AGENDA ITEM: Special Use Permit- Requested Action: Accept the recommendation of the Planning Commission and issue a special use permit to District 742 for the construction and-operation of a wind turbine. SUBMITTED BY: Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: The Planning Commission conducted a public hearing on November 5, 2007 to allow the construction and operation of a wind turbine for District 742. The wind turbine will be a learning tool and provide a minimal amount of energy for the school. PREVIOUS COUNCIL ACTION: None. BACKGROUND INFORMATION: The Planning Commission unanimously recommended approval of the special use permit. The height of the tower was discussed and why the turbine is'being constructed at the limited height. If the turbine were taller it would produce more energy. The owner representative indicated that they did discuss the height with District 742 and the tower being proposed is what they have opted to construct. - BUDGET/FISCAL IMPACT: ATTACHMENTS: Planning Commission material REQUESTED COUNCIL ACTION: Authorize the Mayor and Administrator to execute Resolution 2007- 046 Issuing a Special Use (Conditional Use) Permit to District 742 to allow the construction and operation of a wind turbine at 1300 Jade Road West. ST.JOSltlff{ MEETING DATE: November 5~ 2007 AGENDA ITEM: Distritt 742 - Special Use Permit SUBMITTED BY: Administration - , STAFF RECOMMENDATiON: Recommend thedty Council approve the Special Use Permit to allow the construction of a wind turbine at the District 742 School Site. PREVIOUS PLANNING COMMISSION ACTION: When the School district presented their buildings plans for the facility; they indicated that they would be looking at the possibility of adding a wind turbine, but did not have the details at that time. Therefore, the turbine was not part of the approvalprocess. BACKGROUND INFORMATION: While the Ordinance is entitled '1"elecommunications" the wind turbine does fall under the definitions. RESOLUTION OF FINDING The request of Winkleman'sEnvironmentally Responsible Construction, on behalf of District 742 for a Special Use Permit to allow the construction and operation of a wind turbine came before the Planning Commission at a Public Hearing held on November 5,2007. The use of the turbine is for alternative energy and to use as an educational tool. Yes, even though you have read about a 27% increase St. Cloud taxpayers fac due to building new police and fire stations, St. Joe would likely keep a small lead! !! I ave sent you charts the last two years showing this data. In the current budget year, St. ~oseph is also 29% higher in its city taxes than the average of all MN cities. Budget Meeting 8/29/07 The proposed general levy is twice as large as the money needed fo general operations than needed just four years ago ($1.7 million vs. $868,000) and thre times as large as six years ago ($1.7 million vs. $584,000). In addition we continue to b rrow more funds through bonding mechanisms every year. An article in the St. ClOUf: Times seemed to indicate that St. Cloud's General Bond Debt to General Levy and A d total ratio was high at 17%. That same ratio for St. Joseph is nearly double that number at 32.5% As our city grows taxpayers realize that more roads may need to be plowed, more streets to patrol, meters to pe read, bills to be processed, etc. The new gro~h will also contribute to the.pay~ent of these services. Taxpayers genefaily~a1 accept paying a fair amount for the services that we receive. Does paying the highestt~es in the St. Cloud area translate into having the best city services in the are.a?? That. c~rtainly does not seem to be the case in St. Joseph. That should be a glariIlg problemfor thF council as policy makers and to citizens and business owners as taxpayers. The growths in population and number of households over the last number of years have been largej but it would not seem large enough to justify a doubling or tripling of the geneFal.le~, . That new growth rate has slowed dramatically over the last two years from that hectic pace. A new concern for the council may be how that slow-down will affect projctions made for presently committed bond payments. I I I I have asked the council what growth factors most influence their budgetary decisions and how they translate that growth to specific spending needs. I ha~e not gotten any responses to that inquiry. In my observations over the last number or years it seems the growth number the council most relies on is the increase to the city'~ Net Tax Capacity. (The Net Tax Capacity is a weighted number that is obtained from Steams County and is directly related to the taxable value of property in the city. If you di~'ide the amount of money the city needs for its General Levy (in this case $1.7 million) Iby the tax capacity, you obtain the mill rate the city will charge us for taxes. Multiply thb mill rate by the value of your home and you determine the amount oftaxes that you pay to the city). The budget package was presented to the council with four scenarios of the increase to the net tax capacity (no increase, 5%, 10%, and 15% increases). It then seerhs to draws a very simplistic conclusion that if proposed spending increases 15% and tHe net tax capacity rises 15%, that the council is not raising taxes for a homeowner with I the same valued home as the prior year. That may look great on paper but It does hot1follow reality. When was the last time the value of your home did NOT go up, eve~ if you did nothing to improve your property? The 11 % difference between those numbers was largely due tb arbitrary increases to values of existing properties. Home values go up for a variety o~reasons, your neighbors home sold for a hefty sum, you improved your property, !he assessor believed, in general, homes in St. Joseph were undervalued, etc. The point is that in none of these cases should it cost the city a cent extra in operating funds to run ou city just because our home values rose. If council members really want to know the TR1E IMP ACT of budget policies on existing homeowners they should not merely be comparing the taxes on a house valued at $150,000 in 2007 to one valued at $150,000 in12008. They must factor in how much of that increase in nettax capacity has nothing tp do with new growth. Failing to do so is a distortion of reality. In this case, a $130,000 home in the base year would be compared to a home valued at $166,500 ($150,900 x 1.11 % due to increase in EXISTING property values). In the case of the 2008 bUrget, the 15% tax capacity scenario shows an increase of only $4 to a $150,000 home. In reality, that home's value would have increased by 11 % and the true increase th taxpayer would see on the city portion of the tax bill would be $210. (57.111% Mill Rate x166.5 = $951. $951-74,1 .~ $210). The council chose to commit the city to those bond payments and negotiated or dccepted those same employment contracts. New policies, such as paying for.'an emplp~ee's Health Insurance deductible payments seem to negate chances for cost savings.
