Members Present: Fire Chief Randy Torborg, City of St. Joseph Representative Rick Schultz, St. Joseph Township Representative Jeff Janssen, St. Wendel Township Representative Greg Salk. City Administrator Judy Weyrens. Others Present: Assistant Fire Chief Jeff Tauten, Terry Loso. Minutes: Janssen made a motion to approve the minutes of November 7, 2007 as presented; seconded by Salk and passed unanimously. Financial Report: Weyrens presented the following 4`h Quarter Fire Fund Financial Summary: Revenues $ 53,654.43 Expenditures (104,820.30) Fund Balance 474,875.02 Weyrens reported that the donation from St. Ben's had been billed but not yet received. When the donation is received it will be credited back to the financial year 2007. Torborg made a motion to approve the 4`h Quarter Financial Report as presented; seconded by Salk and passed unanimously. OLD BUSINESS Fee Schedule: Weyrens reported that the City Council has been working on the Fee Schedule for 2008. Each year the City is required to conduct a public hearing on the proposed fees. The Council included the Fire Service fees as part of the hearing and they include the following: Car/Vehicle Fire ($20/hr per firefighter) $100.00Itruck FirelMedical Reports (Medical report must contain release form) $ 0.25/page Illegal/Intentional Burns ($20/hour/firefighter) $100.001truck Swim Pool Fill (Additional fee of $ 20/hr per firefighter) $100.OOltruck Water Charge - $30 (1-10K gallons) $3.00/1,000 gal Torborg made a motion to accept the fee schedule as stated for implementation in 2008. The motion was seconded by Salk and passed unanimously. Cleaning Person: Torborg reported that the new cleaners have been cleaning the facility and it is working well. Compensation Study: Torborg questioned the status of the organization study for the Fire Department. The department has reviewed the job descriptions and have recommended some changes. The Department questioned the additional license fee if they are required to possess a commercial driver's license. Weyrens stated that this would be no different than the existing City staff, if the license is required the City pays the difference between the Class D and Commercial License. Torborg stated that the Department also questioned the 15' Responder requirement and Firefighter 1. Torborg stated that the Department has implanted an availability board in the dispatch area to allow firefighters to identify when they would be out of town. The purpose of the Board is for firefighters to be aware of when help is needed. Torborg stated that the new process appears to be working, but the true test will be the summer months. Torborg stated that the firefighters are also aware that the by-laws will be incorporated into the City policy and he has not had negative comments. Weyrens stated that the information has been submitted to the February 6, 2008 Page 2 of 2 City Attorney so that the enabling Ordinance By-laws can be updated. As soon as a draft is ready the information will be forwarded to the Fire Board. The Fire Board discussed the structure of the Department with regards to the Fire Chief. Torborg questioned whether or not the term of Fire Chief should be three years as it takes one year to learn the processes. Torborg also suggested that the Captain terms should be two years terms and the terms should be staggered so that not all the captains are up for election in one year. Another change in the department will be the selection of officers. Currently department members can express interest in being Chief, Assistant Chief or Secretary and the officer is elected by popular vote. The League of MN Cities has indicated that this practice cannot continue as each position must have minimum qualifications and the officers should be qualified candidates not just popular candidates. The Board agreed that the methodology for selection must include input from the existing officers and a recommendation should be forwarded for consideration. New Business DNR Matching Grant: Torborg reported that the Fire Department has an opportunity to apply fora $ 700 matching grant from the Minnesota Department of Natural Resources. The Fire Department is requesting to make application to the DNR to replace an existing generator. One of the generators used by the Fire Department is efficient and cumbersome to use. The new generator would be identical to the second generator used by the Department. Salk made a motion to authorize the application for a matching grant to the DNR to seek assistance to purchase a Honda generator at approximately $ 1400.00. The motion was seconded by Janssen and passed unanimously. EMT Classes: Torborg stated currently all Firefighters are required to be 15` Responder Certified. Some of the firefighters have expressed an interest in continuing training by attending Emergency Medical Technician Training (EMT). The cost of the training is approximately $ 400 without hourly compensation. The Board discussed that they support continuing education; however, the budget did not include additional training. Therefore the Board agreed that the department could send two firefighters to EMT Training and the Fire Board will compensate for the registration fee only. Torborg made a motion authorizing the expenditure of two firefighters to attend EMT training on a first come, first serve basis with the City paying the registration fee only. All required training must be completed before registering for the EMT Training. The motion was seconded by Janssen and passed unanimously. Signal Ooticons: Torborg reported that the new signals light at CR 75 and Northland Drive are equipped with opticons for emergency vehicles to trip the signal. The Fire Department vehicles do not have the equipment to utilize the opticons at this time and they will be looking at the costs to purchase the equipment. 