PURD -Application process, documents submitted in particular the Special Use Permit. How can a special use be granted if the application material required in the Ordinance was not submitted. 2. Special Use Permit Expiration -The Ordinance section reference the expiration if not construction not in one year. -how does this provision impact the current development. 3. Transfer of property -The Development Agreement for Graceview II includes the following provision. (extract of page 15 of the development agreement) 8.29 Assi~mnent. This Agreement may not be assigned by Developer except upon obtaining the express written consent of the City. [NOTE: The property being discussed at this time is an outlot in Graceview 2] 4. Completion Date -The Development Agreement for Graceview II includes a completion date. - How does this deadline relate to the proposed development. 4.2 Completion Deadlines. The Developer agrees to proceed with said Plan B Improvements entirely at its expense, and to complete said improvements by June 30, 2004, except for final wear course which shall be completed by September 15, 2005. The construction documents shall establish completion dates at or before the dates shown above. Part B -After the September 15, 2005 deadline isn't the developer required to comply with the current Ordinances and the revised Ordinance in 2005 required PUD to have an underlying zoning district so the property in question would have to be rezoned to R3. Comprehensive Plan -This properly is illustrated as R1 in the Comprehensive Plan. The map illustrates the property as R1. (position of Dale Wick). Commissioner Mike McDonald clarified that the verbiage identifies this area as mixed use. (I will forward this chapter to you). 6. Senior Housing -how was this labeled in the PURD, it falls under R3 - is there a difference between the two housing types. 7. School and busing -verification on busing to Kennedy and Lab School. 8. EAW -Page 4 discusses the cover types and the Ordinance limits R3 to 20% of the total development. How is the 20°!o calculated and does it meet the provision. 10. Cover types. Adequacy of 24' proposed roadway connecting 7t" Avenue. How was this width selected. 10. Can sidewalk be added at this time and should the City look at restrict parking to one side of the street. 11. The City should receive a phasing schedule with this project (Note -the original submittal does have a phasing schedule).
