First, thank you for sharing your opinions. I will ask City staff (Jean) to retain a copy of your email with opinions for our records and for distribution with the next Planning Commission information packet. As for your question: The City is insured through the League of Minnesota Cities Insurance Trust. The City's Agent is Peter Omann from Omann Insurance in St. Joseph. The legal opinions were NOT mentioned last night by the commission or city representatives nor did the city attorney address them. Our legal representative mention them in our opening statement but the Planning Commission never mentioned the city attorneys letter nor did you ask the Planning Commission to consider the City Attorney letters. In my opinion, I believe the city attorney has spelled out the legal opinions in several briefs but were not full transmitted, received, or mentioned by the Planning Commission last night. I also feel that the Planning Committee just wanted to wash their hands of this mess and give it to the city council to deal with- in fact several of them stated this exact opinion last night on record. They even admitted that mistakes were made - which is something I have tried to explain to you on several occasion (I can get you those emails if you like?) that mistakes were made (we are not blaming anyone) but we have an opportunity to fix those past mistakes but yet the Planning Commission has chosen to over look those mistakes and continue down this dangerous legal path. I really think that the city attorney should have spoken up last night to ID the root cause issue rather than say nothing and let the SUP move forward. Finally, for public record information purposes who is the city's insurance company, primary contact person, telephone number, and are the premiums paid to date? Thank you, Bradley H.
