The fee schedule is split out by department for ease of scanning through the fees. Changes are in red. The Water and Sewer usage rates are still being reviewed with Waterworth, our contractor for financial analysis of the funds. The proposed water/sewer usage rate changes in the draft fee schedule are based on the 2024 analysis of the funds. Below are discussion items for the proposed changes. Administration: ~Assessment Fees – propose increases to keep up with labor rates and certification fees. Central MN cities are charging over $100 certification fees for delinquent accounts. ~Collection Charges – propose increase to help cover legal fees for contested cases ~Labor Rate increase to $72 based on average pay and benefits for 2026. This increases fees in other areas throughout the fee schedule. Fire: ~Dama Box proposed to increased based on cost from vendor. ~Pool Fill water fees proposed to increase the same as the bulk water fees under the utility rates. Police: ~Administrative Hearing Fee – propose increase to help cover legal fees for contested cases Planning-Zoning: ~Redevelopment TIF Escrow Fees – fee to cover city’s cost to determine if a property qualifies for a redevelopment TIF. Unused escrow fees will be returned to the applicant. Licenses & Permits: ~ Special Event Escrow – charge for staff time to block off roads, move picnic tables, etc. for event Rentals: ~Bike Share Fee – program discontinued in Aug. 2025 ~Soccer Fields – consolidated rental fee to just summer period ~Adult Softball – increase fee for concessions and field prep to cover city costs ~Schneider Field Fees – Changes to cover costs to maintain fields and future improvements Building: There are no proposed changes for 2026. Costs are recovered with the current fees. Utility Rates: ~ Refuse/Recycling – fees proposed to increase with the Republic Services contract (through 2026) ~ Sewer – Waterworth rate analysis still ongoing. The fund has a sufficient reserve to postpone increases in 2026 and buy down the reserves. ~ Stormwater Rates proposing a slight increase to ensure fund can cover MN and US regulations. Rates have not increased in the past several years. We have been buying down reserve balances. Utility Fees: ~ Bulk Water/Sewage Dumping -increases due to water/sewer usage rate increases proposed. ~Interim Meter Reading – increase to proposed labor rate fee. ~Cellular Interim Meter Read – staff can read these meters from city hall versus sending out Public Works staff to get an electronic read. Proposing a lower rate ~Cellular Meter Read Head – increased fee due to costs from vendor Compensation: ~Fire Department- The pension rate of $4,600 was approved by Council in September BUDGET IMPACT Proposed fees were incorporated into the 2026 draft budget revenue numbers. PREVIOUS COUNCIL ACTION Council approved the C.U.P. on November 20th, 2023. An extension request was approved in 2024 which extended the C.U.P. an extra year to November 20th, 2025. To-date no progress has been made on the C.U.P. (execution of Development Agreement still needs to occur, site plan submittals, permit submittals, etc.) REFERENCE AND BACKGROUND Staff reached out to KAB Land LLC (applicant and owner Ken Bellicott) to remind them of the upcoming expiration of their C.U.P. (expires on Nov. 20th) for their Special Event facility. During the discussion Mr. Bellicot indicated they are not inclined to move forward due to the required utility extension placed on his C.U.P.. When originally approved in 2023 it was the intent of the Council at that time to require water/sewer extension to Mr. Bellicots site and installation of a right-turn lane. After speaking with staff Mr. Bellicot believed it was a good idea to come to the Council Work session to discuss with Council. Since 2023 the Council makeup has changed with two new Councilors and a new Mayor so it’s possible a new perspective exists among Council regarding the proper utility extension. Please note the owners still need to execute the Development Agreement with the City. All conditions in the original C.U.P. resolution are still active this request is only for discussion and direction about proper utility extension. This discussion will help Mr. Bellicot determine if he wishes to seek another C.U.P. extension, move forward with the project, or abandon the project at this location. JOSEPH CITY COUNCIL, hereby makes the following Findings of Fact: 1. That the surrounding land uses to the Subject Property are Rural Residential to the North and South; Educational and Ecclesiastical to the East, and R-5 Supportive Care District to the Northwest and West; and 2. That the Special Event Facility will be located on the Northeast portion of the Subject Property as depicted in Exhibit A; and 3. The conditional use will not be detrimental to or endanger public health, safety, morals, comfort, or general welfare of the neighborhood and will be harmonious to the objectives of the Comprehensive Plan of the City; and 4. That the conditional use will not involve activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or