AGENDA ITEM: MNdot Agency Agreement -Requested Action:
Authorize the Mayor and Administrator to execute Amendment No. 2 of MNdot Agreement No. 86510
regarding the timeframe for completion of the Field Street Study.

BOARD/COMMISSION/COMMITTEE RECOMMENDATION:
PREVIOUS COUNCIL ACTION: In 2004 the City received federal funding to complete a corridor study
that has been known as the "Field Street" Study. The study was to review a south east west
transportation corridor.
BACKGROUND INFORMATION: The initial contract indicated a five year study timeframe. At this time
the study is still in the hands of Cultural Resource and the study will not be complete by April of 2009.
The Amendment before the Council extends the timeline 2 years, through April 2011. Kristen from
Cultural Resource has indicated that she is anticipating a letter from Dennis regarding a desire to write
up a Programmatic Agreement. He wants to make sure that SHPO continues involvement during final
design activities. Kristen indicated she will begin writing up the agreement immediately but it will need
to be signed by FHWA, the City, SHPO and potentially others. She indicated that the Consulting Party
will have an opportunity to sign it, but if they choose not to, the Programmatic Agreement is not null
and void. Finally she indicated that this process will add a few more months onto the Section 106
process further extending this project.

REQUESTED COUNCIL ACTION: Authorize the Mayor and Administrator to execute Amendment No. 2
of MNdot Agreement No. 86510 regarding the timeframe for completion of the Field Street Study.

Amendment No. 2 -Field Street Study
Extending the time for the Completion of the Study
BE IT RESOLVED, that pursuant to Minnesota Statute Section 161.36, the Commissioner of
Transportation be appointed as Agent of the City of St. Joseph to accept as its agent, federal aid funds
which may be made available for eligible transportation related projects.
BE IT FURTHER RESOLVED, the Mayor and the Administrator are hereby authorized and directed on
behalf of the City of St. Joseph to execute and enter into an agreement with the Commissioner of
Transportation prescribing the terms and conditions of said federal aid participation as set forth and
contained in "Minnesota Department of Transportation Agency Agreement No. 86510, a copy of which
said agreement as before the St. Joseph City Council and which is made a part hereof by reference.

Attached are three copies of the agency agreement between the City St. Joseph and Mn/DOT,
which allows for Mn/DOT to act as the City's agent in accepting federal aid in connection with the
above referenced project.
Please review and if approved, have all three copies signed. A Board resolution similar to the
example attached, must be passed. The certified resolution should then be placed as the last page
in each of the three copies of the agreement. Please verify that the person/title authorized to sign
as stated in the resolution, corresponds to the signature (person/title) on the signature page. Please
return all three copies of the agreement to me for MnJDOT signatures. A fully executed copy will
be returned to you.

This Amendment is by and between the State of Minnesota, through its Commissioner of Transportation ("State") and St.
Joseph ("City").
Recitals
1. State has a Agreement with City identified as MnJDOT Agreement Number 86510 ("Original Agreement"). To
provide preliminary engineering, corridor study, and bypass concepts for the Southern Corridor of the community.
2. The agreement is modified to extend the expiration date. The discovery of a traditional cultural property and the time
needed to resolve issues around it necessitates extension of the timeline of the contract..
3. State and City aze willing to amend the Original Agreement as stated below.

In this Amendment deleted Agreement terms will be s~~ and the added Agreement terms will be bolded and
underlined.
REVISION 1. VII. is amended as follows: TERM OF AGREEMENT. This agreement is be effective upon execution by the
City and by appropriate State officials, pursuant to Minnesota. Statutes Section 16C.05, and-will remain.in effect for €~e{3) seven 7
years from the effective date or until all obligations. set forth in this agreement have been satisfactorily fulfilled, whichever occurs fast
The terms of the Original Agreement and all previous Amendments aze expressly reaffirmed and remain in full force and
effect. The Original Agreement and all previous Amendments are incorporated into this Agreement by reference. Except as
amended herein, the terms and conditions of the Original Agreement and all previous Amendments remain in full force and
effect.
