Meeting Minutes - Wednesday, September 26,2007
Present: EDA Board Members Carolyn Yaggie-Heinen, Ken Jacobson, AI Rassier, Tom Skahen
and Dale Wick.
Absent: None.
Also present: Cynthia Smith - Strack of Municipal Development Group.
Chairperson Wick called the September 26, 2007 regular meeting of the St. Joseph EDA to order
at 3:05 p.m.
Agenda.
Chairperson Wick introduced the agenda.
Moved by Skahen seconded by Wick to approve the agenda as presented. Motion carried 5-0.
Approval of Minutes.
Chairperson Wick introduced the minutes from the August 22, 2007 regular meeting. Motion by
Rassier, Second by Skahen to approve minutes from the previous meeting provided "Johnson"
changed to "Jacobson" on page one of the minutes. Motion carried 5-0. -
EDA Accounts Payable.
Wick introduced the topic. Strack noted accounts payable for the month totaled $3,011.39
including preparation of TI F reports for both 1-3 and 1-4.
Motion by Rassier, second by Skahen to approve the EDA accounts payable for the month of
August 2007 in the amount of $3, 011.39. Motion carried 5-0.
Financial Report.
Wick introduced the agenda item. Strack noted the financial reports included in the packet were:
revenue, expense, check register and fund balance.
Motion by Jacobson, second by Heinen to approve the August financial reports as presented.
Motion carried 5-0.
Revolving Loan Fund Policy.
Chairperson Wick introduced the agenda item.
Strack noted at the previous meeting the EDA approved Revolving Loan Fund standards and
application processing procedures. However, the EDA requested additional information be
provided regarding a subgroup of the EDA which could be established to review the
appropriateness of the level of assistance requested. The subgroup would make a
recommendation to the full EDA regarding the appropriate amount of assistance based on the
request. The subgroup is proposed to be one member of the EDA, the City's Finance Director
and the EDA Director.
The EDA discussed the additional subgroup review and noted comment on the appropriate level
of funding would be welcomed. The process will be added to review procedures for the RLF.
EDA Minutes - September 26, 2007
Review of City Website.
Wick introduced the agenda item. Strack noted that at the previous EDA meeting she was
directed to review and update material posted on the City website and the Community Profile as
listed on the MnPRO website.
Since the previous meeting, material on the City Website relating to the EDA and downtown
revitalization has been updated. In addition the community profile as listed on the Mn.
Department of Employment and Economic Development's MnPRO website has been updated.
The EDA reviewed the updated web pages and the community profile included in the packet.
The following changes were recommended:
1. On the EDA page on the City website, add St. Cloud Public School District, Kennedy K-8
and the Lab School to the section titled "Education".
2. On the EDA page on the City website, add information regarding cultural activities to the
"Recreational Opportunities" section.
3. On the EDA page on the City website, add pharmacy to the section regarding "Health
Care".
4. On the EDA page on the City website, delete the final sentence in section titled "Utilities"
and "Sanitary Sewer".
Progress on 2007 Goals.
Chairperson Wick introduced the agenda item. Strack noted that proposed goals for 2007 were
set forth as part of the EDA's annual report to the City Council in January of this year. An update
on progress toward those goals was included in the meeting packet.
The EDA reviewed progress toward 2007 goals and other work list priorities. Jacobson suggested
partnering with the Chamber of Commerce to extend street lighting, planters and banners from
where they currently end adjacent to College Avenue North to the Wobegon Trail Center. Skahen
suggested providing additional community notices and advertising at the Trail Center could
encourage trail users to remain in the City longer. Jacobson suggested working with the Park
Board to create a map of City park/trail facilities and area business attractions.
Wick and Rassier noted they were not members of the EDA when discussion regarding CSAH 75
renewal occurred. Strack was directed to forward the technical inventory and renewal plan to both
Wick and Rassier for their information.
Update Schellinger Project.
Chairperson Wick introduced the agenda item. Strack noted the EDA/CC previously approved a
preliminary application for the use of tax increment financing in conjunction with the development
of a commercial condominium (owner occupied) at 24 North College Avenue (Dave Loso
Property). The applicant has since withdrawn his request for tax increment financing and
cancelled his purchase agreement for the property. The project not moving forward was due to
circumstances beyond the control of the applicant. The applicant did attempt to find alternate
investors for the project but was ultimately unsuccessful.
Also, the Parkway Business Center final plat has not yet been submitted to the City. In speaking
with the developer's engineer the property owners are no longer contemplating installation of
utilities this fall but rather next spring. The applicant was notified of an Ordinance requirement
specifying final plat must be submitted within 120 of preliminary plat approval with the potential for
a single 30-day extension.
EDA Minutes - September 26, 2007
Board Member Reports.
Wick noted he would be meeting with Tom Moore and Jerry Hirshfeld on October 3rd to tour the
former DBL Labs facility. Purpose of the meeting is to learn more about the facility for marketing
purposes. EDA members invited to attend.
Rassier requested the EDA consider moving the regular meeting of the EDA to the fourth
Wednesday at three p.m. due to a scheduling conflict.
Motion Heinen, Second Jacobson to move the regular meeting date to the fourth Wednesday of
each month provided meeting space was available. Motion carried 5-0.
Adjournment.
Motion Skahen, second Rassier to adjourn the EDA meeting. Meeting adjourned at 4:10 PM.

