tell you that an engineer can design anything, it is just the cost and the goa) you are trying to accomplish. I did not have
Randy prepare much as it becomes very costly to start engineering sidewalks and streets,

Sarah, our attorney, and I will be discussing the recently posted materials this morning concerning Graceview.
Besides Sarah's 2 questions below I have a couple as well:
1) In your letter dated 9/24 to the planning commission that was posted last night, you stated in the last
paragraph that the planning commission "should make a decision based on the findings as to approval or
denial". My question is; What are you asking the planning commission to approve or deny -rezoning,
PURR, a Special Use permit ? The Planning Commission must make that decision at the meeting based
on information from. the Attorney.
2) In your letter dated 9/11 to Lori Athman, you spelled out the 11 major concerns or questions that were
raised by either our neighborhood coalition group and/or planning/city council members. I believe there
are other questions or concerns that have been addressed in the past that are yet un-resolved. In any case,
in the 9/24 letter mention above in #1 -second paragraph you said the city engineer has not prepared a
written response to the questions... For us to be adequately prepared for the 9/30 meeting we need
specific responses to the letter dated 9/11 -specifically items number 7-11(we may have additional
questions to # 1-6 based on our feedback from our attorney which I believe the city attorney tried to
address in their 91241etter) - we cannot wait unti19130 to hear an oral report to these other questions
from the city engineer and/or the city attorney. The city has had several weeks to prepare these
responses and we need them prior to this meeting. In fact even if we get them today we may not have
adequate time to review with our attorney. This has not been a simple matter to review. A lot of case
law has been reviewed in the letter fiom the City Attorney. We have verified that busing is provided to
Kennedy not the Lab School. The EAW question with regard to 20% calculation -the 20% is
determined after the streets and public rights of way have been removed. The adequacy of the 24' road
is based on a standard temporary residential road. The sidewalk, they have gone to the site and are
1oolting at options -Randy will bring any options to the meeting. Parking can. be restricted by
resolution of the City Council and a phasing plan was submitted with the first submittal.
3) Finally, is it your intention (see #1 above) to come to some final planning commission conclusion/vote
to the Graceview Estates Outlot A issue on 9/30? This is not about my intention. As a staff person I
have provided the information to the Planning Commission making them aware of the Statutory
deadlines for the matter. The Planning Commission always has the opportunity to table the matter. The
direction at the last meeting was they wanted to resolve this matter at the next meeting {which is 9/30),

I had 2 quick questions for you this morning...
Will it make a difference who's name is on the agenda for the 30th? We would like our lawyer to speak in place
of myself, should his name be on the agenda instead of mine?
Also, could we get a copy of the 10 special use permit conditions that were referred to in the latest memo from
the City Attorney?