2008 Hiring: Torborg reported that the Department will have at least two openings in 2008 and would like to start the hiring process. The current qualification for the membership in the Department is residence in the Fire District. Based on information from the League, the practice must be changed to a response time not residing in the district. The Fire Board discussed what an appropriate response times. Torborg made a motion to begin the hiring process and to include a seven minute response time for qualification. The motion was seconded by Salk and passed unanimously. Adjourn: Salk made a motion to adjourn at 8:15 PM; seconded by Janssen and passed unanimously. The mission of the St. Joseph Fire Department is to prevent fires through education, to fight fires, and to preserve and protect life and property against injury and damages within the City of St. Joseph and its vicinity. Section 401.02 Purpose. The St. Joseph Fire Department Personnel Policy is provided to help members of the Department to become acquainted with City policies and procedures. It is intended to serve as a guideline and maybe amended without notice. Neither the contents of the handbook nor any amendments constitute an employment contract. Fire Department Members and the City have the right to terminate membership for any reason, with or without notice. Section 401.03 Scope. The St. Joseph Fire Department (SJFD) Personnel Policy applies to all paid-on call members of the Fire Department. Regular full-time, regular part-time and part-time/temporary department employees are covered by the St. Joseph Fire Department Perso olicy. This includes positions such as Fire Chief, Fire Marshal, Fire Inspecto A inistrative Assistants. Some individuals may serve dual roles as both regular or p ' ime/temp ` ry employees and members of the paid-on call staff. In this case, this respe po i 1 appl ;to the duties and services associated with the Fire Departmer~w'~ It is the intent of the Cit}$`'~'St. ~ 's ersonnel Policy Manual is in addition to, and not in lieu of, those terms~nd co iti s sets orth in the St. Joseph Personnel Policy Manual. To ~_~ the extent that any policiesn t ' a ual conflict with the City of St. Joseph Personnel Policy Manual, the City of St. Jose`Personnel Policy Manual shall govern. Section 401.04 Content. Every new member of the SJFD is furnished a copy of this handbook and is required to be completely familiar with its contents. Changes, additions, or deletions to this personnel policy content are only valid when approved by the Fire Chief, the City Manager, and the City Council. As changes, additions, or deletions are made to the personnel policy, each member will be issued updated information via e-mail. A current copy of the personnel policy will be maintained at the fire station. It is each member's ongoing responsibility to stay current on the personnel policy content. Section 401.05 Data Practices Member and officer records for the City of St. Joseph are maintained in accordance with the Minnesota Data Practices Act (MDPA). Information that is not public, but is maintained as part of a member's personnel record, will not be shared with anyone but those authorized to receive it. A member can review his or her personnel file by making an appointment with the Chief. Each member is responsible for providing updated information, as necessary, to maintain the accuracy of records. Contact the Chief or Assistant Chief with questions regarding employment data practices. Section 401.06 Eligibility The SJFD provides a critical service to the community and it is imperative that the best candidates possible are chosen. for membership. 1n order to be eligible for a firefighter position, all applicants must meet the following requirements: • Be 18 years of age and over, • Be a high school graduate or equivalent, • Hold a valid State of Minnesota driver's license, • Have a primary residence or primary place of employment within seven minutes of their assigned fire station, and Successfully complete and pass the backgroun p . sical and psychological exam, and drug and alcohol screening descri v below. In addition, all members of the • Carry out his/hF°~~espo :b e ~ovide good communication in a calm, positive, and professional anner~ s Tally m emergency situations, • Complete traininec~ents established by the Fire Chief or designated training officer, ~~' • Understand and follow this handbook, standard operating guidelines, and any other department policies or procedures, • Meet minimum call requirements, and • Demonstrate the City's shared expectations of customer service, teamwork, initiative, results orientation, flexibility and public stewardship. Individuals who hold exempt level Fire Department positions, such as Fire Chief and Fire Marshal, are not eligible for membership. The applicant for membership must also successfully complete and pass the educational criteria established by the investigating committee within 2 years. This criteria will include 1403A, CPR, and First Responder Course of equivalent. The candidate must maintain all criteria certifications, license, and necessary documentation as long as she/he is a member of this department. The candidate will be on a conditional probation for a period of six (6) months. The investigating committee will review the physical exam and agility test. The investigating committee will also have its regular six (6) month review as well as a two (2) year review. Candidates who fail to comply or violate the established criteria are subject to termination. Section 401.07 Motor Vehicle Records. The City of St. Joseph is permitted to periodically check the motor vehicle records of the members of the SJFD. Certain driving violations maybe legitimate