Pursuant to due call and notice, the Planning Commission for the City
of St. Joseph met in regular session on Monday, June 1, 1992 at 7:30
p.m. in the St. Joseph City Hall.
Members Present: Chair Hub Klein. Members of the Commission Ken
Hiemenz, Sr. Kathleen Kalinowski, Linda Sniezek, Dan Nierengarten, Kurt
Schnieder, Donald "Bud" Reber. Judy Weyrens, Secretary of the Board.
Others Present: Council Liaison Stephanie Hazen, Joe Hanson, Robin
Hanson, Dave Pfannenstein, Caroline Schriml, Bill Elfering, Steve
Dehler, Robert Loso, Don Hanson, Duane Ohman, Dan Schmitz, Kevin Donnay
OLD BUSINESS
Caroline Schriml - Lot Split: Dave Pfannenstein, representing Caroline
Schriml appeared before the Commission to present a revised proposal
for splitting the property owned by Caroline Schriml. The revision was
requested by the City Council at the May 7, 1992 City Council Meeting
in an effort to create two lots that were equal in size. The revision
would leave the property owned by Caroline Schriml a total of 9,339
square feet (Parcel A), and the property to the East 10,480 square feet
(Parcel B). After discussion, Reber made a motion to recommend
Council approval of the one thousand six hundred sixty one foot
variance request to split the property owned by Caroline Schriml, based
on the following findings:
Section 52.7 subd 2 ~~ - That there are exceptional or extra-
ordinary circumstances or conditions applying to the property in
question as to the intended use of the property that do not apply
generally to other properties in the same zoning district. The
exceptional or extraordinary circumstances must not be the result
of actions taken by the petitioner. The extraordinary
circumstances are:
The adjoining neighbor does not have enough square footage to
construct a garage and would be purchasing the parcel to add to
his current property.
Also, approval is recommended provided the property is only sold to the
adjoining land owner, to the East, Mr. Joseph Hanson, for the sole
purpose of constructing a garage.
The legal descriptions of the new parcels will be as follows:
Parcel A: Lots 1 and 2, Less the east 45.00 feet thereof, Block 2,
Loso's Subdivision of Block 2 of Loso's First Addition to the Village
of St. Joseph, according to the plat and survey thereof, on file and of
record in the office of the County Recorder in and for Stearns County,
Minnesota.
Parcel B: The east 45.00 feet of Lots 1 and 2, Block 2, Loso's
Subdivision of Block 2 of Loso's First Addition to the Village of St.

Joseph, according to the plat and survey thereof, on file and of record
in the office of the County Recorder in and for Stearns County,
Minnesota. Said Lots being conveyed for the purpose of attachment to a
contiguous lot, to wit: Lot 1, Block 3, of Loso's Second Addition to
St. Joseph according to the plat and survey thereof, on file and of
record in the office of the County Recorder in and for Stearns County,
Minnesota, and which said lots hereafter shall not be considered a
separate tract, lot, parcel or subdivision of land for purposes of
conveyance, but rather a part of the lot to which it is being attached.
The motion was seconded by Nierengarten.
Ayes: Klein, Hiemenz, Kalinowski, Sniezek, Nierengarten, Reber,
Schneider.
Nayes: None. Motion Carried 7:0:0
Ted Klein - Variance Request: The Commission discussed the previous
recommendation to the Council approving the re-zoning and variance
request of Ted Klein to construct an additional rental unit. The
property is located on Old Highway 52.
Bill Elfering spoke on behalf of the residents along Cypress Drive.
The residents feel that the area is too dense to allow another rental
unit in the already over saturated area. Additionally, they feel that
their homes are being devalued by the rental units and the property
owners make promises to the Council to obtain variances, but one they
receive the variance they do not follow through with their promises.
The neighborhood no longer has a safe feeling. Enforcement is another
problem that needs to be addressed -- to control parties, noise,
parking and the number of students that are living in the units.
Commissioner Reber stated that the City has established the total
number of students for which a rental house can be licensed for, but we
have no control over guests that are allowed to stay.
Commissioner Kalinowski empathized with the residents, but stated that
the Planning Cor~nission must determine from a planning aspect whether
or not the proposed rental unit is appropriate in terms of the
comprehensive plan.
Steve Dehler questioned whether the Planning Commission has considered
placing more restrictions on the variance, such as requiring additional
parking, sodding and curbing the front yard, or more stringent leases.
The Planning Commission was in general agreement that Ted Klein had
presented a plan that would provide ample parking. With this in mind,
Hiemenz made a motion re-affirming the action at the May 4, 1992
Planning Commission Meeting, at which time they recommended Council
approval of the Re-zoning and Variance request of Ted Klein. The
stipulations to the variance shall be as follows:

Before a rental license is issued to the property, the areas
designated as a parking lot will be black topped and stripped.
Each parking stall will be nine (9) feet, and ten (10) will be
provided.
Conditions of the Variance issued to Mr. Klein previously will
also be enforced and completed before issuance of the rental
license.
The motion was seconded by Kalinowski.
Ayes: Klein, Hiemenz, Kalinowski, Sniezek, Nierengarten, Reber,
Schneider.

Steve Dehler = Lot Split: Steve Dehler appeared before the Commission
requesting approval to split a portion of his property located on
Minnesota Street East. The property to be split is the Old Linnemann
house. The reason for the split is due to the recent sale of the
property. Since the property is located in the General Business Zone,
Mr. Dehler does not need to conform to a minimum lot size.
Kalinowski made a motion to recommend Council approval of the lot split
as requested by Steve Dehler. The legal descriptions are as follows:
Tract A: The North half of Lot 7 of Block 9 of the Original Town of St.
Joseph, Stearns County, Minnesota, Less and except the east 10.0 feet
thereof.
Tract B: The East 10.0 feet of Lot 7 and all of Lot 8 less and except
the east 2.00 feet thereof, of Block 9 of the Original Town of St.
Joseph, Stearns County, Minnesota.
Tract C: The South Half of Lot 7 of Block 9 of the Original Town of St.
Joseph, Stearns County, Minnesota. Less and except the East 10.0 feet
thereof.
The motion was seconded by Reber.
Ayes: Klein, Hiemenz, Kalinowski, Sniezek, Nierengarten, Reber,
Schneider.
Nayes: None. Motion Carried 7:0:0
Kevin Donnay = S ace Needs: Kevin Donnay, SEH, introduced himself to
the Planning Commission and stated his purpose. He has been authorized
by the City Council to start a space evaluation needs study. Mr.
Donnay presented a map illustrating possible sights for a new City
Complex and asked for their opinion. As the study progresses, they
will receive more information.

correction; seconded by Sniezek.

Meeting with Fred Sandal: To continue the updating of the
Comprehensive Plan, Fred Sandal is requesting the Planning Commission
schedule a special meeting in June to continue the discussion. The
Commission established June 22, 1992 as a special meeting of the
Planning Commission.
The meeting was adjourned at 9:30 p.m.