Councilors As you are likely aware, the Freedom to Breath provision of the Minnesota Clean Indoor Air Act
Steve Frdnk became effective on October 1st. The Act prescribes where smoking is prohibited, outlines the
Rick Schultz responsibility of employers and facility managers and lists exemptions.
Renee Symdnietz As a result of the Act the City expects to receive requests from the owners of bars, restaurants
Ddle 'Wick and other food and liquor establishments to install outdoor smoking and/or dining areas.
The City's current zoning ordinance doesn't address outdoor smoking/dining areas and/or
sidewalk cafes, however, liquor license requirements for businesses prescribe certain standards
for the permanent sale, possession and consumption of liquor outdoors in conjunction with a bar,
restaurant or other liquor or food service establishment.
Staff and consultants discus,sed this issue at a staff meeting on October 10th. Background
information and sample language has been developed as a means of initiating conversation on
this subject.
Since the subject directly impacts businesses input' from the EDA is kindly requested prior to
additional review/consideration by the public, Planning Commission, and the City Council.

OUTDOOR DINING/SMOKING AREAS AND SIDEWALK CAFES.
A. Outdoor smoking/dining areas are permitted accessory uses in conjunction with a
restaurant, coffee shop, or other eating and drinking facility provided a site plan is
approved by the Planning Commission and the following requirements are met:
1. No portion of the outdoor smoking/dining area shall be located or occur within a
public right-of-way or be located or occur closer than two feet from any property
line.
2. If the outdoor smoking/dining area is proposed to be within a City drainage and
utility easement, the property owner shall enter into a written agreement
authorizing the use of the City's easement.
3. Patrons must gain entrance to the outdoor area from within the main facility,
however at least one exit must be provided for fire safety.
4. If intoxicating liquor is intended to be served in the outdoor dining/smoking area,
the standards of Section 71.11, Subd. 5 of the City Code as may be amended
shall apply.
5. The Planning Commission and/or City Council may restrict days, hours, nature
and volume, and other aspects of entertainment in any outdoor smoking/dining
area, including a prohibition against all forms of music, radio, television, and
other entertainment, to protect the safety, repose, and welfare of residents,
businesses and other uses near the establishment.
6. The Planning Commission and/or City Council may restrict the hours of operation
of an outdoor smoking/dining area based upon the proximity of the area to
residential dwelling units, and upon considerations relating to the safety, repose,
and welfare of residents, businesses, and other uses near the establishment.
7. The outdoor smoking/dining area shall be handicap accessible and not restrict
accessibility in other areas inside or outside the restaurant or food establishment.
8. The outdoor smoking/dining area shall be subordinate to the principal restaurant,
coffee shop, or other eating/drinking establishment and shall not exceed 33% in
area of the square footage of the principal restaurant building.
9. The design of the outdoor smoking/dining area shall be compatible with the main
structure to which the outdoor facility is ancillary.
10. The outdoor smoking/dining area shall be a well-defined space surrounded by
decorative bollards, planters or fencing. A fence surrounding an outdoor
smoking/dining area shall be suitable for the intended use. If a fence is proposed,
a fencing plan shall be submitted for review and approval by the city.
11. The outdoor smoking/dining area shall be kept in a clean and orderly manner.
No food or beverages may be stored outdoors.
12. The outdoor smoking/dining area shall be designed and serviced to prevent
debris from blowing off the premises. The business and/or property owner shall
be responsible to ensure that the area is properly maintained and litter-free.