grounds for disciplinary action if the member or officer's ability to perform their duties and obligations are impacted as a result of such violations (i.e. suspension of a driver's license). Section 401.08 Residency and Availability Members who join the St. Joseph Fire Department must be able to respond to their assigned station from either their primary residence or primary place of employment within seven (7) minutes under normal driving conditions while obeying all traffic laws. Only emergency vehicles that have their lights and sirens on can disobey the state traffic laws. This means that all members' private vehicles cannot break the law on the way to the fire station or on the way to a fire call. Section 401.09 Physical Ability Members are required to meet standards of physical abil' • off ively perform firefighter duties. If a current member fails to meet the standards, e individ will meet with an occupational health care consultant to establis t o ureme oals and maybe suspended from some or all active, 'ng h n' such goals are met. Failure to meet the established goals within six, ,. o s re m cy linary action or termination. `~.':.'. Section 401.10 Re` "_.uitm t ~ Selec ion ,. ,:~. ~;j!'i ..Y'a'~ Any available volunteer posi'~n~in the SJFD will be posted at the station for a period of 21 days after the announcement of the position opening at the business meeting. Officer positions will be announced prior to the expiration of their term. Section 401.11 Selection of New Members All applicants must successfully pass a thorough background check prior to being accepted as a St. Joseph Firefighter. The background check shall include any investigation which indicates the suitability of the candidate for membership as a firefighter. Applicants must successfully pass apre-membership physical examination, which includes a stress test, pulmonary function test and physical ability test, in addition to drug and alcohol screening, and a psychological examination. The City will select the physician or psychologist to assess the candidate's ability to perform the essential functions of the job. The cost of examinations and drug and. alcohol test will be paid by the City. The process by which members are selected shall be in accordance with Section 14.6 of the St. Joseph Personnel Policy. Section 401.12 Selection of Officers The selection process for officer positions will be jointly developed by the Policy Committee, Fire Department Chief, and the City Human Resources. To ensure that consistent and fair consideration is given to members applying for officer positions, a Promotion Review Board will be included as part of the selection process. The Promotion Review Board will be made up of the Chief and Assistant Chief and One Member of the Fire Department. The Promotion Review Board is responsible for interviewing and evaluating candidates according to the criteria identified in the selection process and for making promotion recommendations to the Fire Chief. The Fire Chief is responsible for final promotion decisions. Officer positions vacated with less than one year remaining on their term will be filled by the Fire Chief s appointment until the teen expires. Officer positions vacated with more than one year remaining on their term will be filled by the Fire Chief s appointment until the next annual officer selection process begins. Section 401.13 Employment of Relatives. In general, relatives of current Fire Department members may be considered for employment unles - is a conflict of interest. For the purpose of this policy, relative will mean spouse r, s .,daughter, brother, sister, grandchild, grandparent, legal guardian, or any of the met by a s ~ or in-law relationship. Examples of situations that would - When a ber i indirectly supervise or take part in the decision to hire, ret ,pro ' t or eva uate a relative. - When a me ~ er uld~'~ie responsible for auditing the work of a relative. - When confi iality of information held by the City would be jeopardized. - When there is the potential for or appearance of inappropriate influence relating to policy decisions. Section 401.14 Discipline Fire department members are subject to disciplinary action for failing to fulfill their duties and responsibilities or work rules instituted by the Fire Chief or for failure to comply with a provision in this handbook or in the St. Joseph Personnel Policy attached hereto. Discipline will be administered without discrimination. Disciplinary action may include verbal and/or written reprimands, suspension or termination. The type of disciplinary action imposed is at the discretion of the Fire Chief and City Manager. Nothing in this policy is intended to guarantee that the City must or shall follow all disciplinary steps before terminating a member and a member maybe suspended or terminated, with or without notice, for any reason, that is in compliance with applicable laws. A member may use the grievance policy set forth at Section 24.11 of the St. Joseph Personnel Policy if he or she believes that disciplinary action was either unjust or disproportionate to the offense committed. Section 401.15 Resignation Members are encouraged to provide the Fire Chief with a written resignation stating the last date of work and reason for leaving at least 14 calendar days prior to the resigning from service. Members eligible for pension should refer to the Relief Association bylaws for additional requirements. Section 401.16 Attendance and Leave The SJFD depends on the active participation of all members to be successful in meeting the purpose of and objective of the Fire Department. Members are expected to regularly respond to emergency response calls and to attend department trainings and meetings. In addition, special work details and events