Joseph met in regular session on Thursday, August 17, 2006 at 7:00 PM in the 8t. Joseph City Hall. Members Present: Mayor Richard Carlbom, Councilors AI Rassier, Dale Wick, Ross Rieke, Renee 8ymanietz, City Administrator Judy Weyrens City Representatives Present: City Engineer Tracy Ekola Others Present: 8. Paula Revier, Roger Beuning, Randy Torborg, Linda Hutchinson, Maritime Woida, Nancy Hynes, Irene Reber, Jeff Taufen, Katherine Kraft, Jason Novak, Ellen & Bob Wahlstrom Approve Aqenda: Symanietz made a motion to approve the agenda with the following changes: Delete 3(i) Development Agreement - Graceview Estates 4 - The developer has requested this matter be delayed until further notice. If the improvements cannot be completed this year, the developer does not intend to final plat the property. The Developer's Agreement requires the plat be recorded within 30 days of execution. Add 3(i) Police Grant - Requested Action: Authorize execution of a Public Safety Grant between the City of St. Joseph and the MN Department of Public Safety in the amount of $300 to conduct alcohol compliance checks. The motion was seconded by Wick and passed unanimously. Consent Aaenda: Rassier made a motion to approve the consent agenda as follows: a. Minutes - Approve minutes of August 3, 2006. b. Bills Payable - Approve check numbers 037659-037711. c. Police Purchase - Authorize the Police Department to purchase a second bicycle with the necessary equipment with money from the extra equipment fund. d. Gambling - Accept the off-site gambling application for the St. Joseph Lions to conduct a raffle at the St. Joseph Meat Market, 26 _1st Avenue NW, on September 9, 2006. e. Election Judges - Appoint election judges as presented for the September and November elections. f. Surplus Property - Declare 30 pagers, 12 portable radios and 2 mobile radios as surplus property, allowing the same to be disposed of through public sale. g. Seal Coating - Authorize the expenditure of up to $3,000 to seal coat the parking lot at the St. Joseph Community Fire Hall. h. Medical Director - Appoint Dr. Mark Halstrom as the Medical Director for the St. Joseph Volunteer Fire Department. i. Police Grant - Authorize execution of the grant accepting funding in the amount of $300 to conduct compliance checks. The motion was seconded by Wick and passed unanimously. Public Comments to the Aaenda: - No one present wished to speak. 8t. Joseph Fire Relief Association Report: Annually, the Council must accept the 8t. Joseph Fire Relief Association Report. The Fire Relief is the pension program for the Fire Department. Jeff Taufen, treasurer, was present to represent the Relief Association. Taufen presented the Council with the audited Relief Association Report, which indicates that the liability for the 2007 calendar year is $ 7,300. Weyrens clarified that of the $ 7,300 the City is responsible for approximately 45%, with 8t. Joseph Township and 8t. Wendel Township paying the remaining balance. I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I I Draft August 17, 2006 Page 2 of4 Rieke made a motion to accept the 2007 St. Joseph Fire Relief Association Report acknowledging that the liability for the year 2007 is $ 7,300. The motion was seconded by Wick and passed unanimously. Transportation Plan Update: Kate Minier, SEH, approached the Councilors to give a brief presentation on the progress of the 2006 Transportation Plan. She began the discussion by reviewing the adopted completion schedule. Based on the proposed schedule, the Council should receive a dr-aft report of the transportation plan somewhere between October and December with the final report being completed by February. Originally, this project was to be complete within 9 months, however, it may extend to February depending on the status of the other transportation studies. Carlbom questioned if there would be less public input if the process were expedited. According to Minier, public input would not change; however the amount of review time would lessen. She also stated that there is up to date information available on the City's website to include the results of the 1st public input meeting. Based on that first meeting, the most important community issues are controlled growth and transportation. Miner added that they are reviewing three major roadways and that they are planning for community collectors. The three roadways being reviewed include Principal Arterials, Minor Arterials and Collectors. Principal Arterials provide for less access points, but more mobility; whereas, Collectors provide for more access points, but less mobility. At the last Stakeholder meeting, they were asked to break into three different groups and draw on a blank map where transportation planning is needed. As a result, SEH has created a proposed Transportation Map for Council Review. Minier stated that these are preliminary and will change after further review and Council comments. The Council is asked to review the maps and provide feedback prior to the next Stakeholder meeting. The three big areas discussed include the intersection of 121 and 20th Avenue near Jade Road; the NE portion of the City near CR 133 and the West side of the City with access to CR 75. Minier added that the Southwest Beltway was left outof the mix. She also stated that 20th Avenue might change from a collector road to an arterial roadway. Carlbom questioned whether or not there were any representatives present from either the Monastery or the College, to which Weyrens stated there was not as they did