13. The outdoor smoking/dining area must conform to all fire and building codes
related to the number and types of exits that are required and maximum
structural occupancy limits.
14. The Planning Commission or City Council may require the notification of property
owners if the outdoor smoking/dining area is located closer than 350 feet from
residential properties.
15. The parking regulations related to minimum required spaces as set forth in this
chapter shall apply and compliance therewith shall be maintained.
16. The maximum surface coverage requirements set forth in this chapter shall apply
and compliance therewith shall be maintained.
17. Smoking shall not be allowed in areas meeting the definition of 'indoor area' as
defined by the Freedom to Breathe Provision of the Minnesota Clean Indoor Air
Act. "lnd66Farea" means an space between a floor and a ceiling that is bounded
by walls, doorways, or windows (whether open or closed) covering more than 50
percent of the combined surface area of the wall space constituting the perimeter
of the area. A screen is not considered a wall.
B. Sidewalk cafes are permitted accessory uses within the B-1 Central Business District in
conjunction with a restaurant, coffee shop, or other eating and drinking facility provided a
site plan specifying the area in which the cafe will be operated is approved by the
Planning Commission, a minimum of five (5) feet of sidewalk width remains for
pedestrians, and the following requirements are met:
1. Sidewalk cafes shall be limited to the placement of tables, benches, chairs on
portions of sidewalks immediately adjacent to the business operating them.
2. A sidewalk cafe may not occupy any portion of a public street.
3. Maintenance of all private facilities on public property shall be the owner's
responsibility.
4. Sidewalk cafe facilities including, but not limited to, tables, chairs, and benches
shall not be left outdoors after business hours or between the hours of ten p.m.
and 6 a.m.
5. Establishments holding an on-sale intoxicating liquor license shall not be eligible
for sidewalk cafe approval.
6. Patrons shall not be served food or beverages outside, except that employees
may refill beverage containers in the seating area. At no time shall the sidewalk
cafe area be used for consumption of alcoholic beverages.
7. The business and/or property owner shall be responsible to ensure the sidewalk
cafe area is properly maintained and litter-free. Sites of sidewalk cafes shall be
maintained in an orderly, clean and sanitary manner and be free of debris at all
times. Trash containers and staffing shall be available at all times to facilitate this
condition. Litter shall be picked up on a daily basis.
8. The Planning Commission and/or City Council may require businesses operating
sidewalk cafes routinely sweep and/or wash portions of sidewalks impacted by
such cafes.

9. The sidewalk cafe area shall not block access to the building entrance or

10. Sidewalk cafe operators shall provide proof of insurance on an annual basis.

A summary of the Freedom to Breathe Provisions in the Minnesota Clean Indoor Air Act
Background
The Freedom to Breathe (FTB) provisions were
signed into law by Governor Tim Pawlenty on May
16,2007, to protect employees and the public from
the health hazards of secondhand smoke. The FTB
provisions are an expansion of the current
Minnesota Clean Indoor Air Act (MCIAA); the new
provisions become effective on October 1, 2007.
The FTB provisions describe where smoking is
prohibited, outline the responsibilities of employers
and facility managers and list exemptions within the
new MCIAA provisions that affect their workplaces
and facilities.
Public Health Issue
Secondhand smoke is a leading cause of
preventable death in the United States. "In 2005, it
was estimated that exposure to secondhand smoke
kills more than 3,000 adult nonsmokers from lung
cancer, approximately 46,000 from coronary heart
disease, and an estimated 430 newborns from
sudden infant death syndrome."[
According to the U.S. Surgeon General, there is no
safe level of exposure to secondhand smoke.
Secondhand smoke causes premature death and
disease in children and in adults who do not smoke.
Smoking-prohibited areas
On October 1, 2007, smoking will be prohibited in
virtually all indoor public places and indoor places
of employment, including:
· Bars, restaurants, and private clubs
· Office and industrial workplaces
. Retail stores
· Common areas of rental apartment
buildings, hotels and motels
· Public transportation, including taxis
· Work vehicles, if more than one person is
present
· Home offices with one or more on-site
employees, or used as a place to meet or
deal with customers

