Approve the compensation increase for the Officers as stated below.
PREVIOUS COUNCIL ACTION: The City Council approved the request of the Fire Board to complete an
Organizational Study. Originally the City hired Springsted to complete the study and entered into an
agreement with Springsted to have the study completed within 90 days. Springsted did not perform and
the contract was canceled. The Fire Board requested the Administrator gather information and prepare
documents for the Fire Board to react to. The Fire Board has been reviewing and revising the
documents over the past six months.
BACKGROUND INFORMATION: The need for the Organizational Study was a result of changes in
regulations regarding Fire Department. When the Fire Department was organized a set of by-laws were
established at the same time and the department was operated through that document. Recent
legislative changes and insurance requirements, Fire Departments can no longer operate through By-
laws. Through Minnesota Statutes, Cities are legally responsible for the operation of Fire Departments
and they must be structured and managed as such. Officers of the Department cannot be selected
through a popular vote. Rather the Officer positions must be posted and interested persons would then
have to make application for the position they are interested. Applicants are then screened based on
the minimum qualifications. In the case of the St. Joseph Fire Department, the Fire Department
Investigating Committee will review the applications and make a recommendation to the Fire Chief who
in turn will forward to the Fire Board for recommendation to the City Council. The City Council will have
to make the final determination for Ofi'ICer Positions.
Even though St. Joseph Township and St. Wendel Township are participating agencies, when it comes
down to liability and ownership, the City of St. Joseph is ultimately responsible. The Fire Board assists
with the management of the Department. Under the Organizational structure of the City, the Fire Chief
is a Department Head in the same fashion as the Police Chief, responsible to the City Administrator.
Throughout the process we have followed this same structure.
The Organization Study process included creating an addendum to the St. Joseph Personnel Policy
incorporating the Fire Department by-laws. They are attached for approval. The Fire Chief and
Assistant Fire Chief have reviewed the document and support the document. The document was not
circulated to the Fire Department members individually as if you send a document to 30 people it will
become difficult to reach consensus. Therefore, the Fire Board relied on the Fire Chief and Assistant Fire
Chief to make a policy that will be functional for the City and meet all the needed requirements.
The Study also required creating job descriptions for each position as stated above. The job descriptions
were also circulated through the Fire Chief and Assistant Chief. The descriptions were drafted using
area Cities as background information and then adding specifics for St. Joseph.
With the changes to the Fire Department, the current enabling Ordinance was no longer correct,
therefore it has been amended. Attached you will find the original enabling Ordinance which is on
colored paper. The new Ordinance meets the new requirements and the Council needs to approve the
Ordinance Amendment revoking the current Ordinance 24 and replacing with the text. This Ordinance
Amendment does not require a public hearing, only publication after adoption by the City Council. The
Ordinance approval will require two steps: 1) Authorizing execution of the amendment to Ordinance
24; and 2) Authorization for the Mayor and Administrator to execute Resolution 2008-010 authorizing
summary publication.
The final step in the process was to review the wages of the Officers. Attached is a spreadsheet
indicating the compensation for the area fire departments. Currently the Captains are not compensated
for holding an officer position and as can be seen all other departments do provide for a salary. The
attached page illustrates the request of the Fire Board.
As a separate issue, the Fire Board discussed the concern of response on weekends. Some concern was
expressed that the Department was not have a good response on weekends as many fire fighters go to a
cabin on weekends. In an attempt to increase the attendance the Fire Department has started a
process whereby firefighters post their availability so that all members can see when shortages might
occur. This process has been helpful with the real test this summer. As an added measure, the new
personnel policy for the Fire Department requires that each member must make at least 209'0 of the
calls. Any member not making 209'0 of the calls will not receive the pension for that year.

REQUESTED COUNCIL ACTION: This agenda item requires multiple actions of the Council and they are
as follows:
1. Approval of the Fire Department Job Descriptions to include Fire Chief, Assistant Fire Chief,
Captain and Fire Fighter and. approval of the amendment to the St. Joseph Personnel Policy
adding the section relating to the St. Joseph Fire Department.
2. Authorization for the Mayor and Administrator to execute the amendment to Ordinance 24
causing the same to be published.
3. Authorization for the Mayor and Administrator to execute resolution 2008-010 approving
summary publication of Ordinance 24.
4. Accepting the Fire Board recommendation establishing Fire Officer Salaries as follows:
Fire Chief $ 3,500/annually
Assistant Chief $ 2,500/annually
Captain $ 1,000/annually

FLSA Status: Non Exempt
Performs difficult professional and administrative work managing and directing fire, incident and
emergency service activities including responding to fire and emergency calls, searching for and rescuing
victims, suppressing fires, performing clean up and participating in continuing training and related work
as required. Works with the Administrator, City Council and Fire Board in setting policies and goals for
the Department. Departmental supervision is exercised over Assistant Fire Chief, Captains and Fire
Fighters.
Essential Functions
The following functions are intended only as illustrations of the various types of work performed. The
omission of specific duties does not exclude them from the position if the work is similar, related or a
logical assignment to the position.
• Under the direction of the City Administrator plans, organizes and directs all department
operations with respect to equipment, apparatus and personnel and supervises the placing of
such plans into effect; prepares and presents a variety of operational, statistical and technical
reports.
• Assigns and monitors work for assigned personnel, assists in evaluating performance, provides
direction and counsel to corrector improve performance, recognizes and encourages
outstanding performance and demonstrates by personal example the highest standards of
conduct and performance.
• Models appropriate supervisory behavior at all times and applies and enforces department
rules, regulations, policies and procedures. Exercises disciplinary and commendation action
when indicated. Communicates department policy and procedure to other department
members so that each will have a clear understanding of expectations, purposes and objectives
and provides input for new or revised procedures.
• Prepares agenda and conducts the quarterly Fire Board Meeting.
• Prepares a semiannual report for the St. Joseph City Council and contributing jurisdictions.
• Acts as commanding officer at fire or emergency scenes as needed.

volunteers, other Mutual Aid Association and the general public.
Education and Experience
Graduation from high school or GED or equivalent combination of education, experience, along with
considerable fire fighting experience. Preference will be given to candidates with supervisory
experience.
Physical Requirements
This position requires the exertion of 100 pounds of force occasionally, up to 50 pounds of force
frequently, and up to 20 pounds of force constantly to move objects; work requires climbing, balancing,
stooping, kneeling, crouching, crawling, reaching, standing, walking, pulling, lifting, fingering, grasping,
feeling, and repetitive motions; vocal communication is required for expressing or exchanging ideas be
means of the spoken work, and conveying detailed or important instructions to others accurately, loudly
or quickly; hearing is required to perceive information at normal sound; visual activity is required for
depth perception, color perception, night vision, peripheral vision, visual inspection involving small
defects and/or small parts, assembly or fabrication of parts at or within arms length, operation of
machines, operation of motor vehicles or equipment, determining the accuracy and thoroughness of