not apply. Minier stated that it was interesting to look at the maps created by each group as Field Street was shown running through the Monastery property on each map. Everyone recognizes that there is a need for a road in that area and from a transportation perspective, that area would be the ideal place for the road. The next components to be considered are: . Trails to include points of destination such as parks, etc. · Traffic forecasting . Full build-out to include the whole growth area. St. Joseph Action Group: Linda Hutchinson, 133 - 5th Avenue SE, approached the Councilors to represent the St. Joseph Action Group. She presented them with the fifth and final petition in opposition to the proposed Field Street Corridor. Final Plat - Crescent Hills: Jason Novak was present representing MN Land Development Group. Weyrens stated that the Annexation request and Development Agreement have been prepared for the final plat entitled Crescent Hills. The Developer has not submitted the required easement but has indicated that the property owner is willing to sign the document and will have executed agreement early next week. Within the Development Agreement, two outstanding items remain: Draft August 17,2006 Page 3 of 4 1. Drain Tile - Braun Intertec is currently looking at the site to determine if additional drain tile is needed. According to Ekola, the reason for this it to limit the amount of saturated soil near basement walls. 2. Site Grading - The entire site must be graded with the first phase. Originally, there was no phasing; however the Final Plat showed the plat being constructed in phases. If the entire site is not graded, the streets in phase one will be used to haul an excessive amount of material causing additional wear and tear on the roads. Rassier made a motion authorizing the Mayor and Administrator to execute the resolution accepting the annexation of the area to be known as Crescent Hills. Themotion was seconded by Symanietz and passed unanimously. Rassier stated that he is concerned that the easement has not yet been executed and would prefer to table the Development Agreement until all the documents have been executed. Weyrens stated that the City would not sign the Developer Agreement until the signed easement is received. Wick questioned the number of phases for the development. Ekola stated that it appears that there will be 2 phases and they will be completed by 2008. Carlbom questioned why the developer does not want to grade the entire site. Novak stated that they have not yet reviewed that item. Ekola advised Novak and the Council that the grading is required as it if is not, they would be hauling fill through the first phase during the construction of phase 2. She also added that it is required to allow for street connections. Rassier made a motion to table execution of the Developer Agreement until August 23, 2006 at 5:00 PM to ensure that the easement is signed and received by the City. The motion was seconded by Wick and passed unanimously. CITY ENGINEER REPORTS Minnesota Vehicle Sales Tax Referendum: Ekola advised the Council that on November 7,2006, voters will be asked to vote on an amendment to the Minnesota Constitution, which would dedicate all motor vehicle sales tax to transportation issues. Previously, there were some years in which none of this money was dedicated towards transportation. The proposed amendment would dedicate at least 40% to public transit and not more than 60% to highway projects. Carlbom stated that there are many state agencies in support of the amendment; however, there seems to be some concern with the language stating that at least 40% to public transit and not more than 60% to highway projects. The Coalition of Greater MN Cities is in support of the amendment; however, they feel that the wording should be the opposite with at least 60% to highway projects and not more than 40% to public transit. Wick stated that the APO is also in support of the amendment, but unsure about the wording. Carlbom added that the Motor Vehicle Sales Tax amendment is not the only answer to the problems with transportation funding. The biggest problem is that the funding that is available is not enough to meet the State's transportation needs. Ekola added that past funding for transportation has been spent more on highway purposes rather than public transit. Wick made a motion to execute Resolution 2006-21 with the deletion of the word stron!:llv supporting passage of the proposed amendment. The motion was seconded by Rassier. Ayes: Rassier, Rieke, Symanietz Nays: Carlbom Motion Carried 4:1:0 MA VOR REPORTS School Bond Referendum: Carlbom stated that he met with the Neighbors for School Excellence regarding the proposed K-8 school in St. Joseph. This will be the first time S1. Joseph will have a public Junior High School. This item is on the ballot for September 12, 2006 primary. Carlbom stated that he encourages community support of the referendum. He stated that there would be a School Board meeting on August 24, 2006 at 7:00 PM at the 81. Cloud City Hall Council Chambers. The School District will give a brief presentation and the City Council is welcome to attend. Fire Board Meetinq: Carlbom stated that he attended the Fire Board meeting at which they discussed the Relief Report and the Budget for 2007. COUNCIL REPORTS SYMANIETZ CSAH 2/North Corridor Committee: Symanietz stated that the Committee met and they are working on narrowing down their options. St. Joseph Chamber: Symanietz reported that she attended the 81. Joseph