Definition of "Indoor Area"
"Indoor Area" meanS all space between a floor and
a ceiling that is bounded by walls, doorways, or
windows, whether open or closed, covering more
than 50 percent of the combined surface area of the
vertical planes [wall space] constituting the
perimeter of the area, whether temporary or
permanent. A [standard] window screen is not
considered a wall.
Permitted smoking
The law does not prohibit smoking in the following
locations or circumstances:
. Outdoor smoking, regardless of distance
from building openings such as doors and
windows
. Approved scientific study participants
· Traditional Native American ceremonies
· Private places, such as private homes,
residences or automobiles when they are
not being used as places of employment
· Sleeping rooms of hotels and motels
· Tobacco product shops - whim customers
are sampling tobacco products
· Cabs of commercial motor vehicles that
weigh over 26,000 pounds
· Farm trucks, implements of husbandry, and
special mobile equipment
· Family farm buildings, provided certain
conditions are met
· Disabled Veterans Rest Camp in
Washington County
· Theatrical productions, that is, actors and
actresses who are smoking as part of the
theatrical performance

Responsibilities of proprietors
Employers and facility managers continue to play
an important role in controlling smoking in their
place of business. In general, they are required to:
. Post "No Smoking" signs
. Ask persons who smoke in prohibited areas
to refrain from smoking and to leave if they
refuse to do so
. Use lawful methods consistent with
handling disorderly persons or trespassers
for any person who refuses to comply after
being asked to leave the premises
. Refrain from providing ashtrays and other
smoking equipment
. Refuse to serve noncompliant persons
Compliance and Enforcement
As part of the Minnesota Department of Health' s
(MDH) compliance strategy, emphasis will be
placed on educating the public and business owners
on the new provisions. MDH has compliance
authority over the MCIAA and may delegate
compliance activities to local units of government.
In addition to the compliance authority provided to
MDH and local units of government, local law
enforcement has the authority to issue petty
. misdemeanor citations to proprietors or individuals
who knowingly fail to comply with the MCIAA.
Local government ordinances
Local governments retain the authority to adopt and
enforce more stringent measures to protect
individuals from secondhand smoke.
Other provisions of the act
. Charitable gambling impact study. The
state Gambling Control Board will prepare
a report on the law's possible impact on
charitable gambling. The act requires the
board to submit a report to the Governor
and the Legislature before March 31, 2008.
. Dislocated worker program; allocation of
funds. The Minnesota Jobs Skills
Partnership Board will provide services
under the dislocated worker program to
certain employees who become
unemployed between October 1,2007 and
October 1, 2009, because of the FTB
provisions of the MCIAA.

Freedom to Breathe Act and Outdoor Patios
he Freedom to Breathe Act
(FBA) will take effect Oct. 1,
2007. The FBA expands the
Minnesota Clean Indoor Air Act
to prohibit indoor smoking in all
workplaces that employ two or
more people, or serve the general
public. Bars, restaurants, and "any
other food or liquor establishment" are
explicitly listed as places where smok-
ing is forbidden.
Cities may receive requests from
on-sale liquor license holders to install
outdoor patio areas with tables and
chairs for the convenience of their
customers. The FBA does not prohibit
outdoor smoking on these types of
patios. It is important to note that
certain sheltered patios with roofS
and walls may be considered interior
areas that are subject to the FBA.
Typically, cities are receiving two
types of requests for patios. In some
instances, the patio is intended as a
smoking area only, where no food or
beverages will be served or consumed.
In other instances, the patio is intended
to be an expansion of the bar area,
where customers may order and con-
sume alcohol. Both types of patios may
be regulated by the city.
Patios where alcohol is served and
consumed. Under Minnesota Rule
~7515.0430 construction of a new patio
addition where alcohol will be served
and/ or consumed requires the license
holder to seek an amendment to their
on-sale liquor license from the city.
The rule requires that a liquor license
specifically describe the premises where
liquor will be served. Ifliquor will be
served or merely consumed on a patio
or outdoor area, the liquor license must
explicitly describe the additional area.
If approved by the city, the amended
license must be filed with the Minne-
sota Department of Public Safety Alco-
hol Enforcement Division. Failure to

requirements may result in a liquor
license holder being cited for illegal
sales.
The patio must be compact and
contiguous with the existing facility
and cannot be separated from the actual
bar by streets or alleys. Cities may
impose additional restrictions to limit
the potential negative effects of moving
indoor bar activities to an outdoor
patio. Liquor licenses are a grant and
a privilege, not a property right. As a
result, cities may require license holders
to meet certain conditions as an ele-
ment of their licenses (or in this case,
license amendments).
Cities may wish to impose con-
ditions that relate to fencing and
screening; hours, days and months of
operation; noise and entertainment;
minor access; patio size, placement and
aesthetics; rubbish; recreational fires and
barbecues; lighting and illumination
levels; security and supervision; insur-
ance; and signage.
Cities should document any restric-
tions on the patio area and the rationale
for such restrictions as findings-of-fact
in the formal resolution approving the
amendment to the liquor license.
Smoking-only patios. Some cities
may not wish to allow alcohol service
or consumption on outdoor patios for
public safety and health reasons. These
cities may still receive requests to install
smoking-only patios where drinking is
not allowed. Cities have the authority
to decide whether to allow smoking
on outdoor patios and regulate the
placement of these patios in relation
to other buildings.
To exercise their authority, cities
must pass a local ordinance to regulate
outdoor smoking, including smoking
patios. The FBA specifically grants cities
the authority to pass ordinances that
are more restrictive than state law. As a
result, a city may pass a local ordinance
that prohibits all smoking on business

