J(riFi'H Council Agenda Item 4 e MEETING DATE: AGENDA ITEM: May 21, 2009 Outdoor Liquor Permit -Requested Action: Authorize the Mayor and Administrator to execute the outdoor license for the Stonehouse Tavern for an event to be held on October 3, 2009. SUBMITTED BY: Administration /Police BOARD/COMMISSION/COMMITTEE RECOMMENDATION: BACKGROUND INFORMATION: The City Ordinance includes a provision for liquor license holders to conduct outside events. If the event ends at 9:30 or earlier, the license holder can make application for an outdoor event. The license must be approved by the Council and event impacts such a noise, security and debris must be addressed in a mitigation plan. This is different that the permit that extends beyond 9:30 as a public hearing is required. The Police Chief has met with the property owner who has submitted an event plan that is very thorough. Based on review the plan meets the City requirements and has been placed on the consent agenda as has been past practice. Storehouse Tavern & Eatery plans to hold an Oktoberfest Event on ~~ ~~ After discussions with Chief Peter Jatasky, St. Joseph Police Department and Judy Weyrens, St. Joseph City Cleric, the xnauaget of the Storehouse Tavecri & Eatery would like to address these va7rious issues. 1. x.oeatadn of tLe Event The event will take place in the parlsang lot of the Storehouse Tavern & Eatery utilizing the Eastern end of the parking lot. A double fence will eneiurcle the area where food and beverages will be served which will take place in a large tent located within the parat~aeters of the fenced area. 2. Live E~atextai>araent -Which will be both a traditional "vo:oapa/polka" band in the early afternoon and a country music band in the cvcniilg will be located om the east side of the building facing away from the residential areas of St. Joseph towards the eointnercial area between St. Joseph and Waite Pazk. 3. Rules & Regalations -In accordance with the rules and regulations of the vrdimancxs of the City of St. Joseph the music will end completely at 9:30 p.m., at which time any patrons remaining have the option of either leaving or heading inside the restaurant facility. After discussions with Chief Jansky, he has agreed to work with the management to provide law enforcement personnel to assist with maintaining security at the event and overall compliance with the local and state liquor regulations. Additionally our bar staff will be from the restaurant, and we do not anticipate hiring any outside sources. We have passed our compliance checks and don't foresee any problems with respect to those issues. The double fencing will also ensure that liquor, beer, and other alcoholic beverages cannot be passed outside of enclosed area. Stonehouse Tavern &. Eatery has an offsite liquor-catering license in compliance with the state and local regulations. The majority of the food sales will take place inside of the tent azea, aside from an outdoor grill that we will have in place to prepare sausages, hamburgers, etc, We have also determined that no beverages will be dispensed in glass containers and have discussed the appropriate receptacles for controlling our trash situation. Sanitary issues located within the fenced-in area and the farthest end of the parking lot we will have several ports potties with hand sanitizez available fez the patrons to use. The interior of the restaurant with also be open for additional access to toilet facilities, i~eluding any persons that are handicap or cannot ~safcly use an outdoor toilet. Noise Abatement Far the purposes of noise abatement it has been determined that the music will face away from the residential area of St. Joseph. Additionally we are engaging a country music band and working with Wild County through Leighton Broadcasting to advertise the event and to find suitable entertainment. It is the intent of the owners and management of the Stonehouse Tavern & Eatery that we establish Oktoberfest as a yearly event and wish to have no significant issues whatsoever with respect to those problems that are generally associated with outside events. As a side note I would like to remind the council that the noise problem that occurred under the previous ~oaanagement was beyond the control or even within the notice of current owner/operators of the Stonehouse Tavern & Eatery. Parking We will maintain at least half of the parking lot for the purposes of patron parking. We have also approached representatives of the Armed Services Equipment Depot directly adjacent to the east of the Stonehouse. They have a large open grass area and it has been our request that we receive the appropriate permission to park cars in that area. In the event that we do, we will have staff specifically for the purposes of maintaining a safe and organized ingress/egress to that additional parking area. We also plan to approach the owners of the Trobeck/Delwin Center has agreed to allow us to use his parking lot for patron parkiulg.
