Special Use Permit, College of St. Benedict

BOARD/COMMISSION/COMMITTEE RECOMMENDATION: The Planning Commission conducted a
public hearing on October 13, 2008 for the College of St. Benedict, requesting a special use permit to
allow for the construction of a bus shelter on 3`d Avenue NW.
Prior to the public hearing, the Planning Commission discussed whether the College could request
rezoning for the property where the shelter is to be located to E & E. The Planning Commission
requested that the College apply for special use rather than rezone the property.
PREVIOUS COUNCIL ACTION:
BACKGROUND INFORMATION: At the public hearing no one presented testimony for or against the
special use permit request. The College of St. Benedict owns the property on both sides of 3`d Avenue
NW. While 3`d Avenue NW is a public street to the east /west alley, the street serves as an entrance to
the College. The students are already picked up along this area and the College is only requesting to
placed a covered shelter over the standing area. The shelter is similar to those you see in St. Cloud for
the MTC.
The Planning Commission unanimously recommended approval of the Special Use Permit with the
contingency that the shelter not be located in the ROW.
BUDGET/FISCAL IMPACT: It is unable to determine the impact of the bar hours. It is more likely
that the Police Officers schedule would have to change to avoid paying overtime costs.
ATTACHMENTS: Previously you should have received the Planning Commission
information.
REQUESTED COUNCIL ACTION: Accept the recommendation of the Planning Commission and issue a
special use permit to the College of St. Benedict to allow the construction of a bus shelter at 222
Minnesota Street West. The bus shelter will be located outside of the ROW on 3`d Avenue NW

Public Hearing
City of St. Joseph
The Planning Commission for the City of St.loseph will conduct a public hearing on Monday,
October 13, 2008 at 7:00 PM to consider issuance of a special use permit. The special use
Administrator permit is requested to allow the construction of a bus shelter for the College of St. Benedict,
Judy Weyrens in a R1, Single Family Zoning District. The proposed bus shelter will be located on property
owned by the College of St. Benedict located at 222 West Minnesota Street.
Mayor St. Joseph Code of Ordinances 52.27 Subd. 3: Uses under Special Use Permit. The following
AI Rassier uses shall require a Special Use Permit based on the procedures set forth in this Ordinance:
a) Governmental and public utility buildings and structures necessary for the
Councilors health, safety and general welfare of the community.
k) Uses which in the judgment of the Planning Commission and City Council are
