Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in regular
session on Monday, December 1,1997 at 7:00 p.m. in the St. Joseph City Hall. I
Members Present: Chair Hub Klein. Commissioners S. Kathleen Kalinowski, Marge Lesnick, Linda Sniezek,
Dan Nierengarten, Kurt Schneider. Council Liaison Cory Ehlert. Deputy Clerk Judy Weyrens.
Others Present: Jim Graeve
NorthDark Third Addition: Weyrens reported that Mr. Lambert could not attend this meeting and requested this
matter be placed on the December 10, 1997 special meeting of the Planning Commission. The Commission
denied the request to place this matter on said agenda as this matter is regular business and should be handled
at a regular meeting. Therefore, this matter will be placed on the January 5, 1998 agenda.
Ehlert reported that the City Council referred this matter back to the Planning Commission for review of the
development plan. At the November 20, 1997 City Council meeting Lambert agreed to submit a parking lot
plan for the proposed plat.
Sniezek stated that she has contacted many agencies regarding this plat. Below is a summary of her contacts
and conversations:
· Tom Kruishank - Meto Bus, stated Steams County is in the process of studying light rail or
extending the Wobegon Bike in the same location as the proposed plat. He also stated the Railway
Authority should have been contacted about the purchase of Mr. Lambert.
· JoeOpatz - Indicated it was his understanding that all railroad right of way (RROW) was intended
to be turned back to the public.
· Chuck Wocken - Stated he has been active in RROW acquisition and in the past all purchase
agreements contained a clause whereby public use has priority.
· Dan Kron- Representative of the Railroad stated that all purchases of RROW must receive his
approval and he is not aware of the sale to Mr. Lambert. He further stated that public entities have I
180 days to appeal any sale of corridor.
The Commission also discussed the fact that Mr. Lambert did not own the property he was proposing to plat.
After discussion, the Commission requested Weyrens to notify Mr. Lambert that before the Commission will
take any action on the preliminary plat of North Park Third Addition, proof of ownership must be submitted.
COUNCILOR REPORTS
Bee Line Marine: Ehlert reported the owners of Bee Line Marine are upset with regard to the conditions placed
on the building permit and would like them relieved. The Commission had requested that before a Certificate
of Occupancy is issued a plan needs to be submitted as to where repairable parts would be stored. While the
property owner has cleaned up the property, the Commission left the conditions on the building permit as this
property is one of the main entrances to the City and should be aesthetically pleasing.
Winter Parkino Restrictions: Ehlert reported that he and Councilor Loso will be presenting the City Council with
a proposed amendment to the Winter Parking Ordinance. The proposal will include the allowance of
purchasing a permit to park on the street. In case of snow, the cars would need to be moved.
St. Joseoh Ordinance Uodate: The Commission spent the remainder of the meeting reviewing and
updating a portion of the Zoning Ordinance.
Adiourn: Nierengarten made a motion to adjourn at 9:35; seconded by Sniezek and passed unanimously by