maybe assigned by a captain or higher officer. If a member cannot attend or fully participate in calls or training due to a medical condition or emergency, he or she should contact his or her reporting officer as early as possible. The reporting officer should always be informed of a member's expected date of return. Any member maybe suspended or expelled from memb '~'!"fo " ~ssing two consecutive meetings or drill without a valid excuse. Department will be monitored semi-annually. c) Failure to attend the minimum number of calls (20% of total calls) during a one year period. Call numbers will be reviewed semi-annually. Any exceptions to the call minimum (i.e. work, medical) require prior approval by the department investigating committee. Any member who belongs to any other organization is to respond to SJFD duties first and upon being relieved may attend other functions. Section 401.17 Emergency Response Attendance The SJFD is responsible for responding to emergency situations in a timely fashion with adequate resources. Members are encouraged to respond to as many emergency calls as possible. All members must respond to a minimum of 25% of paged calls assigned to their station. Non- paged calls will not be counted towards the 25% minimum. Attendance for calls will be taken after appropriate time has been allowed for members to reach the fire station. Members are generally expected to respond to a call within ten minutes and to remain until the call is completed. Call percentages are reviewed quarterly. When a member does not meet quarterly attendance requirements, the reporting officer will notify the member following the release of the quarterly percentages. The member has ten (10) days from notification to contact his or her reporting officer to discuss the low attendance and make-up procedure (for more information, refer to the Attendance Make-Up Procedure in the Appendix). Disciplinary action will commence if the reporting officer has not been contacted by the 11th day. Section 401.18 Training and Meeting Attendance The SJFD believes in the positive relationship between member training participation and high levels of performance and safety. Members are strongly encouraged to attend all regularly scheduled training activities and business meetings. Members who are unable to attend department and/or committee meetings are responsible for reviewing the meeting minutes. All members must satisfactorily complete mandatory departm ing. Members who do not meet the requirements for general or mandatory training maybe subject to disciplinary action. Section 401.19 Compensation Members are reimbursed for calls, training sessions, meetings, weekend rescue and special details. In the event a member or officer of the fire department is also a public servant of another department of the City of St. Joseph who qualifies for overtime while performing services for the SJFD, the employee shall receive overtime wages at the rate of one and one-half times the regular rate of on-call pay for the actual work that is being performed for the SJFD. Time that is spent on pre-shift and/or post-shift activities shall be included when computing "hours worked". Travel time from home to the fire station does not count toward "hours worked". Once an officer responds to a call, however, the time counts as "hours worked". Section 401.20 Critical Incident Stress A critical incident stress debriefing group session led by a team of specially trained mental health professionals and peer counselors is provided to any SJFD member who requests a session following a critical incident. Section 401.21 Training and Development In addition to department training requirements, members are encouraged to seek outside training opportunities that will enhance their skills and knowledge as it relates to their position with the SJFD. Approved training will be paid for by the department. Members who do not complete the approved training will be required to reimburse the department. Section 401.22 General Conduct The SJFD has established general guidelines members and the interests of the Department an effort to protect its exnects members to: • Display professio n t, ~, ~`^ • Project a positi _,, imag • Represent the Fi Dep t by being good, law-abiding citizens, • Maintain confideialit . ands' • Follow the policies~~f~procedures of the SJFD. Violation of any of the above may result in disciplinary action. Section 401.23 Performance Reviews. Performance reviews are designed to provide members with feedback regarding their performance as it relates to specific work areas and competencies that have been identified as critical. It is also an opportunity to identify goals and developments areas for the member in the upcoming year. Members receive a performance review at least once per year. Section 401.24 Alcohol and Other Drug Use -Response Policy Members are expected to safely and satisfactorily perform their job duties. Members who violate the City's policy regarding alcohol and drug use will be subject to disciplinary action, and in some cases, legal prosecution. The City's policy regarding drug and alcohol testing can he found in the City of St. Joseph Personnel Fire attached hereto as Exhibit "A". In addition, the following alcohol and drug use firefighter response policy shall apply: A firefighter who has consumed more than two drinks of alcoholic beverages in the previous four hours shall not respond to any emergency call. A firefighter who has used any illegal drug during the preceding 24 hours shall not respond to an emergency call. Upon arriving at the fire hall in response to an emergency call, a firefighter shall immediately inform the Fire Officer in charge of any of the following conditions: If the firefighter has consumed alcohol during the preceding four hour period and the amount consumed in that period. If the firefighter is using any prescription or non-prescription tedication that is labeled with a warning regarding drowsiness, driving, or operation of machinery. A firefighter who fails to comply with this requirement is subject to disciplinary action. 