General Definition of Work
FLSA Status: Non Exempt
Performs intermediate protective service work in supervising, planning, implementing and coordinating
fire training and safety operations for the fire department, maintenance and operation of trucks or
equipment, preparing and maintain detailed records and files, develop Standard Operating Procedures
related to specific assignments and related work as required. Work is performed under moderate
supervision of Fire Chief or Assistant Fire Chief. Lead worker oversight is exercised over Fire Department
personnel during operational response, maintenance, safety and training activities.
Essential Functions
The following functions are intended only as illustrations of the various types of work performed. The
omission of specific duties does not exclude them from the position if the work is similar, related or a
logical assignment to the position.
• Assists with the planning and development of training programs on all aspects of fire
suppression, prevention, rescue, tactics, medical and hazardous materials response.
• In the absence of the Fire Chief or Assistant Fire Chief, serves as the commanding officer at a fire
or rescue call.
• Plans, schedules and directs work of assigned personnel in: fire suppression; emergency
medical services; public fire education and information; training; pre-fire planning; equipment
check, tests and maintenance.
• Assigns and monitors work for assigned personnel, assists in evaluating performance, provides
direction and counsel to correct or improve performance, recognizes and encourages
outstanding performance and demonstrates by personal example the highest standards of
conduct and performance.
• Models appropriate supervisory behavior at all times and applies and enforces department
rules, regulations, policies and procedures. Exercises disciplinary and commendation action
when indicated. Communicates department policy and procedure to other department

• Directs the inspection and maintenance of the fire and emergency medical vehicles and related
equipment to assure that they are ready for instant use when needed.
• Serves as a liaison with numerous state and regional officials to ensure maximum support for
department training, mutual aid response and hazardous materials activity.
• Performs related tasks as required.
Knowledge, Skills and Abilities
Thorough knowledge of incident command, fire science and hazardous materials, equipment, training
and certification principles and procedures; thorough knowledge of the techniques, principles and
practices of fire prevention, suppression, hazardous materials, and emergency services; thorough
knowledge of departmental rules and regulations; ability to evaluate the effectiveness of the Fire
Department incident command and training programs and recommend changes to improve activities
program; ability to reduce relatively complex ideas into easily understood presentations; ability to

Fire Fighter
General Definition of Work
FLSA Status: Non Exempt
Performs responsible protective service work in fire suppression and rescue operations including
responding to fires and emergency calls, rescuing victims, suppressing fires, performing clean up,
participating in continuous training and related work as required. Work is often performed under
emergency conditions and frequently involves considerable personal hazard. Works is performed under
limited supervision of the Fire Chief, Assistant Chief and or Captain.
Essential Functions
The following functions are intended only as illustrations of the various types of work performed. The
omission of specific duties does not exclude them from the position if the work is similar, related or a
logical assignment to the position.
• Responds to alarms and assists in the suppression of fires, including rescue, entry,
ventilating and salvage work.
• Enters structures, searches for and rescues occupants.
• Performs cleanup and overhaul work.
• Assists in maintaining fire apparatus and equipment, and cleaning fire station and
grounds.
• Checks, tests and maintains fire hydrants; maintains appropriate maintenance and
inspections records.
• Participates in continuing training and instruction program by individual study of
technical material and attendance at scheduled drills and classes.
• Responds to vehicle accidents; extricates victims from vehicle; medical aid and
evaluation; assists with pre-incident surveys and planning.
• Responds to medical emergencies as a first responder.
• Conducts fire prevention classes for groups, schools and the general public.
• Responds to hazardous material spills.
• Inventories equipment, uniforms, emergency stock, etc.
• Attends and participates in all required drill and training activities as scheduled by the
Fire Chief.
• Participates in continuing education and training programs.
• Performs related tasks as requested.
Knowledge, Skills and Abilities
General knowledge of firefighting techniques and procedures as applied to fire suppression; general
knowledge of fire prevention strategies and techniques; some knowledge of emergency medical
techniques and procedures; ability to learn technical firefighting principles and techniques, and
principles of hydraulics applied to fire suppression; thorough knowledge of the street system and
physical layout of the fire district; ability to understand and follow oral and written instructions; ability
to keep simple records and prepare reports; physical endurance and agility; ability to take charge of a
situation until senior personnel arrive on scene; ability to establish and maintain effective working
relationships with associates and the general public.

