HomeMy WebLinkAbout1997 [09] Sep 15 I Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in regular session on Monday, September 15,1997 at 7:00 p.m. in the St. Joseph City Hal/. Members Present: Chair Hub Klein, S. Kathleen Kalinowski, Linda Sniezek, Marge Lesnick, Dan Nierengarten. Council Liaison Cory Ehlert. Secretary Judy Weyrens. Others Present: Economic Development Director Chad Carlson, Ellen Wahlstrom, Bob Wahlstrom. Land Use Moratorium: Chad Carl so", EDA Director, presented the following suggestions for the Moratorium Area: Moratorium Area #1: North of County Road 75, west of College A venue North extending west to Millstream Park. · Area west of Col/ege Avenue to the Mobile Home Park area: designate as Commercial or General Business · Area currently designated as RM: designation will remain RM mobile home · Property currently owned by City and used as the Maintenance Facility. Currently is zoned Industrial: recommendation to designate as Public. · Property located behind the Maintenance Facility and west, the current zoning is Industrial with a smalt portion as General Business: recommended designation of Commercial or General Business. The Commission discussed the property on the east side of College A venue North and if it would be compatible to General Business. Carlson stated that in his opinion it would be compatible. Also discussed was Sunset Manufacturing and if the operation was General Business or Industrial. Carlson brieny discussed the expansion plans of Sunset. The Commission also discussed the property adjacent to the existing Railroad and the right-of-way that has recently been purchased. The Commission discussed the need to zone the property and how the property relates to the proposed Lake Woebegan Trail. Sniezek made a motion to recommend the area behind the former Krebsbach Bulk Tank site and west of the City Maintenance Facility be designated public; seconded by Kalinowski. Discussion: The Commission discussed the property north of the Maintenance Facility and what appropriate uses would include. The motion passed unanimously by those present. Ehlert made a motion recommending the following zoning classification designations in the Moratorium One area: All remaining property in Moratorium One area to be designated General Business, and all property currently zoned R3 be zoned General Business; seconded by Kalinowski. The motion passed unanimously by those present. I Moratorium Area #2: The area north of Minnesota Street and south of County Road 75, east of 3rd Avenue NE to 91st Avenue. Wahlstrom discussed the need for the Planning Commission to expand the Ordinance to include a setback whenever business abuts a residential neighborhood. The Commission discussed reviewing the Zoning Ordinances and how to accomplish such a task. Kalinowski stated the Commission needs to set aside time to review the Ordinances in a timely manner and conduct the necessary hearings. Commissioners agreed that the Ordinances need updating and written in a clear and concise manner. Ehlert discussed the need to periodically review the Ordinances in the same manner that the Comprehensive Plan is reviewed. The review would help to meet the needs of the City. The Commission discussed non-conforming uses in zoning districts and the impact development has on the non-conforming uses. Development can reduce the value of a parcel. Wahlstrom is requesting protection for residential homes abutting zoning classifications other than residential and for protection of non-conforming uses in Commercial or Industrial Development. Carlson made the following recommendations: · Property east of 3rd A venue and abutting 3rd A venue: recommendation to designate as R-1 Single Family. · Roske Property: recommendation to designate the property used by the Fire Hallas Public and the remaining property as General Business. · Bill Wasner Property: recommendation to designate as General Business. · Property north of Minnesota Street to Bill Wasner Property: recommendation to designate the property as R-1, single family. · Existing apartment complexes, Hoffman property: recommendation to designate the property as R-3, Multiple Family. · Property currently owned by Bob and Ellen Wahlstrom: recommendation to designate as R-1; Single Family. · Property north and abutting Minnesota Street East (frontage lots, current single family use); recommendation to designate the property as R-1, Single Family · The one lot of the Roske property abutting Minnesota Street and 4th A venue NE is currently zoned General Business; recommendation to designate the property as Public. · Property abutting County Road 75, east of County Road 133; recommendation to designate the property as General Business Klein made a motion to accept the recommendation of the Economic Development Director and schedule a re-zoning hearing for Monday, September 29, 1997 at 7:00 p.m.; The motion was seconded by Sniezek and passed unanimously by those present. Sniezek made a motion to extend the Moratorium 30 days to allow the Planning Commission to conduct the required public hearing and make a recommendation to I the City Council. The motion was seconded by Lesnick and passed unanimously by those present. Approval of Minutes: Lesnick made a motion to approve the minutes of July 22 and August 4, and August 26, 1997 as presented. The motion was seconded by Nierengarten and passed unanimously by those present. Other Business: Sniezek discussed complaints she has received by Hope Klocker, Kay's Kitchen, and issues regarding Taco John's. Klocker indicated that a safety hazard has been created by the removal of the trees, the development has encroached her property and her parking lot is being used by Taco John patrons. Kalinowski questioned at what point the issue is a neighbor dispute and when the City has the right to intervene. Ehlert stated that he would discuss the safety hazard with the owner I Paul Sullivan. Carlson stated that some ofíhe issues are competition and the City does not have the authority to intervene. Liaison Reports: Planning Commission pay increase request: Ehlert reported that he discussed the matter with the Council and they denied the request Your time. He stated that the Council felt that budget restraints would prohibit any increases. The Commission stated that because of the public hearings required and the amount of work required of the Commission, they requested the increase. The Planning Commission stated they have a different level of responsibility than other Commissions of the City. Adjourn: Nierengarten made a motion to adjourn at 8:45 p.m.; seconded by Ehlert.
