CHAPTER VII -LIQUOR, BEER & WINE c) Proof of liability insurance as required by this ordinance shall be delivered to the City Clerk/Administrator prior to issuance of the license. d) The maximum number of "special event" licenses which may be issued to an entity or organization in a single calendar year is three. e) The permit fee fora "special event" license shall be $10.00 for atwenty-four hour period. ' Subd. 5: Any person issued an "on-sale" nonintoxicating liquor license pursuant to Section 7.2.2, Subd. 2, of this Ordinance, may also engage in the sale of intoxicating malt liquor at on-sale without an additional license if the licensee meets the following conditions: a) The licensee also holds a wine license issued pursuant to Section 73.02, et seq. of this Code. b) The gross receipts of the licensee's operation are at least 70 percent attributable to the sale of food. The licensee shall provide the City with copies of licensee's financial records upon reasonable request for the purpose of establishing the source of gross receipts. c) The licensee maintains in effect the liability insurance required under Section 71.03, Subd. 3. . ~ d) The licensee shall pay a license surcharge in an amount that when added to the `~c%~ U license fee for on-sale 3.2 percent malt liquor established by Section 72.04 and on-sale wine established by Section 73.04, equals 50 percent of the annual on-sale intoxicating liquor license fee established pursuant to Section 71.04. Subd. 6: A restaurant club, bowling alley, or hotel which holds an on-sale or special events license may sell 3.2 percent malt liquor for consumption on the premises in conjunction with the sale of food after the hour of 10:00 a.m. on Sundays. An establishment serving 3.2 percent malt liquor on Sundays must obtain a Sunday license. Any establishment requesting a Sunday license must show that they are in conformance with the Minnesota Clean Air Act. A license may be issued by the governing body of the municipality and a fee as established by resolution of the City Council maybe charged, but in no event shall said fee exceed the sum of $5.00 for a special event license or $25.00 for the on-sale license unless otherwise prohibited by State law. Section 72.03: APPLICATIONS FOR LICENSE Subd. 1: Every application for a license to sell beer shall be made on a form supplied by the City and shall state the name of the applicant, his age, representations as to his character with such references as maybe required, his citizenship, whether the application is for "on-sale", "off- sale", or "special event", the business in connection with which the proposed license will operate 72-2