patios, sidewalks or parking lots, or
within a certain amount of feet from
the entrance or air intake of a build-
ing. Alternatively, the city may pass
an ordinance that allows the conduct,
but imposes conditions upon outdoor
patios and other outdoor smoking areas.
These conditions may address a variety
of concerns, already highlighted above,
including fencing, noise, screening, and
public safety. Violation of the local ordi-
nance may be designated as a misde-
meanor or petty misdemeanor.
Additional regulatory concerns.
When receiving requests for patio addi-
tions, the city should also determine if
the patio meets local zoning or build-
ing requirements. Depending on the
local zoning ordinance, a patio may be
a permitted use, a conditional use or
prohibited altogether as an unauthor-
ized accessory use. Some license holders
may need to apply for a liquor license
amendment to operate the patio and
submit a zoning application.
Cities should also review whether
the patio addition meets the setback
requirements, performance standards,
and parking standards imposed by local
zoning ordinance. License holders with
limited lot space may be tempted to
build patios that encroach upon required
setbacks, parking areas, ingress/egress or
to otherwise fall below required zoning
and building performance standards.

than close of business on November 2nd, 2007. One of the revisions required is a reduction in

acres. This will require a significant reduction in the area proposed to be included in the zone in
St. Joseph.
The 8t. 'Cloud HRA will host a meeting to discuss the revisions on Monday, October 22, at 3:00
p.m. City Administrator Weyrens will be attending the meeting. An update will provided at the
EDA meeting.
It is likely the EDA will be asked to comment on whether or not to continue pursuit of zone
designation and, if so what areas should be eliminated from the proposed zone acreage.

A joint application process for bioscience zone acreage allocation is being pursued by the cities

which may be conducive to bioscience/biotech development.

Bio Zone Selection Criteria
Thank you for your input into the design of additional criteria to consider for expanding
the Bio Zone program. As a result of the meeting and several follow up conversations, the
Department of Employment and Economic Development has established additional criteria
required for the designation of Bio Zones.
The 2007 Legislative Session added the following requirements to section 469.334 of the
Minnesota Statutes:
"Additional zones may be designated in later years only after the commissioner of
employment and economic development has established criteria for expanding the number
of zones. The criteria must be limit designating a new zone to a community that has
adequate resources and infrastructure to support bio-industry including postsecondary
institutions, strong health care systems and existing bioscience companies. It also requires
that new bio zones be located on a transportation corridor. "
Based upon the new Legislative direction andthe comments received at the "Open
Forum", the Commissioner of the Department of Employment and Economic Development
has authorized additional criteria for expanding the number of Bio Zones beyond the three
initial communities of Minneapolis, St. Paul and Rochester. In addition to the current
statutory criteria, the communities applying for the designation of Bio Zone shall be
evaluated on the following:
1) A "technical champion" working in concert with local public/private efforts to
promote industry growth
2) An active marketing effort around attracting bioscience based companies and
dedicated resources to participate in national events promoting Minnesota's
capabilities.
3) The support and participation of bioscience companies, health care systems and

DEED will not be accepting new applications but will reevaluate the original submissions
from October 2006. Applicants are welcome to submit a short update (5 pages or less) to
DEED outlining recent accomplishments of their continued efforts to build the bioscience
industry in their community/region and to address the additional criteria requirements. In
addition, based on the process that DEED undertook for the original designation ofBio
Zones, new zones will be limited to 500 acres. Please refine the original submission of
land to the most applicable geographic area and resubmit the property to be designated.
DEED will accept the revisions until 4:00pm on Fridav November 2nd. 2007.
Announcements of new Bio Zones will be made no later than December IS\ 2007. Newly
designated Bio Zones will be become active January 1 S\ 2008 and will close December
31S\ 2015.
