Pursuant to due call and notice thereof, the Planning Commission for
the City of St. Joseph met in regular session on Monday, December 7,
1992 at 7:00 p.m. in the St. Joseph City Hall.
Members Present: Chair Hub Klein. Members of the Commission Donald
"Bud" Reber, Sr. Kathleen Kalinowski, Ken Hiemenz, Kurt Schnieder, Dan
Nierengarten. Secretary of the Board Judy Weyrens.
Others Present: Gary Heltemes, Mark Lambert, Norm Gregerson, Kevin
Schirmers, Mark Happe, Leo Buettner, Ed Villalta, Lee Davis, Leona
Roth, Mary Mertes, Gerry Klaphake, Stephen Hoffman, Allan Stellmach,
Bob Walstrom, Ellen Wahlstrom, Mary Anne Graeve, Jim Graeve, Ervin
Goebel, Dick Stock, Mr. & Mrs. Dan Goering.
Chair Klein called the meeting to order at 7:00 p,m.
Garage Size: The Planning Commission has been asked by the Council to
review the Ordinance which pertains to the maximum allowed square
footage of a garage/accessory building. The Current Ordinance, 52.14
subd. 04e, states that the maximum is 800 square feet or 8~ of the lot,
which ever is less. Commissioner Reber stated that he feels that 800
square feet is sufficient, since that would allow a garage to have the
dimensions of 32 x 20, making the total area 640 square feet. The
Commission reviewed information received from other Cities on this
matter. The Commission clarified that the current maximum lot
coverage, 800 square feet, includes all accessory buildings located on
the premise. Additionally, the lot coverage maximum is thirty five
percent of the lot. Commissioner Schnieder felt that the Ordinance
should be amended so that in addition to the maximum 800 square feet,
residents would be allowed one (1) additional accessory building not to
exceed 100 square feet. Commissioner Hiemenz was concerned that
revising the Ordinance based on lot size, might result in very large
garages in residential areas. The Commission also discussed the
definitions as written in the Ordinance, pertaining to accessory
building and garage-private. After discussion, Reber made a motion to
recommend the City Council leave the Ordinance as written, No accessory
building nor buildings shall occupy an area greater than 8 percent of
the total lot size or a total combined area of 800 square feet,
whichever is the lesser. In addition, the definitions as written,
pertaining to accessory building, (page 75), and garage size, (page
77), should be written as one. The motion was seconded by Hiemenz.
Ayes: Klein, Kalinowski, Hiemenz, Nierengarten, Reber, Schneider.
Nayes: None. Motion Carried 6:0:0
The Planning Commission also clarified that all accessory buildings
need a building permit.
Since the garage size requirement has not been increased, Mr. Twit will
need to schedule a variance for his garage since he exceeds the 800
square foot maximum.

Mark Lambert - Apartment Complex: Mark Lambert appeared before the
Commission to request an extension on a fifteen (15) feet rear yard
variance, that was approved by the City Council in November 1990. The
Variance was needed to allow for the construction of an Eleven (11)
unit apartment building, located at 129 1/2 Cedar Street East, (see the
minutes of the October 29, 1990 for legal description). Mr. Lambert
explained to the Commission that he was been working on securing
financing since the approval of the Variance. According to St. Joseph
Code of Ordinances, variances expire after the term of one year if they
are not used. Mr. Lambert has since secured financing and is
requesting the Commission to recommend the City Council extend his
variance approval of 1990 at least one additional year. It is his
contention to build this the Spring of 1993. Reber made a motion to
recommend the City Council extend the fifteen (15) feet rear yard
variance, indefinitely. The motion was seconded by Kalinowski.