ST JOSEPH FIRE DEPARTMENT PERSONNEL POLICY
Section 401.01 Mission Statement.
The mission of the St. Joseph Fire Department is to prevent fires through education, to fight
fires, and to preserve and protect life and property against injury and damages within the City of
St. Joseph and its vicinity.
Section 401.02 Purpose.
The St. Joseph Fire Department Personnel Policy is provided to help members of the Department
to become acquainted with City policies and procedures. It is intended to serve as a guideline and
may be amended without notice. Neither the contents of the handbook nor any amendments
constitute an employment contract. Fire Department Members and the City have the right to
terminate membership for any reason, with or without notice.
Section 401.03 Scope.
The St. 3oseph Fire Department (SJFD) Personnel Policy applies to all paid-on call members of
the Fire Department. Regular full-time, regular part-time and part-time/temporary department
employees are covered by the St. Joseph Fire Department Personnel Policy. This includes
positions such as Fire Chief, Fire Marshal, Fire Inspectors and Administrative Assistants. Some
individuals may serve dual roles as both regular or part-time/temporary employees and members
of the paid-on call staff. In this case, this respective policy will apply to the duties and services
associated with the Fire Department.
It is the intent of the City of St. Joseph that this Personnel Policy Manual is in addition to, and
not in lieu of, those terms and conditions sets forth in the St. Joseph Personnel Policy Manual. To
the extent that any policies in this manual conflict with the City of St. Joseph Personnel Policy
Manual, the City of St. Joseph Personnel Policy Manual shall govern.
Section 401.04 Content.
Every new member of the SJFD is furnished a copy of this handbook and is required to be
completely familiar with its contents. Changes, additions, or deletions to this personnel policy
content are only valid when approved by the Fire Chief, the City Administrator, and the City
Council. As changes, additions, or deletions are made to the personnel policy, each member will
be issued updated information via a-mail. A current copy of the personnel policy will be
maintained at the fire station. It is each member's ongoing responsibility to stay current on the
personnel policy content.
Section 401.05 Data Practices
Member and officer records for the City of St. Joseph are maintained in accordance with the
Minnesota Data Practices Act (MDPA). Information that is not public, but is maintained as part
of a member's personnel record, will not be shared with anyone but those authorized to receive
it.
A member can review his or her personnel file by making an appointment with the Chief. Each
member is responsible for providing updated information, as necessary, to maintain the accuracy
of records. Contact the Chief or Assistant Chief with questions regarding employment data
practices.
Section 401.06 Eligibility
The SJFD provides a critical service to the community and it is imperative that the best
candidates possible are chosen for membership.
In order to be eligible for a firefighter position, all applicants must meet the following
requirements:
• Be 18 years of age and over,
• Be a high school graduate or equivalent,
• Hold a valid State of Minnesota driver's license,
• Have a primary residence within seven minutes of their assigned fire station, and
• Successfully complete and pass the criminal and employment history background
checks, physical and drug and alcohol screening, described below.
• Be eligible to hold a 1 S` Responder Card ,
In addition, all members of the department are expected to:
• Carry out his/her responsibilities and provide good communication in a calm, positive,
and professional manner, especially in emergency situations,
• Complete training requirements established by the Fire Chief or designated training
officer,
• Understand and follow this handbook, standard operating guidelines, and any other
department policies or procedures,
• Meet minimum call requirements, and
• Demonstrate the City's shared expectations of customer service, teamwork, initiative,
results orientation, flexibility and public stewardship.
Individuals who hold exempt level Fire Department positions, such as Fire Chief and Fire
Marshal, are not eligible for membership.
The applicant for membership must also successfully complete and pass the educational criteria
established by the investigating committee within 2 years. This criteria will include 1403A, CPR,
and First Responder Course of equivalent. The candidate must maintain all criteria certifications,
license, and necessary documentation as long as she/he is a member of this department. The
candidate will be on a conditional probation for a period of six (6) months. The investigating
committee will review the physical exam and agility test. The investigating committee will also
have its regular six (6) month review as well as a two (2) year review. Candidates who fail to
comply or violate the established criteria are subject to termination.
Section 401.07 Motor Vehicle Records.
The City of St. Joseph is permitted to periodically check the motor vehicle records of the
members of the SJFD. Certain driving violations may be legitimate grounds for disciplinary
action if the member or officer's ability to perform their duties and obligations are impacted as a
result of such violations (i.e. suspension of a driver's license).
Section 401.08 Residency and Availability
Members who join the St. Joseph Fire Department must be able to respond to their assigned
station from either their primary residence within seven (7) minutes under normal driving
conditions while obeying all traffic laws. This means that all members' private vehicles cannot
break the law on the way to the fire station or on the way to a fire call.
Section 401.09 Physical Ability
Members are required to meet standards of physical ability to effectively perform firefighter
duties. If a current member fails to meet the standards, the individual will meet with an
occupational health care consultant to establish a set of measurement goals and may be
suspended from some or all active firefighting duties until such goals are met. Failure to meet the
established goals within six (6) months may result in disciplinary action or termination.
Section 401.10 Recruitment.
Any available volunteer position in the SJFD will be posted at the station for a period of 21 days
after the announcement of the position opening at the business meeting. Officer positions will be
announced prior to the expiration of their term, with terms following the calendar year.
Section 401.11 Selection of New Members
All applicants must successfully pass a thorough background check prior to being accepted as a
St. Joseph Firefighter. The background check shall include any investigation which indicates the
suitability of the candidate for membership as a firefighter.
Applicants must successfully pass apre-membership physical examination, which includes a
stress test, pulmonary function test and physical ability test, in addition to drug and alcohol
screening. The City will select the physician to assess the candidate's ability to perform the
essential functions of the job. The cost of examinations and drug and alcohol test will be paid by
the City.
The process by which members are selected shall be in accordance with Section 14.6 of the St.
Joseph Personnel Policy.
Section 401.12 Selection of Officers
The selection process for officer positions will be jointly developed by the Policy Committee,
Fire Department Chief, and the City Human Resources. To ensure that consistent and fair
consideration is given to members applying for officer positions, the Fire Department Hiring
Committee will be included as part of the selection process. The Fire Department Hiring
Committee is an annual appointment of the Fire Department, ratified by the St. Joseph City
Council. If a member of the Hiring Committee makes application for an Officer position, the
next senior ranking officer will fill the open position on the Hiring Committee. The Fire
Department Hiring Committee is responsible for interviewing and evaluating candidates
according to the criteria identified in the selection process and for making promotion
recommendations to the St. Joseph Fire Board for recommendation to the City Council who shall
make the final appointment.
Officer positions vacated with less than one year remaining on their term will be filled by the
Fire Chief's appointment until the term expires. Officer positions vacated with more than one
year remaining on their term will be filled by the Fire Chief's appointment until the next annual
officer selection process begins.
Section 401.13 Employment of Relatives. In general, relatives of current Fire
Department members may be considered for employment unless there is a conflict of interest.
For the purpose of this policy, relative will mean spouse, father, son, daughter, brother, sister,
grandchild, grandparent, legal guardian, or any of these met by a step or in-law relationship.
Examples of situations that would constitute a conflict of interest include:
- When a member would directly or indirectly supervise or take part in the decision
to hire, retain, promote, or evaluate a relative.
- When a member would be responsible for auditing the work of a relative.
- When confidentiality of information held by the City would be jeopardized.
- When there is the potential for or appearance of inappropriate influence relating to
policy decisions.
Section 401.14 Discipline
Fire department members are subject to disciplinary action for failing to fulfill their duties and
responsibilities or work rules instituted by the Fire Chief or for failure to comply with a
provision in this handbook or in the St. Joseph Personnel Policy attached hereto. Discipline will
be administered without discrimination. Disciplinary action may include verbal and/or written
reprimands, suspension or termination. The type of disciplinary action imposed is at the
discretion of the Fire Chief and City Administrator. Nothing in this policy is intended to
guarantee that the City must or shall follow all disciplinary steps before terminating a member
and a member may be suspended or terminated, with or without notice, for any reason, that is in
compliance with applicable laws.
A member may use the grievance policy set forth at Section 24.11 of the St. Joseph Personnel
Policy if he or she believes that disciplinary action was either unjust or disproportionate to the
offense committed.
Section 401.15 Resignation
Members are encouraged to provide the Fire Chief with a written resignation stating the last date
of work and reason for leaving at least 30 calendar days prior to the resigning from service.
Members eligible for pension should refer to the Relief Association bylaws for additional
requirements.
Section 401.16 Attendance and Leave
The SJFD depends on the active participation of all members to be successful in meeting the
purpose of and objective of the Fire Department. Members are expected to regularly attend
department trainings and meetings. In addition, special work details and events may be assigned
by a captain or higher officer. If a member cannot attend or fully participate or training due to a
medical condition or emergency, he or she should contact his or her reporting officer as early as
possible. The reporting officer should always be informed of a member's expected date of return.
Any member may be suspended or expelled from membership for missing two consecutive
meetings or drill without a valid excuse. Upon missing two drills or meetings a member will
receive a certified letter asking him/her to appear at the next meeting and justify the absences.

