St.Joseph, MN 5656374 RE: Annual Municipal Fee Report Requirement Pursuant to Minn. Stat. § 3266.145 Dear Ms. Weyrens: On May 7, 2019 and July 23, 2019,the department notified municipalities that if they collect more than $5,000 in fees related to construction and development in a calendar year that they are required to submit a Municipal Fee Report by June 30 each year. This requirement was passed into law in 2001. See Minn. Stat. § 3266.145. Because we have not received a report from your municipality despite two requests,the department is providing you with this final notice. Failure to provide a completed report by the close of business Friday, September 6,2019 will result in formal administrative action against your municipality, including a potential monetary penalty of up to$10,000 pursuant to Minn. Stat. § 3266.082, subd. 7. If your municipality does not meet the$5,000 threshold for reporting,you need only to complete the attached form and either email it to eileen.mcniff@state.mn.us or mail to the address below. For those municipalities that are required to submit a report because they collect more than $5,000 in fees, there are two options available for you to submit the required information: Option 1 --submit online: This is available at https://www.dli.mn.Rov/workers/licenses-permits-and-plan-reviews/municipal-revenue- reporting-system for municipalities to complete,submit and print a report online. Each municipality shall annually report by June 30 to the department,in a format prescribed by the department,all construction and development-related fees collected by the municipality from developers,builders,and subcontractors if the cumulative fees collected exceeded$5,000 in the reporting year,except that,for reports due June 30,2009,to June 30,2013, the reporting threshold is$10,000.The report must include: (1)the number and valuation of units for which fees were paid; (2)the amount of building permit fees,plan review fees,administrative fees,engineering fees,infrastructure fees,and other construction and development-related fees;and (3)the expenses associated with the municipal activities for which fees were collected. A municipality that fails to report to the department in accordance with this section is subject to the remedies provided by section 326B.082.