Chamber meeting at which a representative from the St. Cloud Meth Coalition spoke. . WICK - No Report RASSIER Northland Heiohts: Rassier advised the Council that he was surprised how quick the Northland Heights project is coming along and how nice it looks. RIEKE Meetinqs: Rieke stated that he attended the following meetings: . Downtown Committee - Promotions Group: Information is available on the website. · EDA Meeting . Budget Meeting: Follow-up meeting scheduled for August 30, 2006. ADMINISTRATOR REPORTS Assessment Hearinq: Weyrensadvised the Council that due to the bid opening on August 28,2006 and the City is required to provide the assessment information to the residents two weeks prior to the hearing the Assessment hearing will be postponed until September 11, 2006 at 7:00 PM. 2006 Street Improvement Proiect: Symanietz stated that residents have been questioning her to why there is a bump on Baker Street near the construction site. Ekola stated that a temporary utility line is located during the relocation and lining of utility lines. Wick questioned whether or not construction on 1st Avenue SE would be completed before school begins for the 2006-2007 school year. Ekola assured him that it would be completed prior to that. ALIGNMENT RECOMMENDATIONS Following the discussion of the preliminary design comments, Brian asked the group to make recommendations for the study area for presentation to the St. Joseph City Council and Steams County Board. CSAH 2-South (1-94 to CSAH 3 at approximately the Lake W obegon Trail) Brian stated that SRF recommends Alternative Blue 4 because it appears to have the best technical performance of the considered alternatives. Brian noted that Blue 4 also received the largest amount of support at the public meetings. Renee Symanietz moved to recommend Alternative Blue 4 as the preferred alignment. Matt Symalla seconded the motion. The group offered no additional discussion. The group unanimously approved Alternative Blue 4 as the preferred alignment for CSAH 2-South (1-94 to CSAH 3 at approximately the Lake Wobegon Trail). The group unanimously approved moving forward with an Environmental Assessment Worksheet for this portion of the study area. North Corridor (CSAH 133 to Rolling Ridge Road) Brian then stated that SRF recommends the alignment shown for the North Corridor from CSAH 133 to Rolling Ridge Road (note that Yellow 1 and Yellow 2 have the same alignment in this area). Dick Taufen moved to recommend the Yellow Alternative. Renee Symanietz seconded the motion. The group offered no additional discussion. The group unanimously approved the Yellow Altenative as the preferred alignment for the North Corridor from CSAH 133 to Rolling Ridge Road. The group unanimously approved moving forward with a federal Environmental Assessment and state Environmental Assessment Worksheet for this portion of the study-area. North Corridor/CSAH 2~North (CSAH 3 at approximately the Lake Wobegon Trail to CSAH 133) Brian reminded the group that a preferred alignment is not needed at this time for the North Corridor/CSAH 2-North Realignment from CSAH 3 at approximately the Lake Wobegon Trail to existing CSAH 133 as this portion of the study area will likely undergo more extensive environmental documentation. Brian stated that SRF recommends moving forward with some form of an Environmental Impact Statement (EIS) for this portion of the corridor. ENVIRONMENTAL DOCUMENTATION Brian provided more insight into the discussions that recently occurred regarding the St. Joseph North Corridor/CSAH 2 Realignment environmental documentation. Brian reminded the group that SRF met with the Steams County Technical Evaluation Panel (TEP), officials from FHW A and Mn/DOT, officials from the St. Cloud Area Planning Organization (APO), and also with the Project Management Team (PMT) to discuss environmental documentation options. Third Avenue and First Avenue (north of Ash Street) are paved. What's next? The sanitary sewer in the alley between Minnesota Street and Able Street from College Avenue to Third Avenue is being lined. The Contractor is working on sanitary sewer installation on Second Avenue Northeast. Placement of Class 5 and curb and gutter will be starting on Second A venue Southeast and Able Street in the next week, followed by paving. First Avenue Southeast is expected to be paved by September 1, 2006. In: the coming weeks, the Contractor will also be final grading boulevards and placing sod in September. Construction Site Safety Remember, there will be some deep utility trench construction and, of course, heavy machinery operating on site. Heavy equipment and construction in progress can be strong attractions to everyone, especially children. Warn your children not to play near machinery and construction material storage areas. Construction of Bituminous Base Course The Contractor intends to construct the bituminous base course over the next few days. Remember, bituminous is placed atvery hot temperatures (2300 F to 2650 F). Fresh bituminous will stick to your shoes, clothes and just about anything it comes in contact with. Please advise children about the dangers of hot pavement and avoid walking, skate boarding or riding bicycles on the fresh pavement. To avoid unnecessary damage to your floors, check the soles of your shoes before entering your home. The Contractor will use a pneumatic roller to compact the bituminous immediately after placement by the paving machine. All traffic will be kept offthe pavement until the compaction work is complete and