The plat consists of ten (10) lots extending from 4`h Avenue NE. The Planning Commission recommended the Council approve the preliminary plat and the Council approved the preliminary plat on September 20, 2007. BACKGROUND INFORMATION: Last fall the City staff was working on the draft Development Agreement. Since the plat would not be developed until spring of 2008, the developer requested to wait to execute the agreement as he did not want to file the final plat. It is the policy of the City to not bring a plat forward for approval without the development agreement. Due to the economic slow down, MG Development is requesting to delay final plat approval until the Spring of 2009. St. Joseah Code of Ordinances 54.30 Subd. 4(a) requires final plat approval within 120 days of the preliminary plat approval. (See Attached). I have received a request to delay final plat approval until Spring of 2009 along with a request to keep the platting fees as they were when the plat was developed. In January of 2008 the City changed the fees for platting and added a fee for the final plat and increased the storm water fee from .22 square foot to .25 square foot. All of the engineering and work for this plat has been finished and is ready for approval. It is a reasonable request to accept the fees that were in place when the plan was developed. The developer will still be required to pay the reimbursables such as legal and engineering. I am writing to ask the City of St. Joseph to allow us to delay the recording of the final plat for one year. The economic slowdown that has occurred in the housing market has necessitated us to make this request. We would also like to request that the City hold all fees associated with this plat to the fees that were in effect when this Plat was first submitted. The subdivider-developer shall be notified by the City Administrator of the City Council's action together with the reason for such action and what requirements will be necessary to meet approval of the City Council. The approval of the Preliminary Plat does not constitute an acceptance of the subdivision, but is deemed to be an authorization to proceed with the preparation of the final plat. This approval of the Preliminary Plat shall be effective for a period of one hundred twenty days (120), unless an extension is granted by the City Council. The scale of the Final Plat shall be not less than one (1) inch to one hundred (100) feet and shall comply with all conditions and requirements of applicable regulations and all conditions and requirements upon which the preliminary plat approval is conditioned either through performance or the execution of appropriate agreements assuring performance. c) The owner shall submit a completed application, all required materials and sixteen (16) or more copies of the Final Plat to the City Administrator at least sixteen (16) days before the Planning Commission meeting at which such Plat is to be considered. Such Final Plat shall be submitted within one hundred twenty (120) days of Preliminary Plat approval; otherwise such approval shall become null and void. The owner shall also submit a title opinion disclosing title to the property and any interests of other parties in the property. d) Upon receipt of the completed application, the City Administrator shall transmit one (1) copy of the Final Plat to each Department Head, the City Engineer, the City Attorney and other staff/consultants as warranted for comment. e) The City Administrator, Department Heads, the City Engineer, City Attorney and any other staff/consultants consulted shall review the Final Plat and shall transmit a report of his opinions to the City Administrator at least ten (10) days prior to the meeting at which such Plat is to be considered. f) The City Administrator shall formulate a report and deliver the report and a copy of all required materials and a copy of the final plat to the Planning Commission. 54-30