Any member who belongs to any other organization is to respond to SJFD duties first and
upon being relieved may attend other functions.
Section 401.17 Emergency Response Attendance
The SJFD is responsible for responding to emergency situations in a timely fashion with
adequate resources. Members are encouraged to respond to as many emergency calls as possible.
All members must respond to a minimum of 20% of paged calls assigned to their station. Non-
paged calls will not be counted towards the 20% minimum. Attendance for calls will be taken
after appropriate time has been allowed for members to reach the fire station. Members are
generally expected to respond to a call within seven minutes and to remain until the call is
completed. Call percentages are reviewed semi-annually.
When a member does not meet semi-annual attendance requirements, the investigating
committee will notify the member following the release of the semi-annual percentages. The
member has ten (10) days from notification to contact his or her reporting officer to discuss the
low attendance. Disciplinary action, including up to termination of membership, may be
commenced if the reporting officer has not been contacted by the 11 `h day.
Any member who fails to meet the cumulative attendance requirement (the semi-annual
percentages will be averaged for a cumulative average) will not qualify or be eligible for benefits
provided under the Fire Relief Association Fund for that year.
Section 401.18 Training and Meeting Attendance
The SJFD believes in the positive relationship between member training participation and high
levels of performance and safety. Members are strongly encouraged to attend all regularly
scheduled training activities and business meetings.
All members must satisfactorily complete mandatory department training. Mandatory training
includes 1 S` Responder Training, which includes 24 hours of annual training and Fire Fighter I
Certification. If a mandatory training is missed, it must be made up as soon as feasibly possible.
Members who do not meet the requirements for general or mandatory training may be subject to
disciplinary action.
Section 401.19 Compensation
Members are reimbursed for calls, training sessions, meetings, weekend rescue and special
details. In the event a member or officer of the fire department is also a public servant of another
department of the City of St. Joseph who qualifies for overtime while performing services for the
SJFD, the employee shall receive overtime wages at the rate of one and one-half times the
regular rate of on-call pay for the actual work that is being performed for the SJFD.
Time that is spent on pre-shift and/or post-shift activities shall be included when computing
"hours worked". Travel time from home to the fire station does not count toward "hours
worked". Once an officer responds to a call, however, the time counts as "hours worked".
Section 401.20 Critical Incident Stress
A critical incident stress debriefing group session led by a team of specially trained mental health
professionals and peer counselors is provided to any SJFD member who requests a session
following a critical incident.
Section 401.21 Training and Development
In addition to department training requirements, members are encouraged to seek outside
training opportunities that will enhance their skills and knowledge as it relates to their position
with the SJFD. Outside training opportunities must be approved by the Fire Board prior to
registration and will be limited by budgetary resources. Approved training will be paid for by
the department. Members who do not complete the approved training will be required to
reimburse the department.
Section 401.22 General Conduct
The SJFD has established general guidelines for member behavior in an effort to protect its
members and the interests of the Department and the City. The SJFD expects members to:
• Display professional conduct,
• Project a positive image,
• Represent the Fire Department by being good, law-abiding citizens,
• Maintain confidentiality, and
• Follow the policies and procedures of the SJFD.
Violation of any of the above may result in disciplinary action.
Section 401.23 Performance Reviews.
Performance reviews are designed to provide members with feedback regarding their
performance as it relates to specific work areas and competencies that have been identified as
critical. It is also an opportunity to identify goals and developments areas for the member in the
upcoming year. For the purposes of this section, performance reviews can be either formal or
informal.
Section 401.24 Alcohol and Other Drug Use -Response Policy
Members are expected to safely and satisfactorily perform their job duties. Members who violate
the City's policy regarding alcohol and drug use will be subject to disciplinary action, and in
some cases, legal prosecution. The City's policy regarding drug and alcohol testing can be found
in the City of St. Joseph Personnel Fire attached hereto as Exhibit "A". Under no circumstances
shall a firefighter in a state of intoxication, (drugs and/or alcohol), respond to an emergency
incident or Department drills and training.
1. A firefighter who has consumed any alcohol in the preceding four hour period, or
who is using a prescription or non-prescription medication that is labeled with a
warning regarding drowsiness, driving, or operation of machinery shall not
perform any of the functions listed below, but will instead be assigned to other
duties:
- Drive any vehicle.
- Use SCBA;
- Enter a structure fire;
- Provide emergency medical assistance or first aid.
2. The Fire Officer in charge shall restrict the activities of any firefighter as s/he
deems appropriate if the Fire Officer in charge reasonably believes or suspects
that the firefighter may be unable for any reason to safely and properly perform
the duties of a firefighter. This applies even if the firefighter is in compliance with
the requirements of Paragraphs 1 through 4 of this policy.
3. Any firefighter who during an emergency response or training observes any
indication that another firefighter is under the influence of alcohol or drugs shall
immediately report those observations to the Fire Officer in charge. Such
indications include the odor of alcohol on the breath, slurred speech, unsteady
gate, or disorientation.
4. In any case of a scheduled social event that may involve consumption of alcohol
by a substantial percentage of the Fire Department members, the Fire Chief shall
arrange in advance for emergency response by a neighboring department pursuant
to the appropriate mutual aid agreement.
Section 401.25 Accidents with City-Owned Vehicles.
If an employee is involved in an accident while operating aCity-owned vehicle, s/he should:
1. Notify the Police Department.
2. Urge all parties involved to remain at the scene of the accident until the police
officers can investigate.
3. Report the accident, no matter how small, to his/her department head.
4. Not discuss the accident with anyone but the investigating officer, supervisor,
department head, or anyone authorized by the City to receive the information.
5. Complete an Employee Accident Report. A copy of the report will be retained in
the employee's personnel file.
Section 401.26 Communication Technology and Resources
SJFD technology and resources are provided to members to assist them with their department
responsibilities. All SJFD technology and resources are the property of the City of St. Joseph..
This includes resources such as software, hardware, pagers, email, voicemail, and fax machines.
The City reserves the right to access any messages or files stored on City technology without
consent.
SJFD technology and resources should be used primarily for SJFD business. Personal use is
allowed on an occasional basis according to the guidelines outlined in the Technology Policy,
which can be found in the Appendix. Members should not use SJFD technology and resources
for any purpose that would reflect negatively on the City. Members should use caution when
sending confidential or sensitive information through email. Members may not download
software or programs without approval from the Information Technology division. The SJFD's
fall Technology Policy can be found in the Appendix.
Section 401.27 Confidential Information
During the course of duty, members have significant access to private and personal information.
Members must maintain the confidentiality of such information to protect the privacy of the
subjects of the information, and to maintain the public faith in the department's commitment to
preserving such confidences. Disclosure of confidential information can be made only in
accordance with established City policies and procedures as well as state and federal law. A
member, who is unsure about the release of confidential information, should see his or her
reporting officer or the City Clerk prior to releasing the information.
Section 401.28 Conflicts of Interest
It is expected that all members will exercise good judgment in avoiding outside activities or
situations where conflicts of interests with City business exist or could be perceived to exist.
Following are some examples of situations where conflicts of interest might occur:
• If a member's official capacity with the City or with an outside organization may enable
him or her to influence the placing of City business which allows him or her to directly
or indirectly gain something of value.
• If a member accepts a paid or unpaid position elsewhere and performs an activity that
interferes with the member's duties or job performance at the City.
• If a member uses SJFD information not generally available to the public, in the
member's private affairs which allows him or her to directly or indirectly gain
something of value.
• If a member's personal relationships may have inappropriate influence on SJFD
decisions
Section 401.29 Dress and Uniform
Members are expected to dress in a manner appropriate to the performance of their duties. When
appropriate, wear clothing that is clean and well maintained, and observe good grooming and
personal hygiene practices. When responding directly to calls, members should make every
effort to wear SJFD identifiable clothing. Members should keep in mind that while wearing City
Uniforms, or SJFD identifiable clothing, they are representing the City to the public even if they
are not on duty. Accordingly, it is his or her responsibility to protect and uphold the reputation of
the City and SJFD in his or her actions.
Section 401.30 Driver's Licenses
Members of the SJFD are required to hold a valid State of Minnesota Commercial driver's
license with a tanker endorsement. The City shall reimburse firefighters the difference between a
standard driver's license and Commercial License with endorsement. Members must notify the
Fire Chief of any suspensions, revocations, and/or actions taken which would affect the
member's ability to maintain licensure or insurability. Loss of a driver's license will require a
member to take a personal leave of absence.
Section 401.31 Media Relations
The City of St. Joseph strives to provide the public with accurate and timely information,
communicated in a professional manner and in accordance with the laws regarding public
information and data practices. This section provides guidelines for members who may have
contact with the media while acting on behalf of the City or while performing their job duties.
The policy also spells out the guidelines for all external communications from the City to various
public audiences.
The following persons are authorized to speak or write on behalf of the City:
• The City Manager.
• The Department Officers
• Other employees and members specifically approved by one of the above.
(Hereinafter collectively referred to as "Communications Division")
All requests for media interviews or information are to be routed through the Communications
Division. The Communications Division must be notified when a reporter or camera crew is on
City property. A Communications Division representative should be present at all media
interviews, if possible, to document the interview and be available as a resource to the interview
subject.
All external publications must be reviewed by the Communications Division prior to publication.
This includes news releases, articles, newsletters, materials written by outside or contract writers,
brochures, flyers, and handouts. The policy does not apply to communications such as utility
bills, official documents, elections materials, and the like.
The Communications Division is an excellent resource for internal and external communications
matters. All City departments are urged to make use of those resources when crafting
communications materials.
Section 401.32 Personal Areas
Personal areas such as offices, lockers, work stations, and City vehicles are the property of the
City. As such, the City has the right to enter or inspect them without a member's consent.
Section 401.33 Property Damage
Any member who damages City property or discovers damage to City property must
immediately report it to his or her reporting officer.
Section 401.34 Safety and Security
The safety of SJFD members is of utmost concern. All members have a responsibility to help
maintain the safety and security of co-workers, customers, facilities and property. Members
should immediately contact their reporting officer or the police if they observe anything that
could pose a threat to the safety or security of members, customers, facilities, or property.
It is the responsibility of each member to:
• Understand and follow all rules and safety standards including but not limited to the St.
Joseph Fire Department Safety Policy and Standard Operating Procedure Manual.
• Know the safe and proper use of any tool, piece of equipment or vehicle before it is
used.
• Operate all tools, equipment and vehicles in a safe and careful manner.
• Comply with state law and wear seat belts whenever driving or riding in City vehicles
or personal vehicles while performing City business.
Members must report all accidents and injuries to their reporting officer immediately, no matter
how small or insignificant the injury appears to be. Failure to make timely reports may
jeopardize benefits.
Members should be vigilant in looking for any potential hazardous conditions or unsafe practices
and immediately reporting these conditions to their reporting officer. The City has established a
safety committee to assist with the detection and prevention of unsafe conditions.
Section 401.35 Use of City Vehicles.
Use of City-owned vehicles is restricted to City business and incidental uses which occur in the
course of City business.
No member may operate aCity-owned vehicle without a valid driver's license. Members are
expected to obey all traffic laws and to operate the vehicle in a manner that reduces the
likelihood of damage to the vehicle or injury to self or others.
Section 401.36 Use of Emergency Vehicies.
Drivers of all emergency vehicles must sound an audible signal by siren and display at least one
lighted red light to the front. The driver of an authorized emergency vehicle shall operate the
emergency vehicle with due regard for the safety of persons using the street.
Section 401.37 Meetings.
Regular meetings of the Department shall be held on the second Tuesday of each month at 8:00
p.m. at the Fire Hall. In case a National or Religious Holiday should fall on that date, the
regular meeting will be rescheduled.
Special meetings shall be called by the Chief or at the written request of ten members of the
Department. The request shall state the subject matter to be considered at the meeting.
The following rules of order shall govern at all meetings of the Department:
Ten members of the Department shall constitute quorum at any meeting.
2. Any member wishing to speak shall stand and address the chair, and may
only speak only when properly recognized by the chair.
3. No question can come before the Department unless properly moved and
seconded, declared open for discussion by the chair.
4. Any member may request a roll call vote on any question being voted
upon. When a roll call vote is requested every member shall answer to
his/her name as the roll is called unless excused by the chair.
5. No member shall speak more than five (5) minutes on any subject at any
one time, or more than twice on the same subject except by permission of
the chair.
6. When a motion is properly before the Department it must be disposed of
before another can be entertained, and no motion may be made subject to
more than two amendments.
7. No issue which is tabled shall be considered at the same meeting unless it
was understood at the time of tabling that it might be considered again at
the same meeting.
8. A motion to reconsider must be made by a member who voted with the
majority.
9. All resolutions and amendments must be offered in writing.
10. An appeal of a decision of the chair shall be worded as follows: "Shall the
decision of the chair be sustained?" Atwo-thirds vote of those present
shall be necessary to reverse the chair.
11. When a point of order is raised by any member, the person having the
floor shall take his/her seat until the point is decided by the chair. When
recognized by the chair she/he may resume.
12. No member shall leave the room during a meeting unless
permission is given by the chair. Any member who leaves without such
permission shall lose credit for attendance at the meeting.
13. When no quorum is present the most senior member present shall call the
roll and adjourn the meeting. No other business may be conducted.
14. The regular department meetings shall by governed by the abridged
version of Roberts Rules of Order.
Section 401.3$ Operations
It shall be the first duty of all members of the Department and substitutes to obey all
commands of their officers while on duty.
It shall be the duty of all members to be present at all meetings if possible, and on every call to
assemble at the fire station without delay and assist in responding to the call.
No member shall appear at meetings of the Department or on duty in a state of intoxication, be
guilty of misconduct, be a disgrace to this Department, fail to properly perform his/her duties,
or otherwise fail to abide by this Personnel Policy or the St. Joseph Personnel Policy and the
regulations and rules that may be established, under penalty of being disciplined by the Chief
or removed form membership under the procedure set forth for officers or members in Article
3, Section 6.
All members of this Department shall become familiar with the handling and working of all
articles of equipment and shall conduct themselves accordingly.
Any member who leaves the Department and fails to return Department keys and
equipment to the Chief, shall forfeit any money owing him/her.
No officer or member shall contract any debts or the Department without prior consent of the
Department
Any member who shall take or borrow any article from the Fire Station without the
permission of the Chief shall be subject to discipline.
No resignation shall be accepted unless the Secretary certifies that the member is not arrears to
the Department. The application of any prior member for re-admission to the Department shall
be treated as the application for a new member.
No equipment which is in use on any fire truck shall be loaned to any member at any time. Old
equipment which is not used for fire fighting may be loaned to a member with the consent of
the Chief.
Any member not returning loaned equipment to the fire hall within reasonable length of time (to
be determined by the Chief) shall be subject to discipline.

