Members Present: Chair Hub Klein. Members of the Board Sr. Kathleen Kalinowski, Linda Viehauser, Kurt Schneider, Dan Nierengarten, Donald "Bud" Reber. Ken Hiemenz absent due to military camp. Deputy Clerk Judy Weyrens. City Attorney John Scherer. City Engineer Joe Bettendorf. Others Present: Bruce Ostendorf, Rose Ostendorf, Bruce Haan, Bev Haan, Gary Faushing, Ed Merkiling, Edmund Schneider, Cy Valerius. Approve Minutes: Sr. Kathleen made a motion to approve the minutes with corrections; seconded by Linda Viehauser. Ayes: Klein, Kalinowski, Viehauser, Schneider, Nierengarten Nayes: None. Reber abstained. Motion Carried 5:0:1 Fence Ordinance: Commissioner Hiemenz prepared a sample fence ordinance to be reviewed by the board. After discussion, Reber made a motion to recommend to the City Council, to have the City Attorney draft a sample fence ordinance for the commission to review. The motion was seconded by Nierengarten. Ayes: Klein, Kalinowski, Viehauser, Schneider, Nierengarten, Reber. Nayes: None. Motion Carried 6:0:0 Northland Addition: Chair Klein, reconvened the public hearing for the proposed housing addition on the North side adjacent to the railroad tracks. The proposal has been submitted by Terry Schmid of Avon Lumber One. Mr. Schmid discussed with the commission the relocation of the park area. since the last planning commission meeting. The park will now be located a.t the area known as Indian Hill. He feels that this is prime property and aesthetically correct for a park. Also discussed with the commission was the location and number of Ingresses a.nd Egresses need for the development. Mr. Schmid presented a letter from Mr. Rothfork stating that he would agree to give the City a 66' foot wide continuation North of Northland's 2nd Avenue NE to the point it joins with his driveway. [n addition, Mr. Brandenberg, an adjacent land owner to the East also indicated that he would be willing to allow the City to have right away through his property. These agreements would place an Ingress/Egress from both the North and East. The planning commission was in agr•ecment that before f ina.l a.pprova.l a.i i agreements would have tv be finalised in writing. The planning commission discussed the type of housing that is proposed and who the developer would be. Mr. Schmid stated he is the sole developer and has no partner. He stated that he wa.s willing to place protective covenants in the development which would include the front yard bring sodded after construction, basements would be cinder block, brick would be required on the fronts of the houses, a.nd a. minimum square footage. After discusing the covenants with City Attorney, John Scherer, the planning commission agreed that all covenants would be in writing and included in the developers agreement before final a.pprova.l. Vieha.user made a. motion to recommend Council approval of the preliminary plat of Terry Schmid for Northland Addition with the following provisions: 1) The plat is accepted as FlJRD 2? An Ingress~Egress wilt be provided both to the North a.nd to the East 3) A road will be inserted in Block 1 to break up the string of houses Discussion: Reber and ka.linvwski expressed concern whether yr not this plat meets the criteria. of pURD a.nd if by a.llvwing this development presidence is being set.
