J[~tiNPH MEETING DATE: March 19, 2009 Council Agenda Item 6 AGENDA ITEM: Outdoor Liquor Event, Church of St. Joseph SUBMITTED BY: Chief Jansky/Administrator Weyrens BOARD/COMMISSION/COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: The City Council has approved a temporary event permit for the St. Joseph Parish in 2006, 2007 and 2008. BACKGROUND INFORMATION: The recently amended Liquor Ordinance allows each license establishment to hold one event per license year past 9:30 PM. The Ordinance requires a public hearing and notification to the neighbors. Attached is the hearing notice that was published on March 6 and mailed to property owners within 350 feet. Members of the Committee are working with Jansky to assure that the security issues have will be taken care of. This event will also require the Council close the portion of College Avenue/CR 121 between Minnesota Street and East Baker Street. The Parish will be responsible for securing the necessary permit from Stearns County. This year the Church is requesting authorization to secure a liquor license for intoxicating liquor versus the malt liquor license from the previous year. They are proposing to sell hard lemonade and similar products in bottles. It is more cost effective for the parish to purchase the intoxicating liquor. In checking with Gambling Control, the City can issue a temporary license for such. The City does not currently have a license fee for intoxicating temporary liquor licenses but staff is recommending a fee of $ 250.00 compared to the $ 100.00 for malt liquor. BUDGET/FISCAL IMPACT: . The purpose of the hearing is hear all persons present upon the proposed outdoor event to be held at the Church of St. Joseph on July 3, 2009. The concert will be held in the parish's east parking lot. College Avenue will be closed between the east parking lot and the church and school grounds. The concert will feature Bobby Vee and his family along with three other bands. The concert will start at 6:00 pm and end at 12:00 midnight. The St. Joseph Chamber of Commerce and the St. Joseph Jaycees will provide a fireworks display that will take place during one ofe intermissions and be visible from the festival grounds. Along with the concert, the parish will offer for sale food and beverage concessions, bingo, pull tabs and games for those who attend. The parish will obtain the necessary liquor license, gambling and other permits, and insurance requirements for the event. We realize that an outdoor concert will have an impact on the local residents, especially those who live in close proximity to where the concert is held To minimize any disruption of local resident's daily routine caused by the noise generated during the concert, the parish plans to do the following: Position the stage and sound amplification equipment on the east side of the church's parking lot so the music is directed toward the church and church grounds. 2. Advise all residents living adjacent to the church parking lot of the concert, the time of the concert (6:00 pm to midnight), and that alternative lodging arrangements will be provided them if they choose not to attend the concert. Residents will be offered a room at a local motel at the parish's expense. The parish is working closely with the Chief of Police regarding security for the concert. The concert and festival graunds will be fenced and security officers will be at all entrances as well as patrolling the grounds. For any concerns during the concert, I will be the parish contact person. My cell phone number is 291-7097 and this number will also be given to Chief Jansky.