a short cooling period has passed. Depending on the air temperature, the fresh pavement will have a tendency to stay warm and soft. Please try to avoid making sharp turns or sudden stops and starts with your automobile. Y o~r cars tires can damage the soft pavement. Topsoil Placement and Rough Grade The Contractor will be hauling topsoil to isolated locations throughout the project to fill in the boulevards disturbed by construction. As the topsoil is placed, the contractor "rough grades" the topsoil to match the pavement and existing turf. Final Boulevard Grading and Sodding Once the topsoil has been rough graded, another subcontractor will perform the "fine grading" work. During the fine-grading phase, the subcontractor shapes the boulevard and removes debris and any large rocks from the topsoil. The edge of the existing turf is also cut during this phase. The boulevard will have a smooth, raked look once the fine-grading work is complete. Finally, a third subcontractor will return to install the rolls of sod. Sprinkler Systems Property owners with a sprinkler system that was removed during construction are encouraged to delay installation of the sprinklers until the sod is placed. At a minimum, you should wait until the Contractor has completed the final grading of the topsoil. The Contractor will be operating equipment on the boulevards as the t-opsoil is placed and graded. Therefore, the potential for damage to the sprinkler lines and heads still exists. Property owners who reinstall sprinklers within the public right-of-way are advised to document the location of the pipes. Be aware that future construction within the right-of-way may require you to move your sprinkler lines again. 2006 Street Improvements St. Joseph; MN Project Update I August 2006 I No.5 Caring for Your New Sod New sod will be placed along the boulevard areas soon. We ask for your assistance to help ensure the sodding work is successful! Walking on the Sod To the extent possible, please avoid walking on your new sod until it has rooted. The topsoil beneath the sod is loose and will compress under foot traffic, especially when the topsoil is moist, leaving depressions in the sod. Until the sod roots penetrate the topsoil, the sod strips may shift. Water The contractor will be responsible to ensure the survival of the new sod for the first 30 days after .placement. After 30 days, it will be entirely up to you to water and maintain. The Contractor will not replace sod that dies after the 30-day maintenance period. The contractor's maintenance efforts will include periodic watering from a pumper truck. On a large project like this one, however, it is difficult to keep up with the demand for water. Your assistance with watering, when combined with the contractors, will help ensure the sod will grow and your lawn looks its best. Your effort will be especially important if there is little rainfall and hot temperatures. New sod requires significantly more watering than mature lawns. More frequent, lighter waterings are not desirable since they encourage development of shallow roots instead of deep roots. Lawns need deep roots to help them withstand periods of little or no rain. During extended hot and dry periods, new sod should be thoroughly soaked every day . You should continue watering the new sod for the remainder of the summer and fall. Mowing Your new sod should not be mowed until either the grass lays over and mats down when wetted or the grass goes to seed. Do not be alarmed if either of these conditions do not occur in the first 30 days. Usually, you may begin cutting your new sod after 2 to 3 weeks. However, it is recommended that you only cut 1/3 of the grass blade off for the first 2 months after placement. Never cut more than 1/2 the height of the grass blade off. Cutting the grass too short will put the sod under stress, encourage drying out, and allow weeds to establish. Fertilizing Do not fertilize your new sod. The sod was fertilized in the field prior to cutting and has enough fertilizer to last for the first 60 days. After the sod has permanently rooted, which usually occurs within the first 60 days, fertilizer may be applied. Consider fertilizing in two different directions using a rotary spreader to avoid streaking. Water the grass immediately after the fertilizer has been applied. . Future Maintenance Remember, even after your new sod appears to have taken hold, it is not as sturdy as an established lawn. It takes a while for the roots to reach their mature length. Until the roots are mature, the sod is still susceptible to dry conditions. Remember to deeply water. It is also advisable to let the sod grow a little longer than normal when conditions are dry. The work will include sealing cracks, spraying a coat of oil over the street pavement, applying a cover of aggregate chips and sweeping. The Contractor will start sealing cracks the week of August 21, 2006, and tentatively plans to seal coat the week of August 28, 2006. Sweeping is completed approximately one week following seal coating. Your Help The Contractor will post no parking signs to notify you the day before seal coating and sweeping. Please keep your vehicle off the streets until aggregate has been placed on the street. It is very important that you do not drive on the streets until the aggregate is placed over the oil. The oil that is applied to the streets is very sticky. The length oftime the oil will remain uncovered should be relatively short. The aggregate will be swept from the streets in a week or so. At