' ARTICLE 1 -Name and Purpose
' Section l . This organization shall be know as the St. Joseph Fire and Rescue Department,
hereinafter referred to as the Department.
' Section 2. The objective of this Department shall be to prevent fires through education, to fight
' fires, and to preserve and protect life and property against injury and damage in the City
of St. Joseph and its vicinity.
ARTICLE 2 -Membership
' Section 1. The Department shall not have more than thirty (30) and not less than fifteen (IS) active
members.
' Section 2. Any person eighteen (18) years of age who is a resident of the St. Joseph Fire District and
can pass the required physical and agility test, shall be eligible for membership.
Section 3. Proposals for membership shall be submitted in writing to any Officer. Whenever a
vacancy occurs, replacement members shall be obtained through the normal hiring
process.
Section 4. The candidate for membership mint successfully complete and pass the educational
' criteria established by the investigating committee within 2 years. This criteria will
include 1403A, CPR, and First Responder Course of equivalent. The candidate must
maintain all criteria certifications, license, and necessary documentation as long as she/he
are a member of this department. The candidate will be on a conditional probation for a
' period of six (6) months. The investigating committee will review the physical exam and
agility test. The investigating committee will also have its regular six (6) month review as
' well as a two (2) year review. Candidates who fail to comply or violate the established
criteria are subject to termination.

