SUBMITTED BY: Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: The Council considered the refuse bids for the contract years 2009 - 2011 at the December 4, 2008 Council meeting. The Council motioned to accept the bid of Allied Waste and authorized staff to prepare the contract agreements. BACKGROUND INFORMATION: Allied Waste has agreed to implement the recycling bank program in St. Joseph. As the program needs to be established including the delivery of carts with chips and solicitation of vendors, the program will not be ready for approximately six months. The carts will be ordered as soon as the City executes the agreement. Once the program is implemented, the fees will increase one dollar per month. The agreement includes this provision. We are still working on the rates and hope to have that information for your January meeting. The new rates will become effective in January, but will not be billed until March 1, 2009. The new rates should be ready for the January Newsletter. BUDGET/FISCAL IMPACT: ATTACHMENTS: 2009 - 2001 Refuse Contract REQUESTED COUNCIL ACTION: Authorize the Mayor and Administrator to execute the refuse contract for the period January 1 2009 through December 31, 2001 between the City of St. Joseph and Allied Waste Services. REFUSE HAULER AGREI/MENT This agreement made and entered into this 18'x' day of December , 2008 by and between Allied Waste Service of Sauk Rapids, party of the first part, and the City of St. Joseph, a Municipal Corporation, part of the second part. ]t is hereby agreed by and between the parties as follows: From January 1, 2009 to December 3l, 201 1 the party of the first part is hereby employed to operate a refuse collection service, serving all of the residences, excluding the non-owner occupied rental units and business places, in the City of St. Joseph, Minnesota. In providing said service the first party shall: a. Collect refuse of all owner occupied residences in the City of St. Joseph. The residents shall have a choice of one of two services. First, there will be a choice of one (1) sixty (60) gallon container. Residents also have a choice of one (1) smaller container with a limit of thirty (30) gallons. Any residents who so chose, may at the beginning of any one billing period elect to convert to either the larger or small container. Containers are to be placed at the rear end of all lots having alleys or reasonably near the street on lots not having an alley access. The party of the second part shall only be responsible for billing for the base service; the party of the first part will bill for any other service. The party of the first part will contract with residents separately for extra pickups, construction debris and yard waste, at the individual residence. Absolutely no tires, batteries, drain oil, paint, or chemicals can be picked up. b. Use a compactor truck for refuse pick up service. c. Dispose of all refuse at such places where the first party can lawfully dispose of the same at the first party's expense and not at the expense of the City. The party of the first part will provide a disposal plan which will minimize the total amount of mixed municipal solid waste which is land filled to 35% or less by weight through processing or delivering the mixed municipal solid waste to a processing site. d. Collect all refuse once each week, the established pickup day being Thursday. The party of the first part shall continue to provide service each and every Thursday, but shall however, have the right to change said days of pickup upon giving written notice to the second party and obtaining the second party's consent. The first party shall publish the notice in the St. Cloud Times and St. Joseph Newsleader for any approved change seven days prior to the change and the first party shall have broadcast said change on the following radio stations: WJON, KSAM, KS95. This broadcast must be aired each of the seven days prior to the approved change. [n addition, the first party shall place notices on one refuse container of each of the residents to be served in substantially the following form: CITY OF ST. JOSEPH GARBAGE AND REFUSE PICKUP DAY OF PICKUP GARBAGE PICKUP TIME DATE OF EFFECTIVE CHANGE COMPANY NAME COMPANY PHONE NUMBER e. Recycling service will be provided at no cost to the residents or City of St. Joseph. Items for recycling will include but not be limited to: newspapers, can, glass and plastic. This service shall be provided bi-weekly . f. The party of the first part shall be responsible for the implementation and management of the recycling program entitled "recycling bank". Each resident will be provided a 60 gallon container for single sort recycling. Once the program is operating the monthly refuse rates will increase $ 1.00 per month. g. The party of the first part shall be responsible for providing a curbside spring and fall pickup. All residents affected by this contract, shall twice each year, have the opportunity to participate in a spring and fall cleanup at no extra charge to the City of St. Joseph. Large items can consist of furniture, white goods, or any other household goods, excluding hazardous waste. There shall be no limit as to the amount of garbage per residence on said cleanup days. Included in the spring and fall clean up is an appliance drop off one Saturday in spring and one Saturday in fall, with a limit of two appliances per drop off event (spring and fall). h. The party of the first part will provide a dumpster at no charge, for City use, at 25 College Avenue North and one at Millstream Park. Perform all work in reasonable manner, protecting from any unreasonable or unnecessary damage or wear to the containers used in the pickup service. j. To indemnify the City of St. Joseph from any and all claims or demands for damage to person or property arising out of or in any way connected to the performance by the party of the first part of the requirements of this agreement and to carry insurance satisfactory to the second party, naming the second party as co-insured providing coverage for damage to property in the sum of $ ] 00,000 and injury to any one person in the sum of $200,000 and injury to more than one person arising out of one occurrence in the sum of X300,000, said insurance covering first party and second party for any activities arising out of the first party's perfoi7nance of this agreement, and provide second party with a certificate of insurance. 2. If the performance by the first party of the services herein provided shall be commenced in the middle of the month, and service provided shall be for less than an entire calendar month, the sum to be paid to the first party shall be prorated and the first party shall be paid only that part of the month in which the service is actually provided. 3. Every owner of a multiple family dwelling shall supply facilities for the sanitary and safe storage and/or disposal of rubbish and garbage. In the case of single, two family or multi-family dwellings of three units or less, the disposal of rubbish and garbage shall be by the hauler contracting through the City in accordance with the terms and conditions of the city contract. For all other properties, the owner shall contract with a refuse hauling and disposal company, which furnishes appropriate containers for on-site storage of rubbish and garbage and pick up at least bi- week 1 y. 4. The first party shall not be obligated to provide said service in any areas until plowed of snow by the second party, but then shall provide said service in the amount of pickups where the parties to be served have cleared snow to provide access for first party to the containers to be picked up. 5. The City shall at the commencement of the performance of this agreement, and at the start of each three-month period thereafter, make a count of all pickups where service is provided by the first party and said count shall be used to determine the sum to be paid to the first party for the service provided. 6. This aleement shall be subject to termination during its tern by the second party upon said second party giving written notice of its intent to terminate 30 days before the date it chooses to terminate said agreement.
