PREVIOUS COUNCIL ACTION:
The City Council previously passed Resolution 2007-12 approving the APO programmed amount
of $68,987 for the Field Street 4(f) Study, comprised of 70 percent ($48,291) federal funding and
30 percent $20,696) local funding. The Council also previously passed Resolution 2007-043
approving $84,390 for analysis of the 62 minimization alternative comprised of 70 percent
($59,073) federal funding and 30 percent $25,317) local funding.
BACKGROUND INFORMATION:
The attached Agreement Amendment, prepared by MnlDOT, is standard on federally funded
projects. It authorizes MnlDOT to act as the City's agent in administering federal funds and
receiving the additional eligible federal funds associated with the previous Council resolutions.
BUDGETIFISCAL IMPACT:
Federal Share $209,601
City Share $102,776 Plus Remaining Expenses

SAMPLE RESOLUTION FOR AGENCY AGREEMENT
BE IT RESOLVED, that pursuant to Minnesota Stat. Sec. 161.36, the Commissioner of
Transportation be appointed as Agent of the City/County of to accept as its agent,
federal aid funds which may be made available for eligible transportation related projects.
BE IT FURTHER RESOLVED, the * vi1ayorj/(Chairman) and the * (Clerk/(;1llditor) are hereby
authorized and directed for and on behalf of the City/County to execute and enter into an
agreement with the Commissioner of Transportation prescribing the terms and conditions of said
federal aid participation as set forth and contained in "Minnesota Department of Transportation
Agency Agreement No. xxxxx", a copy of which said agreement was before the City
Council/County Board and which is made a part hereof by reference.

Agency Agreement No. 86510 Amendment
Dear Mr. Bettendorf:
Attached are four copies ofthe agency agreement amendment between the City of St. Joseph and
MnlDOT, which allows for MnlDOT to act as the City agent in accepting federal aid in cOlmection
with the above referenced proj ect.
Please review and if approved, have all four copies signed. A Council resolution similar to the
example attached, must be passed. The certified resolution should then be placed as the last page
in each ofthe four copies ofthe agreement. Please verify that the person/title authorized to sign as
stated in the resolution, corresponds to the signature (person/title) on the signature page. Please
return all four copies of the agreement to me for MnlDOT signatures. A fully executed copy will
be returned to you.

This amendment is by and between the State of Minnesota, through its Commissioner of Transportation ("Mn/DOT") and
City of St. Joseph, Minnesota ("City").
Recitals
1. Mn/DOT has a Agreement with City/CountY identified as Mn/DOT Agreement Number _86510 ("Original
Agreement") to provide preliminary engineering, corridor study, and bypass concepts for the Southern Corridor of the
community.
2. Agreement is modified to reflect the additional costs for the preparation of the study, due to the discovery of a
traditional cultural property within the borders of the study area.
3. Mn/DOT and City/County are willing to amend the Original Agreement as stated below.
Agreement Amendment
In this Amendment deleted Agreement terms will be struck out and the added Agreement terms will be bolded and
underlined.
REVISION 1. LB. is amended as follows: ELIGIBILITY / COSTS. The estimated cost of the Preliminary Engineering is $159,000
$312.377.
1. The orh!inal proiect cost estimate was $159.000. It is anticipated that 64.3 W% (up to $127,200.00$102.237.00
uncapped) of the cost of the Preliminary Engineering is to be paid from federal funds made available by the FHW A;
and that the remaining 35.7 ;u)% ($56,763) shall be paid by the City. The City will pay any part of the cost or
expense of the work that the Federal Highway Administration does not pay.
2. As work pro2:ressed on the proiect it became necessary to amend the ori2:inal scope of preliminary
en2:ineerin2: to increase the estimated costs by $153.377. It is anticipated that 70% (up to $107.364.00 of the
cost ofthe Section 4(0 evaluation and analvsis of an avoidance/minimization alternative (Amendment 1) is to
be paid from federal funds made available by the FHW A. and that the remainin2: 30% ($46.013) shall be paid
by the City. The City will pay any part of the cost or expense of the work that the Federal Hi!!Invav
Administration does not pay.
REVISION 2. IILB. is amended as follows: B.MnlDOT's authorized representative is Lynnette Roshell, Minnesota Department
of Transportation, State Aid for Local Transportation, Mail Stop 500, St Paul, MN 55155, phone 65I.n2.6179, 651.366-3822 or her
successor.
The terms of the Original Agreement and all' previous Amendments are expressly reaffirmed and remain in full 'force and
effect. The Original Agreement and all previous Amendments are incorporated into this Agreement by reference. Except as
amended herein, the terms and conditions of the Original Agreement and all previous Amendments remain in full force and
effect.
