PREVIOUS COUNCIL ACTION: At the previous Council meeting Mike McDonald approached the
Council and requested that the Council consider televising the budget workshop meetings. Councilor
Frank and Schultz also expressed interest. I have been asked to place this matter on the agenda. The
cost for televising the meeting will be approximately $ 70. We have two cable persons present and they
are each compensated $ 35.00 per meeting.
MISCELLANEOUS MATTERS: I have been asked to present to the Council what matters may be placed
on the ballot for election and how the City would change term limits or lengths of terms. I will have
information forwarded early next week.

The following addresses the two issues raised by the City with regard to elections.
A. Can the Mayor's position be made into a four year term and, if so, how?
A mayor maybe elected for either a two or four year term. Minn.Stat. 412.02. The council may,
by ordinance, establish a four year term or re-establish atwo-year term for the office of mayor
commencing with the ensuing term, except that in a standard plan city which establishes a four
year term for mayor, the first mayox to serve afour-year term shall be elected at the first election
when the clerk is not to be elected. In any case the ordinance shall not affect the team of the
mayor elected in the year in which it is adopted unless it is adopted at least four weeks before the
closing date for the filing of affidavits of candidacy for such election. Minn.Stat. 412.022.
B. What types of questions can be placed on the ballot? Can the City council
shift or defer decisions to the public byway of a special election ballot,
Special elections can be held so local voters can weigh in on city-specific issues. A special
election to decide a question relating to the city can be submitted to the local voters only if the
city is specifically authorized to do so by state law. Often times, a City wishes to hold an election
relative to controversial or politically sensitive decisions facing a city. The state law explicitly
gives local voters the authority to vote on certain topics. Without specific legislative authority,
however, the city council may not hold such a special election. In other words, the state
legislature delegates certain powers to statutory cities; this delegation functions bath as a grant of
power and as a restriction. Cities possess only those powers specifically given by the state
legislature or implied to carry out its delegated power. Without the legislative grant of specific
authority, a statutory city cannot act. Borgelt v. City of Minneapolis, 135 N.W.2d 438
~`Minn.1965); A.G. Op. 59a-32 {January 25, 2002). Thus, the state legislature decides if local
voters possess the authority to vote on city-specific issues. The legislature gives city councils the
powex to make decisions on most local issues, but does not give it the power to re-delegate that
decision-making authority to local voters. Minnesota Courts have held that a city council has no
authority to pass their decision-making power to voters when the legislature delegates that power
solely to the city council. Muehring v. School Dist. No. 31 of Stearns County, 28 N.W.2d 655
(Miruz.1947). Thus, the city must find specific authority for a special election on question.
Attached hereto as Exhibit A are special elections on questions which are required by law.
Exhibit B sets forth the statutorily authorized special elections called by council or by petition.
Exhibit C sets forth the statutorily permitted special elections. These documents were received
by the Minnesota League of Cities. These exhibits are not finalized, but are very close to being
adopted (thus explaining the comment notes).
Tn reviewing the exhibits, there is no authority to allow a question relative to matters concerning
development of property be submitted to the voters on a ballot.
