Regarding building height max for apartment units. The current standard (2008) is three stories or 40 feet. The 2001 standard was 35 feet. Since the SUP application was filed this year, the 2008 rules apply. Also important to understand is the definition of building height. The following definition was applicable in both 2001 and 2008 and can be found in the 'definitions' section of the zoning ordinance: "Subd. 15: Building Height. The vertical distance measured from the average ground level adjoining the building to the highest point on the roof surface if a flat roof, to the deck line of mansard roofs, and to the mean height level between eaves and ridge of gable, hip and gambrel roofs" I'm attaching a site plan for the proposed units. Please note the gable roof and the average elevation difference of 34'. This means the building height as proposed is 34' which meets both the 2001 and 2008 requirement.