ARTICLE 3 -Officers
' Section 1. The officers of the Department shall be the Chief, the Assistant Chief, the Secretary, and
the Treasurer, all of whom shall serve a period of one year, or until their successors have
' been elected and installed.
Section 2. In addition to the duties imposed upon them by Ordinance, the Chief shall have the
following duties: to call all regular and special meetings; to preside and preserve order at
all meetings; to appoint committees; to sign all orders drawn on the Treasury; to
supervise all subordinate officers; to be present at all calls, if possible, and to assume full
' charge of all operations; to enforce the constitution and by-laws of the Department to the
best of his/her ability; to have general supervision over all the affairs of the Department;
to discipline members by suspension or other measures for failure to abide bye the rules
L and regulations of the Department or to properly perform their duties; to participate on all
committees; to appoint members to temporarily fill vacancies in officers' positions; to
' cast his/her vote in al] cases, except when the question voted upon concerns his/her own
interest, in which case it shall be the duty of the officer next in rank to preside until the
vote is taken.

Section 3. The Assistant Chief shall have the following duties: to assist the Chief in the discharge of
his/her several duties, and in the event of absence of the Chief, to assume the duties of the
Chief.
Section 4. The Secretary shall have the following duties: to maintain a record of all proceedings of
the Department; to call the roll; to record all absences; to maintain the books and records
of the Department; to give notice of special meetings; require new members to sign the
constitution and by-laws; to keep lists of retired members, deceased members, active
members, and expelled members. The records shall be open to inspection at al] times.
Section 5. The Treasurer shall have the following duties: Before assuming hisll~er duties, the
Department shall secure a surety bond assuring the faithful performance of the
Treasurer's duties. The treasurer shall receive and keep the monies and funds of the
Department and shall pay them over to the Finance Committee, whenever required by the
Department. Only orders drawn on the Department shall be paid by the Treasurer and
countersigned by the Chief. The Chief shall have the power to appoint a substitute, (a
member) to act in the absence of the Treasurer. The Chief shall be responsible for all acts
of the substitute that is appointed. All accounts shall be kept in a fair and legible manner,
listing the sources and amounts of all receipts and disbursements. If called upon, the
Treasurer shall report at each regular meeting on the financial condition of the
Department. Department financial records shall be open to inspection by all members at
each regular meeting. The Treasurer shall also close all accounts and submit full
statement thereof to the Department at the end of said term and shall deliver to the
successor all money, vouchers, etc. belonging to the Department.
Section 6. Any officer of the Department may be removed from the office by atwo-thirds vote of
the entire membership, for abuse of authority, or misconduct in office. The charge against
the member shall be made in writing and filed with the Secretary at least on month before
any vote shall be taken upon it, and a copy of said charge shall be served upon the
member at least two weeks before a vote shall be taken. If the charge is against the
Secretary, it shall be filed with the Chief.

ARITCLE 4 -Meetings
Section 1. Regular meetings of the Department shall be held on the second Tuesday of each month

Section 2. Special meetings shall be called by the Chief or at the written request of ten members of
the Department. The request shall state the subject matter to be considered at the meeting.
Section 3. The following rules of order shall govern at all meetings of the Department:
1. Ten members of the Dc;~arnnent shall constitute quorum at any meeting.
2. Any member wishing to speak shall stand and address the chair, and may
only speak only when properly recognized by the chair.
3. No question can come before the Department unless properly moved and
seconded, declared open for discussion by the chair.
4. Any member may request a roll call vote on any question being voted upon.
When a roll call vote is requested every member shall answer to his/her name
as the roll is called unless excused by the chair.
5. No member shall speak more than five (5) minutes on any subject at any one
time, or more than twice on the same subject except by permission of the
chair.
6. When a motion is properly before the Department it must be disposed of
before another can be entertained, and no motion may be made subject to
more than two amendments.
7. No issue which is tabled shall be considered at the same meeting unless it
was understood at the time of tabling that it might be considered again at the
same meeting.

8. A motion to reconsider must be made by a member who voted with the
majority.
9. All resolutions and amendments must be offered in writing.
10. An appeal of a decision of the chair shall be worded as follows: "Shall the
decision of the chair be sustained?" Atwo-thirds vote of those present shall
be necessary to reverse the chair.
11. When a point of order is raised by any member, the person having the floor
shall take his/her seat until the point is decided by the chair. When
recognized by the chair she/he may resume.
12. No member shall leave the room during a member unless permission is given
by the chair. Any member who leaves without such permission shall lose
credit for attendance at the meeting.
13. When no quorum is present the most senior member present shall call the roll
and adjourn the meeting. No other business may be conducted.
14. Except as otherwise provided by these By-Laws, Robert Rules of Order
(revised edition), shall govern the conduct of the meetings.

