INTERIM ORDINANCE
The Council of the City of St. Joseplihereby ordains:
That the St. Joseph Code Book is amended by the addition of following Interim
Ordinance:
And VlHEREAS the present zoning ordinances regulating the use of signs within the City
appear inconsistent and inadequate to achieve that balance, and the City Council has authorized a
study to determine whether and how the zoning ordinances should be amended to better achieve
that balance.
THE ST. JOSEPH CITY COUNCIL HEREBY ORDAINS that it is necessary to impose a
moratorium on the permitting of new signs of any kind in order to allow sufficient time for said
study, and to protect the enforcement of zoning regulations and the heaith, safety and welfare of
the citizens of the City of St. Joseph. The moratorium shall include, but not be limited to, the
permitting oftemporary signs, portable signs, advertising signs and business signs within the
City. The moratorium shall not apply to requests in regards to signs already existing necessitated
by emergency circumstances. The moratorium shall continue in full force and effect for one year
from the date of adoption, or until such time as the City Council has amended the zoning
ordinances. The City Council reserves the right to extend the effective period of this Interim
Ordinance in accordance with Minn.Stat. 462.355, Subd. 4.
This ordinance is adopted pursuant to the recommendation of the Planning Commission
of the City of St. Joseph to the City Council on July _, 2006. The ordinance is hereby adopted
on , 2006 and shall be immediately effective.

PUBLIC HEARING
Notice is hereby given that the Council will meet at 7:00 PM on September 11, 2006 at the City of St.
Joseph Council Chambers to consider, and possibly adopt, the proposed assessment for the
improvement of 8th Avenue NE between Minnesota Street East and CSAH 75 to include utility extension
and street, curb, and gutter. Adoption by the Council of the proposed assessment may occur at the
hearing.
The proposed assessment role is on file for public inspection at the City Clerk's Office. The total amount
of the proposed assessment is $ 275,000.00. Written or oral objections will be considered at the meeting.
No appeal may be taken as to the amount of an assessment unless a written objection signed by the
affected property owner is filed with the City Clerk prior to the assessment hearing or presented to the
presiding officer at the hearing. The Council may upon such notice consider objection to the amount of a
proposed individual assessment at an adjourned meeting upon such further notice to the affected
property owners, as it deems advisable.
An owner may appeal an assessment to district court pursuant to Minn. Stat. 429.081 by serving notice of
the appeal upon the mayor or clerk within 30 days after the adoption of the assessment and filing such
notice with the district court within ten days after service upon the mayor or clerk.

TO WHOM IT MAY CONCERN:
Notice is hereby given that the Council will meet at 7:00 PM on September 11, 2006 at the City of St.
Joseph Council Chambers to consider, and possibly adopt, the proposed assessment for the
improvement of 8th Avenue NE between Minnesota Street East and CSAH 75 to include utility extension
and street, curb, and gutter. Adoption by the Council of the proposed assessment may occur at the
hearing.
The amount to be specially assessed against your particular lot, piece, or parcel of land is see attached.
Such assessment is proposed to be payable in equal annual installments extending over a period of 15
years, the first of the installments to be payable on or before the first Monday in January 2007 and will
bear interest at the rate of six percent per annum from the date of the adoption of the assessment
resolution. To the first installment shall be added interest on the entire assessment from the date of the
assessment resolution until December 31, 2006. To each subsequent installment when due shall be
added interest for ooe year on all unpaid, installments.
You may at any time prior to certification of the assessment to the county auditor, pay the entire
assessment on such property, with interest accrued to the date of payment, to the City Clerk. No interest
shall be charged if the entire assessment is paid within 30 days from the adoption of this assessment.
You may at any time thereafter, pay to the City Clerk the entire amount of the assessment remaining
unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment
must be made before November 15 or interest will be charged through December 31 of the succeeding
year. If you decide not to prepay the assessment before the date given above the rate of interest that will
apply is six percent per year. The right to partially prepay the assessment according to Ordinance No. 37
is available.
The proposed assessment role is on file for public inspection at the City Clerk's Office. The total amount
of the proposed assessment is $ 210,573.17. Written or oral objections will be considered at the meeting.

