BACKGROUND INFORMATION: Steve Schirber has requested a lot split of property he owns adjacent
7"' Avenue. When the City installed the utilities for the Cloverdale Area this particular lot was charged
as if it were two lots, since the area was large enough to be split. I have attached the assessment roll for
the project illustrating that the property assessed as though it is two lots.
The vacant lot that will be created has an existing shed, the Zoning Ordinance does not allow an
accessory building without a principal structure. As you can see from the survey the vacant lot will have
a shed 20 x 22. The property owner will be required to move the building and he has agreed to but
would like a window of one year.
The Ordinance allows the Administrator to approve minor subdivisions under certain circumstances.
Those circumstances include if the division is less than 10 acres and no more than two lots. In this case
the Ordinance applies.

REQUESTED COUNCIL ACTION: Approve the lot split of Steve Schirber, creating two single family
residential lots as illustrated on the attached certificate of survey and authorizing the Administrator to
execute the certificate of compliance. Approval also requires that the property owner remove the
existing accessory building on or before May 1, 2009.

Certificate of Compliance
To: Stearns County Auditor's Office
The undersigned Administrator for the City of St. Joseph does hereby certify that the City
Council reviewed and approved at its regular meeting on the 17`" day of July 2008, a lot split dividing ten
(10) feet of property from Lot 5, Block 2 Cloverdale Estates and adding the same to Lot 6, Block 2
Cloverdale Estates. The lot split has created the following two legal descriptions:
Tract A
Tract B
Lot 6 and the West 10.00 feet of Lot 5, Block 2, Cloverdale Estates, Stearns County,
Minnesota, according to the recorded plat thereof.
Lot 5, Block 2, Cloverdale Estates, Stearns County, Minnesota, according to the recorded
plat thereof, lying easterly of the West 10.00 feet of said Lot 5.
The attached survey described and illustrates the lot split requested. The transfer is in
compliance with the Zoning Ordinance and Subdivision regulations of the City of St. Joseph. Further, this
certificate does not operate as approval for any subdivision, platting or building plans.