ARTICLE 5 -Elections
Section 1. Office positions shall be posted one month prior to the conduction of an election. The
annual election of officers shall be held at the regular meeting in the month of December
each year. The election shall be by written ballot. Officers elected at the December
meeting shall be installed and assume office at the beginning of the regular meeting in the
month of January next following.
Section 2. A member shall be eligible to become a convention delegate based upon the length of
service in the Department.
Section 3. Vacancies in office shall be filled by election at the next regular meeting, and the
successor shall assume office immediately.
ARTICLE 6 -Committees
Section 1. There shall be an auditing committee, a grievance committee, and an examination
committee, each to be composed of four members appointed by the Chief. These
committee members shall hold office until the expiration of the Chief's term of office or
removal under section 2 below. The Chief may appoint such other committees as may be
necessary in the conduct of the Department.

Any committee shall have the authority to request assistance form any member of the
Department. Any Committee Member who fails to serve or who shows lack of interest
may be removed from the committee under the procedure set forth in Article 3, Section 6.
Section 3. It shall be the duty of the Auditing Committee to examine the accounts that may be
referred to it by the Department, and to make a report at the next meeting following such
' examination.
' Section 4. It shall be the duty of the Examination Committee to evaluate the qualifications any
person proposed for membership. The Examinations Committee shall report its findings
' to the Department.
' Section 5. It shall be the duty of the Grievance Committee to examine all complaints and petitions
referred to it by the Department and report at the next regular or special meeting. It shall
' also be its duty to recommend action to promote good morale and harmony in the
Department.
' ARTICLE 7 -Operations
Section 1. It shall be the first duty of all members of the Department and substitutes to obey all
commands of their officers while on duty.
t Section 2. It shall be the duty of all members to be present at all meetings if possible, and on every
' call to assemble at the fire station without delay and assist in responding to the call.
Section 3. No member shall appear at meetings of the Department or on duty in a state of
intoxication, be guilty of misconduct, be a disgrace to this Department, fail to properly
perform his/her duties, or otherwise fail to abide by this Constitution and By-Laws and
' the regulations and rules that may be established, under penalty of being disciplined by
the Chief or removed form membership under the procedure set forth for officers or
' members in Article 3, Section 6.
' Section 4. All members of this Department shall become familiar with the handling and working of
all articles of equipment, and with the Constitution and By-Laws, and shall conduct
themselves accordingly.

' ARITCLE 8 -Entertainment Fund
' Section 1. Active members shall pay the amount designated by the Department, to the entertainment
fund at each regular or special meeting whether present at the meeting or not. The fund
' accumulated shall be set aside for entertainment purposes and shall be expended at the
discretion of the members.
' AWTCLE 9 -Amendment and Dissolution
' Section 1. No amendment shall be made to these By-Laws unless proposed at a regular meeting in
writing. The proposed amendment shall then be referred to a special committee which
' shall report at the next regular or special meeting. Upon failure of the committee to report
at the proper time, the proposed amendment may be considered by the Department as a
committee of the whole, and there after voted upon.
Section 2. No amendment shall be adopted without atwo-thirds vote of the entire membership.
Section 3. This Department may be disbanded only be athree-fourths vote of the entire membership
of the Department and a published or served notice shall be given to all members of the
meeting for that purpose, at least one month before said vote shall be taken.
ARTICLE 10 -Validity and Interpretation
Section 1. All provisions of these By-Laws shall be deemed supplementary to any ordinance now or
hereafter enacted bye the City Council, and any ordinance in consistent with any
provisions herein shall govern.
Section 2. These By-Laws shall be effective from the date of adoption.

ORDINANCE 24 VOLUNTEER FIRE DEPARTMENT
Section 24.01: ESTABLISHMENT OF FIRE DEPARTMENT. It is hereby established
in the City of St. Joseph, a volunteer Fire Department consisting of a Chief, an Assistant Chief, a
Fire Marshall and not less than 15 nor more than 30 firefighters.
Section 24.02: ELECTION OF CHIEF. The Chief of the Fire Department and the
Assistant Chief shall be elected annually by the members of the Department, subject to
confirmation by the Council. Each shall hold office for one year and until a successor has been
duly elected, except he or she may be removed by the Council for cause, after a public hearing.
Firefighters and probationary firefighters shall be appointed by the members of the Department,
subject to confirmation by the Council. Firefighters shall continue as members of the
Department during good behavior until they attain the age of 60 years, but they may be removed
by the Council for cause, after a public hearing.
Section 24.03: FIRE MARSHALL. The City Council shall annually appoint a Fire
Marshall who shall be in charge of the enforcement of all ordinances aimed at fire prevention.
He or she shall have the authority to inspect all premises within the City, and to cause the
removal or abatement of all fire hazards. The Chief of the Fire Department shall be eligible for
appointment to the office of Fire Marshall.
Section 24.04: DUTIES OF CHIEF. The Chief shall have control over all of the fire
fighting apparatus and shall be solely responsible for its care and condition. The Chief shall
report semi annually to the Council at its meeting in March and September, as to the condition of
the equipment and the needs of the Fire Department. He or she may submit additional reports
and recommendations at any meeting of the Council, and shall report each suspension of a
member of the Fire Department at the first meeting of the Council following such suspension.
He or she shall be responsible for the proper training and discipline of the members of the Fire
Department, and may suspend any member for refusal and neglect to obey orders pending a
hearing and vote of the members and pending final action by the Council on such member's
suspension, discharge or retention.
Section 24.05: RECORDS OF FIRES. The Chief shall keep in convenient form a
complete record of all fires. Such records shall include the time of alarm, location of the fire,
cause of the fire (if known), type of building, name of owner and tenant, purpose for which
occupied, value of the building and contents, members of the Fire Department responding to the
alarm, and such other information as may be advisable or as may be required from time to time
by the Council, or by state law or regulation.