If an assessment is contested or there is an adjourned hearing, the following procedure will be followed:
1. The city will present its case first by calling witnesses who may testify by narrative or by
examination, and by the introduction of exhibits. After each witness has testified, the contesting
party will be allowed to ask questions. This procedure will be repeated with each witness until
neither side has further questions.
2. After the city has presented all its evidence, the objector may call witnesses or present such
testimony as the objector desires. The same procedure for questioning of the city's witnesses will
be followed with the objector's witnesses.
3. The objector may be represented by counsel.
4. Minnesota rules of evidence will not be strictly applied; however, they may be considered and
argued to the council as to the weight of items of evidence or testimony presented to the council.
5. The entire proceedings will be tape-recorded (video-taped).
6. At the close of presentation of evidence, the objector may make a final presentation to the council
based on the evidence and the law. No new evidence may be presented at this point.
7. The council mayadopt the proposed assessment at the hearing.
An owner may appeal an assessment to districtcourt pursuant to Minn. Stat. ~ 429.081 by serving notice
of the appeal upon the mayor or clerk of the city within 30 days after the adoption of the assessment and
filing such notice with the district court within ten days after service upon the mayor or clerk.

Bids were opened in the City Hall at 11:00 a.m. on Monday, August 28,2006, for the above-referenced

RESOLUTION ACCEPTING BID
WHEREAS, pursuant to an advertisement for bids for the improvement of 8th Avenue NE between
Minnesota Street E and CSAH 75 to include utility extension and street, curb and gutter, bids were
received, opened and tabulated according to law, and the following bids were received complying
with the advertisement:

AND WHEREAS, it appears that C & L Excavating, Inc of St. Joseph is the lowest responsible
bidder.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA:
1. The Mayor and City Administrator are hereby authorized and directed to enter into the attached
contract with C & L Excavating of St. Joseph in the name of the City of St. Joseph for the
improvement of 8th Avenue NE between Minnesota Street E and CSAH 75 to include utility
extension and street, curb and gutter according to the plans and specifications therefore
approved by the city council and on file in the office of the City Administrator.
2. The City Administrator is hereby authorized and directed to return forthwith to all bidders the
deposits made with their bids, except that the deposits of the successful bidder and the next
lowest bidder shall be retained until a contract has been signed.

This letter has been prepared to provide you with notice and information regarding a
proposed suspension or revocation of the rental license for the above referenced
property. This action is being taken because of an alleged violation of Ordinance
No. 102 of the S1. Joseph Code of Ordinances. This violation is alleged to have
arisen out of an incident on September 1, 2006 (copy enclosed) .

The S1. .Joseph City Council will review these allegations and consider appropriate
action, including a suspension or revocation of your rental license, for up to a period
of twelve months. The meeting will be conducted on Monday, September 11, 2006
at 7:40 p.m. 'in the S1. Joseph City Hall, 25 College Avenue North.
At that time you are entitled to a hearing to be conducted in accordance with
Minnesota Statutes 14.57 to 14.70. This hearing will be for the purpose of
determining whether or not the alleged violation did in fact occur. At that hearing,
you have the right to cross-examine witnesses and present evidence on your
behalf. The proceedings will be video recorded. Based upon the evidence
presented, the Council will then make a determination as to whether or not the
alleged violation did in fact occur.
If you wish to have an evidentiary hearing of this type, you must contact the City
Clerk/Administrator in writing at least five days prior to the scheduled Council
meeting. If a request for hearing is not received by the City Clerk/Administrator at
least five days before the hearing, you will then be considered to have waived your
right to have an evidentiary hearing and no evidentiary hearing will be scheduled. A
waiver of this right to hearing will be equivalent to an admission of the basic
allegation (s) alleged herein and reported by the complaining party.
If you waive your right to hearing, or if an evidentiary hearing is conducted and the
Council determines that a violation did occur,' then and in those events, the Council
will proceed immediately to consider a disposition, which may inciude