general welfare of traffic, noise, smoke, fumes, glare or odors; and 5. That a mix of coniferous and deciduous trees and shrubs and fencing will screen the facility and outdoor ceremony area; therefore, the conditional use will be designed, constructed, operated and maintained so as to be harmonious and appropriate in appearance with character of the area and is not hazardous or disturbing to existing or future neighboring uses as the facility is over eighty 80) feet from the nearest residence; and 6. That adequate utilities and services, including utilities, streets, drainage and other necessary facilities will be extended to service the site per the requirements of the Developers Agreement and at the applicants cost and installation and will not create excessive additional costs for services and/or be detrimental to the economic welfare of the community; and 7. That access will derive from Jade Road a city identified future collector street and proposed vehicular approaches will be designed to not create traffic congestion or interference with traffic or surrounding public thoroughfare; and 8. The facility will provide sufficient off-street parking and loading space as required in the City parking standards and no on -street parking will occur; and 9. The facility will not result in the destruction, loss, or damage of a natural, scenic, or historic feature of major importance; and 10. The soil conditions are adequate to accommodate the proposed use; and 11. The applicant is proposing to install class two gravel surfacing for the parking lot areas and this proposal requires a variance to the paving standards of City Code 502.10 Subd. 5 Section B; and 12. The applicant is proposing to pave (asphalt) the entrance road and drop off areas; and NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA, HEREBY RECOMMENDS APPROVAL OF THE CONDITIONAL USE PERMIT BASED ON THE FOLLOWING CONDITIONS: l . The property owner is responsible for meeting all Federal, State, Local, and City requirements and obtaining any and all permits and licenses. 2. That the applicant shall submit a Site Plan application and all Site Plan standards shall be met and approved prior to allowing a building permit to be issued for the subject property. 3. That a Development Agreement shall be executed as part of this approval and the applicant shall extend sewer and water lines to service their property as shown in Exhibit A of the Development Agreement. Such extension shall be required to be installed prior to the building receiving a Certificate of Occupancy. 4. All lighting shall meet City Ordinance. Lighting (wall and pole) shall be full -cut off style or hooded. 5. All parking shall be met on -site. There shall be no parking in the public right-of-way. 6. The outdoor spaces shall be fully screened with a year-round living fence. Living fence shall be accomplished through a combination of trees, shrubs, and fence as required by ordinance to limit noise and light impacts to the adjacent residential property to the North. A landscape and fencing plan shall be submitted and approved as part of the Site Plan application. Screening shall be of sufficient height and opaqueness. Coniferous trees will be required to achieve year-round screening and final plan will be determined at time of Site Plan. 7. The City shall have the right to inspect the premises for compliance and safety purposes at any time upon reasonable request. 8. All noise generated by the facility shall met the City Noise Ordinance. Any amplified sound/music shall be inside of an enclosed building. Sound amplification systems like speakers and similar devices shall not be allowed to be placed or generated outside of an enclosed structure except when a ceremony is occurring then speakers or similar devices may be used to conduct the ceremony proceedings. Any noise during a ceremony shall still meet the City Noise Ordinance. 9. The City's Liquor Ordinance shall be met. 10. The outdoor ceremony space shall not be used between the hours of 9PM-7AM Sunday — Thursday and 1 OPM-7AM Friday and Saturday. 11. Any large gatherings or events of fifty people or more shall be restricted to private events. 12. Revocation: The City Council shall revoke a conditional use permit when it determines that the terms and conditions of the permit as issued are no longer being complied with. A certified copy of an order of the City revoking a conditional use permit shall be filed with the County Recorder. 13. Expiration: The conditional use permit shall expire if the authorized use ceases for any reason for more than one (1) year. 14. If any significant changes as determined by the Zoning Administrator and Planning Commission occur the applicant shall seek an amendment to this Conditional Use permit. 15. Hours of operation for event uses within the event facility building shall be 8AM-1 OPM Monday Wednesday; and 6AM-12AM on Thursday — Sunday. If a federal holiday or federal holiday eve falls on a Monday — Wednesday then the hours of operation shall be 6AM-12AM.