Section 24.06: FIRE DRILLS. It shall be the duty of the Chief, when weather permits,
to hold a monthly drill of at least one hour duration for the Fire Department and to give the
firefighters instructions and approved methods of fire fighting and fire prevention.
Section 24.07: ASSISTANT CHIEF. In the absence of, or disability of the Chief, the
Assistant Chief shall perform all functions and exercise all the authority of the Chief.
Section 24.08: REQUIREMENTS FOR FIREFIGHTERS. The Chief, Assistant Chief,
and firefighters shall be able bodied, not less than 18 and no more than 60 years of age. They
shall become members of the Fire Department only after a six month probationary period. The
Council may require that each candidate, before he or she may become a probationary fireman,
shall satisfy certain minimum requirements of height, weight, education and that they fulfill any
other qualifications which may be specified by the Council, and pass a satisfactory mental and
physical examination.
Section 24.09: COMPENSATION. The members and officers of the Fire Department
shall receive such compensation as shall be designated by the City Council from time to time. In
computing compensation for fires, one hour shall be considered as a minimum to be paid any
firemen or officer.
Section 24.10: RELIEF ASSOCIATION. Members and officers of the Fire Department
may organize themselves into a Firemen's Relief Association.
Section 24.1 I : VIOLATIONS. It shall be unlawful for any person to give or make, or
cause to be given or made, any alarm of fire without probable cause, or to neglect or to refuse to
obey any reasonable order of the Chief at a fire at any time, or to interfere with the Fire
Department during the discharge of its duties. Any person convicted of violating this section
shall be guilty of a misdemeanor.

year. To achieve staggered terms, the initial appointment for Fire Chief or Assistant Fire Chief
may be for a term of one year. The Fire Chief, Assistant Fire Chief, and Captains shall serve
until their successor is appointed, unless otherwise removed for cause by the City Council after a
public hearing.
Section 24.04: VACANCIES. Any vacancy in the Fire Chief position shall be filled
through the appointment of a successor by the City Council as soon as is practicable. Until such

position shall remain vacant until such time as a successor is appointed by the City Council. To
maintain staggered terms, the the appointment of a vacant position may be for a term of one year
or, in the case of Captain, two years.
Section 24.05: FIRE FIGHTERS. Applicants shall be screened by the Fire Department
Investigation Committee. Finalists shall then be screened by the Fire Chief and the Fire Board,
and then presented to the City Council for appointment.
Section 24.06: HONORARY MEMBERS. Any member retiring in good standing shall
have his/her name placed upon the Honorary Membership List.
Section 24.07: DUTIES OF CHIEF. The Fire Chief shall perform professional and
administrative work managing and directing fire, incident and emergency service activities
including responding to fire and emergency calls, searching for and rescuing victims,
suppressing fires, performing clean up and participating in continuing training and related work
as required. The Fire Chief shall work with the City Council in setting policies and goals for the

Department. The Fire Chief shall also be responsible for departmental supervision over the

duties. Such committees shall be appointed by the Fire Chief on an annual basis. The Fire Chief

Section 24.09: DUTIES OF CAPTAIN: The Captains shall perform intermediate
protective service work in supervising, planning, implementing and coordinating fire training
and safety operations for the Fire Department, maintenance and operation of trucks or
equipment, preparing and maintaining detailed records and files, develop Standard Operating
Procedures related to specific assignments and related work as required. The Captains shall
perform his or her duties under the moderate supervision of the Fire Chief and/or Assistant Fire
Chief. The Captains shall oversee and supervise the Fire Department personnel during
operational response, maintenance, and safety and training activities.
Section 24.10: RECORDS OF FIRES. The Chief shall keep in convenient form a
complete record of all fires. Such records shall include the time of alarm, location of the fire,
cause of the fire (if known), type of building, name of owner and tenant, purpose for which
occupied, value of the building and contents, Fire fighters of the Fire Department responding to

Section 24.14: WORKERS' COMPENSATION INSURANCE. Workers' Compensation
Insurance coverage shall be maintained in accordance with the Minnesota Worker's Compensation Act.
An employee of the Fire Department shall be a covered employee for the purposes of workers' compensation
coverage from the moment the Fire Fighter responds to the call until the time the employee completes his or
her duties at the Fire Station after the call has been cleared. All injuries shall be reported and processed in
accordance with the St. Joseph Personnel Policy.
Section 24.15: VIOLATIONS. It shall be unlawful for any person to give or make, or
cause to be given or made, any alarm of fire without probable cause, or to neglect or to refuse to

perform his or her duties under the moderate supervision of the Fire Chiefand/or Assistant Fire
Chief. The Captains shall oversee and supervise the Fire Department personnel during
operational response, maintenance, and safety and training activities.
Section 24.10: RECORDS OF FIRES. The Chief shall keep in convenient form a
complete record of all fires. Such records shall include the time of alarm, location of the fire,
cause of the fire (if known), type of building, name of owner and tenant, purpose for which
occupied, value of the building and contents, Fire fighters of the Fire Department responding to
the alarm, and such other information as may be advisable or as may be required from time to
time by the Council, or by state law or regulation.
Section 24.11: FIRE DRILLS. It shall be the duty of the Chief, when weather permits,
to hold a monthly drill of at least one hour duration for the Fire Department and to give the Fire
Fighters instructions and approved methods of fire fighting and fire prevention.
Section 24.12: COMPENSATION. The Fire Chief, Assistant Fire Chief, Captains, and
Fire Fighters of the Fire Department shall receive such compensation as shall be designated by
the City Council from time to time. In computing compensation for fires, one hour shall be
considered as a minimum to be paid any personnel of the Fire Department.
Section 24.13: RELIEF ASSOCIATION. The Fire Chief, Assistant Fire Chief, Captain,
and Fire Fighters of the Fire Department may organize themselves into a Firemen's Relief
Association.
Section 24.14: WORKERS' COMPENSATION INSURANCE. Workers' Compensation
Insurance coverage shall be maintained in accordance with the Minnesota Worker's Compensation
Act. An employee of the Fire Department shall be a covered employee for the purposes of workers'
compensation coverage from the moment the Fire Fighter responds to the call until the time the
employee completes his or her duties at the Fire Station after the call has been cleared. All injuries
shall be reported and processed in accordance with the St. Joseph Personnel Policy.
Section 24.15: VIOLATIONS. It shall be unlawful for any person to give or make, or
cause to be given or made, any alarm of fire without probable cause, or to neglect or to refuse to
obey any reasonable order of the Chief at a fire at any time, or to interfere with the Fire
Department during the discharge of its duties. Any person convicted of violating this section
shall be guilty of a misdemeanor.

VOLUNTEER FIRE DEPARTMENT ORDINANCE
SUMMARY PUBLICATION
The City of St. Joseph has adopted an amendment of Ordinance :Volunteer Fire
Department.
The purpose of the amendment to Ordinance 24 is to re-establish the operation of the
Volunteer Fire Department.
This material is a summary of the amendments to Ordinance 24. The full text of the
Ordinance and amendment is available for inspection by any person during regular office hours
at the office of the St. Joseph City Administrator-Clerk.
This summary publication was adopted by the City Council of St. Joseph on the 5~' Day
of June, 2008 and shall be effective upon publication.

RECITALS:
WHEREAS, the City Council for the City of St. Joseph has passed Ordinance 24, entitled
"Volunteer Fire Department".
WHEREAS, the City of St. Joseph desires to publish the Ordinance by Summary Publication.
THEREFORE, IT IS HEREBY RESOLVED:
1. The City Council has reviewed the proposed Summary Publication and finds that the
summary of the Ordinance clearly informs the public of the intent and effect of the Ordinance.
2. The City of St. Joseph directs the City Administrator to publish the Ordinance by
Summary Publication.