On 09-01-2006, r was on patrol in the City of St. Joseph. I was standing in front of our police garage talking
with Officer Meyer of the St. Joseph Police Department and Sgt John Lentz of the Stearns County Sheriffs
Department. At approximately 0125 hrs, we heard someone start banging on a drum trap set with bass drum
and cymbals. I then heard and electric guitar followed by loud cheering. After about five minutes, a couple
students walked by us and stated, "Boy, that is really loud over there". I told the other officers that I was going
to go over and get them to quit. As 1 walked up to the windows where the music was coming from, r could see
that there were people sitting shoulder to shoulder ail the way around the room watching the show. There were

one ofthe renters as Benjamin James Harper 06-11-84 by MN DL. r-Iarper said, "Lets go, we got about] 0
minutes before the cops wili be here" and then started playing the drums again with more cheering. I then
immediately flashed my flashlight in the eyes of the guitar player who was looking towards the window. The
guy stopped playing immediately when he appeared to recognize me. Someone repeatedly tapped the drummer
and kept repeating, "Cops". I went around to the front of the house. J saw a male sitting on the front porch
chair that later identified as Bnmdol] Royce-Diop 07-17-85 by MN DL. I asked Diop ifhc was one of the
renters. Diop stated that he was not. I asked Diop if he knew who they were. Diop stated, "what's it to you". I
infol111ed Diop of the violation and he began arguing with me on why I was even there. I went to the door and
knocked on it. Someone opened the door and everyone just stared at me. I yelled inside for a renter to come
out. No one moved. I repeatedly asked for a renter and no one moved. I informed all that if no one was a
renter that they all had to leave or they would be arrested. A bunch of them made it to the door and were about
to leave when Diop stood up f)'om his chair and began challenging me. Diop told me that they did not have to
leave and were not going to. At this time the group stopped and kind of circled around me. I called for Sgt
Lentz and Officer Meyer to arrive to my location. They were just arriving when I called. Officer Thelen of
WPPD heard our radio traffic and started towards my location. At this time Harper came forward and admitted
to being a renter. I informed Harper that due to his negi igent behavior and actions of his guests, he would be
receiving a noise violation. Harper began arguing with me. 1 informed the other officers to remain with the
partygoers and I was going to go and write out the citation for noise violation.
After I wrote out the administrative citation, I returned to the front of the house and discovered that everyone
was gone except the two officers. I asked them where Harper was and they were unsure ifhe left with everyone

After 1 returned to the house and was accompanieclby Officer Thelen. We walked around and looked into .'
the windows and observed 5 people were back inside.the.living room of which one was HarpeLl went around
and knocked on the door. An unknown male opencd'lL 1 could see I Impel" sitting in the living room. !
instructed him to come out. I iarper came oLltand immediately started demanding his license gel returned.
Harper statcd that be would not cooperate until that ~as flone. I told Harper that it would be given baek to him
only after 1 was done explaining myself and what he hadgot in trouble for. As we were arguing, another male
1D by MN DL as Kurtis Robert Kipka 03-08-85, walkcd up and got into the argument. Kipka stated that he
too was a renter and had just walkcd horne and did not hear any music. After we got him calmed down and
informed him that Vie were just doing some follow up from the earlier incident, he became much more
reasonable to deal with. Harper never scttled down and at one point one of his friends took. him inside the house
so that he would not be arrested on more charges. Harper could be heard inside the residence throwing things
around. Kipka just shook his head. After a couple minutes Harper came back outside and demanded his
license. After seeing that it was going to be impossible to rationalize with Harper. 1 returned his license and
informed him that the Chief would be by latcr in the morning to deal with him. '

We, the undersigned, reject the 8th Ave. N.E. road improvement bid as proposed. The project is
of no benefit to us as homeowners on 8th Ave. with the exception of water and sanitary sewer.
The party benefiting the most and gaining the most financially is the petitioner/developer.
We believe widening the road would actually reduce the value of our property, will take away
property owners' footage and can cause the lose of very valuable mature trees. These trees are
irreplaceable.
It has been brought to our attention that there is no county record of an easement for that part
of the road that crosses over the Notch's property. The road has never been platted.
We see no need for curb and gutter. The road, as designed, has had adequate drainage for as
long as anyone can remember and drains as well as city streets with curb and gutter. The
swales on both sides of the road, as designed, serve well to catch and provide water for the
large trees lining the street.
We believe the cost is prohibitive. Weare on fixed incomes and unlike the petitioner for this
road project, we cannot pass our costs on as the developer is able to do. The costs may exceed
the benefits
We object to paying 100% of the road improvement costs. We also know we are a part of the
1975 orderly annexation agreement which specifies cost sharing. We have been citizens and
residents of St. Joseph since 1992. There was and is a policy and, customarily, costs of an
improved road are split between property owners and the city. We feel we are entitled to the
same cost sharing as current residents.

exceed the value of the homeowner's property.