None. Abstain: Schneider. Motion Carried 5:0:1
Public Hearing - Re-zoning: Chair Klein called the public hearing to
order at 8:00, and the Secretary of the Board read the hearing notice:
The Planning Commission for the City of St. Joseph shall conduct a
public hearing on Monday, December 7, 1992 at 8:00 p.m. in the St.
Joseph City Hall. The purpose of the hearing is to allow citizen input
on a proposed amendment to rezone the following parcels of property:

The South Thirteen (13) rods of the East Sixteen and Two-thirds (16
2/3) rods of the North Twenty-four (24) rods of the Northwest Quarter
of the Northwest Quarter of the Northwest Quarter (NW 1/4 NW 1/4) of
section Fifteen (15) in Township One Hundred and Twenty-four (124)

Chair Klein explained that all the property described above has
recently been annexed, and when property is annexed it comes into the
City as Agricultural. The re-zoning recommendations are as the
property is currently being used.
Parcel ~ owned by Kevin Schirmers. Reber made a motion to re-affirm
the zoning by the Joint Powers Board, zoning parcel three as R-2. The
motion was seconded by Kalinowski.

Parcel 1~ owned by Irma Hoffmann Duplex. Since the property is a
rental unit containing four (4) apartments, Kalinowski made a motion to
recommend the City Council re-zone parcel 1 as R-3; seconded by Reber.

Parcel 2 owned by the City of St. Joseph and used as a park. Hiemenz
made a motion to recommend the City Council re-zone parcel 2, known as
Morningside Park, to Park. The motion was seconded by Reber.

Parcel 4 - 14, property along 91st Avenue, currently all are
residential. Kalinowski made a motion to recommend the City Council
re-zone parcels 4 - 14 from the Current agricultural to Single Family,

Parcel 15, also known as North Industrial Park. Steven Hoffman
questioned the types of business that is allowed in an Industrial Zone.
Commissioner Hiemenz read the portion of Ordinances that controls an
Industrial Zone, and informed those present that each use needed to be
brought before the Commission and reviewed independently. There being
no objections, Reber made a motion to recommend the City Council rezone
parcel I5 from the current agriculture to Industrial. The motion was
seconded by Nierengarten.

Parcel 16, owned by Bernie and Nancy Evans. Kalinowski made a motion
to recommend the City Council re-zone parcel 16 from the current
agriculture to Single Family, R-1. The motion was seconded by Reber.

Parcel 17, owned by Jim and Mary Anne Graeve. Mr. Graeve questioned
whether or not he would be allowed to use his property as rental
property, under a R-1 zone. Commissioner Reber stated that he could
apply for a rental license and rent up to three (3) persons. Mr.
Graeve stated that he owns 1.07 acres of land and has considered
dividing his property for multi family. The Commission informed Mr.
Graeve that he would need to re-zone his property to R-2 or R-3
depending on the type of rental unit. However, since the hearing
notice read that the property was being considered as R-1, a new
hearing would have to be conducted before such a change could be
recommended. Their being no objections, Nierengarten made a motion to
recommend the City Council to re-zone parcel 17 from the current
agriculture to R-1, Single Family. The motion was seconded by
Kalinowski.

Parcel 18, owned by the Convent/College of St. Benedict. Their being
no objections, Hiemenz made a motion to recommend the Council re-zone
parcel 18, from the current agriculture to E & E, Educational and
Ecclesiastical. The motion was seconded by Nierengarten.

Chair Klein closed the hearing at 8:50 p.m.
The City Attorney has drafted an amendment to Ordinance 52.14 subd 4,
which would re-zone property at the time of annexation. Hiemenz made a
motion to recommend Council approval of the Amendment to Ordinance
52.14, subd 4. The motion was seconded by Reber.

Election of Officers
Position of Chair
Kalinowski commended Hub Klein for the past year as Chair, and
recommended that he be re-appointed as chair in 1993. The motion was
seconded by Reber.

Position of Vice Chair
Reber thanked Sr. Kathleen for serving as Vice Chair during the past

Renewal of Terms
Kalinowski made a motion to recommend the re-appointment of Dan

Vacancies on the Commission
With Commissioner Reber being elected as Mayor of St. Joseph, and
Commissioner Hiemenz being elected as Councilor of St. Joseph, two
vacancies exist. The City Clerk's Office has already received five (5)
names of people who have expressed interest. The Commission requested
the Clerk's Office to send a letter to all interested persons who wish
to serve on the Planning Commission, asking for a brief biographical
sketch and a statement as to how they will be an asset to the
Commission.