4. A firefighter who has consumed any alcohol in the preceding four hour period, or who is using a prescription or non-prescription medication that is labeled with a warning regarding drowsiness, driving, or opera ' machinery shall not perform any of the functions listed below t 1 stead be assigned to other duties: ~ a~ - Drive any v - TTcP RC.E3A• assistance or first aid. The Fire Off"ir'in charge shall restrict the activities of any firefighter as s/he deems appropriate ifthe Fire Officer in charge reasonably believes or suspects that the firefighter may be unable for any reason to safely and properly perform the duties of a firefighter. This applies even if the firefighter is in compliance with the requirements of Paragraphs 1 through 4 of this policy. 6. Any firefighter who during an emergency response observes any indication that another firefighter is under the influence of alcohol or drugs shall immediately report those observations to the Fire Officer in charge. Such indications include the odor of alcohol on the breath, slurred speech, unsteady gate, or disorientation. In any case of a scheduled social event that may involve consumption of alcohol by a substantial percentage of the Fire Department members, the Fire Chief shall arrange in advance for emergency response by a neighboring department pursuant to the appropriate mutual aid agreement. OR Section 401.24 Alcohol and Other Drug Use -Zero Tolerance Response Policy The St. Joseph Fire Department maintains a zero tolerance policy regarding the use of alcohol and/or drugs while participating in Fire Department functions including: - response to fire and other emergency incidents; - participation in Fire Department training activities; - participation in any other activities where the firefighter is serving as a representative of the Fire Department, either officially or unofficially. 1. If a firefighter has consumed any substance that may impair physical activity or mental judgment, the firefighter shall not respond to an emergency incident, and shall not participate in training or any other Fire Department activity. A firefighter who observes such indications and fails to report them as required is subject to disciplinary action. If the fire Officer in charge has a reasonable suspicion that a firefighter maybe under the influence of alcohol and/or drugs during an emergency response, the Fire Officer shall ensure the firefighter is relieved of duty and kept in a safe area. A ride home will be provided to the firefighter as soon as possible. In no case will the firefighter be allowed to drive home from the fire activity. Grounds for reasonable suspicion of being under the influence of alcohol and/or drugs include but are not limited to: odor of alcohol on one's breath, slurred speech, unsteady gait, and disorientation. The Fire officer in command may require that the individual immediately submit to a field impairment test*. An individual's refusal to submit to such tests is grounds for disciplinary action. The fire Officer shall document the time, date, observed behavior, witnesses, what was done, and substance of any conversations conducted with the firefighter. This documentation shall be immediately forwarded to the Fire Chief. 4. The Fire Officer may require a firefighter who is reasonably suspected of being under the influence of alcohol and/or drugs to submit to blood or urine testing in accordance with the City of St. Joseph's Personnel Policy's Drug and Alcohol Testing Policy. An individual's refusal to submit to such test is grounds for disciplinary action. A Fire Officer in command who fails to fulfill the responsibilities for action list in Paragraphs 3 and 4 above shall be subject to disciplinary action. 6. Disciplinary action for violation of this policy may include a written reprimand, suspension or termination. A firefighter who responds to an emergency call while under the influence of drugs or alcohol may also be required to undergo chemical abuse assessment and/or treatment. *Note: "Field impairment test" means to "walk a straight line, touch your finger to your nose" type test, not a blood or urine test. Section 401.25 Communication Technology and Resources SJFD technology and resources are provided to members to ass' with their department responsibilities. All SJFD technology and resources are dip of the City of St. Joseph.. This includes resources such as software, hardware, p ers, email, icemail, and fax machines. The SJFD's fall Technology Policy can be found in the Appendix. Section 401.26 Confidential Information During the course of duty, members have significant access to private and personal information. Members must maintain the confidentiality of such information to protect the privacy of the subjects of the information, and to maintain the public faith in the department's commitment to preserving such confidences. Disclosure of confidential information can be made only in accordance with established City policies and procedures as well as state and federal law. A member, who is unsure about the release of confidential information, should see his or her reporting officer or the City Clerk prior to releasing the information. Section 401.27 Conflicts of lntcrest It is expected that all members will exercise good judgment in avoiding outside activities or situations where conflicts of interests with City business exist or could be perceived to exist. Following are some examples of situations where conflicts of