BACKGROUND INFORMATION: In May of 2003, Pond View Ridge LLP prepaid 67 lots for water and
sewer access fees. The fees were prepaid as the City was increasing the water access fee from $ 2,000
to $ 3,500. At that time the Ordinance did not include a provision where access fees could not be
prepaid. So, to save on future increases, the developer prepaid all the single family lots in Graceview
Estates. The City has since fixed the Ordinance and has included a provision that access fees cannot be
prepaid. The hookup fees today are $ 3,900 for water and $ 2,000 for sewer. The City has never been
in a situation like this before as no one has prepaid fees.
Pond View Ridge LLP is requesting a refund for the lots that remain vacant, 20 lots. The Access is does
not impact piping that is in the ground or connections. The access fee is a fee that allows access to the
system and does not include any physical material.
BUDGET/FISCAL IMPACT: Reduction in the Water Access fund of $ 40,000 and a reduction
of $ 40,000 in the sewer access fund.