a later date, they will be doing a follow-up sweeping to pick up the remaining aggregate.. Also, please do not water your lawn the morning of seal coating. The water will interfere with the oil application. Seal Coat Background Seal coating is a method of prolonging the life of a bituminous street by providing a protective layer on top of existing bituminous. When a street is 10- years old or older, the original oil in the surface has oxidized causing the street to become more brittle, and it will crack easier. By providing a seal coat during this time, the life of the street should be extended another 5- to 10- years, provided the underlying strength has not changed. The seal coat will help lengthen the time in which the pavement will have to be replaced. A project number has been assigned to protect the confidentiality of the businesses prospects. Proiect 01-E: This project involves the expansion of a service within the community. MDG has been keeping in touch with the project contact over the past five years. This prospect has been working with another entity within the community with regard to the sale of land for the expansion of the service in St. Joseph. Most recent contact was on August 16th through an em ail offer to assist contact's architect/engineer by providing applicable codes/standards. Proiect 01-1: This project has been inactive for the past several months but MDG continues to follow up on an occasional basis, including most recently via an email on August 16th which provided the contact an update on activities in St. Joseph. Proiect 02-FF: This project has been inactive for the past several months but MDG continues to follow up on an occasional basis, including most recently by mailing a letter on August 16th including updates on several developments within St. Joseph. Proiect 03-A: This group of developers are contemplating a large highway commercial development in an area not yet annexed into the City. The development representatives are awaiting the results of the Field Street extension corridor prior to moving forward with a potential project. MDG continues to maintain active correspondence with this prospect including by phone and/or email on July 1 ih, July 19th, July 20th and August 18th. Proiect 04-F: This prospect contacted MDG in May of 2004 regarding commercial lease space in the downtown area. The prospect continues to express occasional interest in a project in downtown. MDG last spoke with one of the owners of the project in late July. Additional investors are coming on-board. Principal contact remains in touch with City Administrator re: rehabilitation. Proiect 04-N: This business is currently a home occupation in an adjacent area. The business owner contacted the City in 2004 re: industrial acreage. The business prospect recently executed a purchase agreement for the final vacant lot within Buettner Business Park. A site plan has been drafted but not yet submitted for approval by the City. The construction timeline is tentatively 2007. MDG remains in touch with the property owner including mail on August 16th. Project 05-D: MDG spoke to the project representative initially in June of 2005 to respond to very preliminary requests. MDG met with the prospect and an industry specialist from the Mn. Department of Employment and Economic Development later in the year. MDG continues to remain in contact with this prospect including most recently via mail on August 16th. Proiect 05-1: This project involves a potential new investment within the business community. Property has been secured and concept planning is on-going. The EDA and City Council approved a preliminary application for TIF assistance in May. Final TIF application is being drafted. MDG remains in touch with the prospect including most recently on August 16th. Final TIF application expected in October 2006. Project 05-J: This developer contacted MDG in Mid-December and is seeking three to five acres of industrial land to establish a new distribution facility. MDG has been in contact with the prospect on several occasions and has forwarded information to the owners of potential industrial lots in the City. MDG has met with this prospect and encouraged prospect to secure interest from investors and financing. In the meantime, MDG occasionally follows up to offer assistance including via email on August 16th. Project 06-B: This project involves investment in commercial property within the City of St. Joseph. MDG has met with the prospect on two occasions and forwarded information as requested. MDG last followed up with this contact on July 19th via mail. The project representative remains concerned about existing transportation studies and how they impact potential development. Project 06-C: This lead was forwarded from the SCAEDP. The contact is interested in two acres of shovel ready industrial property somewhere in the St. Cloud area. Strack followed up with the contact via phone on June 21st. No further decision has been made, project on hold. Project 06-D: This project involves the relocation of a production facility from a nearby township to an urban service area. This contacted phoned MDG in March with a request for information. MDG mailed requested proposal to the Company and routinely follows up with the project representative. Last contact occurred by email on August 19th. Project 06-E: This project involves starting a new restaurant within the City. The project representative phoned MDG in March with a request for information. MDG coordinated request with project 05-1.