interest might occur: • If a member's official capacity with the City or with an outside organization may enable him or her to influence the placing of City business which allows him or her to directly or indirectly gain something of value. • If a member accepts a paid or unpaid position elsewhere and performs an activity that interferes with the member's duties or job performance at the City. • If a member uses SJFD information not generally available to the public, in the member's private affairs which allows him or her to directly or indirectly gain something of value. • If a member's persona] relationships may have inappropriate influence on SJFD decisions Section 401.28 Dress and Uniform Members are expected to dress in a manner appropriate to the performance of their duties. When appropriate, wear clothing that is clean and well maintained, and observe good grooming and personal hygiene practices. When responding directly to calls, members should make every effort to wear SJFD identifiable clothing. Loss of a driver's license will require a member to take a personal leave of absence. Section 401.30 Media Relations The City of St. Joseph strives to provide the public with accurate and timely information, communicated in a professional manner and in accordance with the laws regarding public information and data practices. This section provides guidelines for members who may have contact with the media while acting on behalf of the City or while performing their job duties. The policy also spells out the guidelines for all external communications from the City to various public audiences. The following persons are authorized to speak or write on behalf of the City: • The City Administrator. • The Department Officers Other employees and members specifically approved by one of the above. (Hereinafter collectively referred to as "Communications Division") All requests for media interviews or information are to be routed through the Communications Division. The Communications Division must be notified when a reporter or camera crew is on City property. A Communications Division representative should be present at all media interviews, if possible, to document the interview and be available as a resource to the interview subject. All external publications must be reviewed by the Communications Division prior to publication. This includes news releases, articles, newsletters, materials written by outside or contract writers, brochures, flyers, and handouts. The policy does not apply to communications such as utility bills, official documents, elections materials, and the like. The Communications Division is an excellent resource for internal and external communications matters. All City departments are urged to make use of those resources when crafting communications materials. Section 401.31 Personal Areas Personal areas such as offices, lockers, work stations, and City. All members have a responsibility to help maintain the safety and security of co-workers, customers, facilities and property. Members should immediately contact their reporting officer or the police if they observe anything that could pose a threat to the safety or security of members, customers, facilities, or property. It is the responsibility of each member to: • Understand and follow all rules and safety standards. • Know the safe and proper use of any tool, piece of equipment or vehicle before it is used. • Operate all tools, equipment and vehicles in a safe and careful manner. • Comply with state law and wear seat belts whenever driving or riding in City vehicles or personal vehicles while performing City business. Members must report all accidents and injuries to their reporting officer immediately, no matter how small or insignificant the injury appears to be. Failure to make timely reports may jeopardize benefits. Members should be vigilant in looking for any potential hazardous conditions or unsafe practices and immediately reporting these conditions to their reporting officer. The City has established a safety committee to assist with the detection and prevention of unsafe conditions. Section 401.34 Use of City Vehicles. Use of City-owned vehicles is restricted to City business and incidental uses which occur in the course of City business. No member may operate aCity-owned vehicle without a valid driver's license. Members are expected to obey all traffic laws and to operate the vehicle in a manner that reduces the likelihood of damage to the vehicle or injury to self or others. Section 401.35 Meetings. Regular meetings of the Department shall beheld on the second Tue day of each month at 8:00 p.m. at the Fire Hall. When a roll call vote is requested every member shall answer to his/her name as the roll is called unless excused by the chair. No member shall speak more than five (5) minutes on any subject at any one time, or more than twice on the same subject except by permission of the chair. 6. When a motion is properly before the Department it must be disposed of before another can be entertained, and no motion maybe made subject to more than two amendments. 7. No issue which is tabled shall be considered at the same meeting unless it was understood at the time of tabling that it might be considered again at the same meeting. 8. A motion to reconsider must be made by a member who voted with the majority. 9. All resolutions and amendments must be offered in writing. 10. An appeal of a decision of the chair shall be worded as follows: "Shall the decision of the chair be sustained?" Atwo-thirds vote of those present shall be necessary to reverse the chair. 11. It shall be the duty of all members to be present at all meetings if possible, and on every call to assemble at the fire station without delay and assist in responding to the call.
