BOARD/COMMISSION/COMMITTEE RECOMMENDATION: The Planning Commission
recommended the Council approve the preliminary and final plat entitled Benedict. The plat was for
administrative purposes only, re-establishing legal descriptions. Development rights are not conveyed.
PREVIOUS COUNCIL ACTION:
BACKGROUND INFORMATION: See the Planning Commission information. As you can see from the
enclosed information, the purpose of the plat is to clarify legal descriptions. The property is platted in
outlots where the property is not developed and lot and blocks where buildings exist. The Ordinance
does not allow construction on outlots, therefore, if the property is to be developed in the future, the
outlots will have to be replatted. The Staff has been working with CSB for a number of months on this
plat. The current legal descriptions are difficult to determine. The Stearns County Surveyor has
facilitated the platting as well.
BUDGET/FISCAL IMPACT: None.

Preliminary Plat -Benedict Plat: Kalinowski stepped down from her chair due to a conflict of interest.
Weyrens stated that, after the last meeting, there were three outstanding issues:
1. Legal Counsel for the St. Joseph Parish had not reviewed the plat and stated that the Parish
could neither support nor oppose the plat until they had time to review such. Since the Parish is a
signing party to the plat, they would need to approve.
According to Weyrens, the City has now received a letter of support from the Parish.
2. Bernie Schloemer questioned the hearing process, in particular the legal description used for the
hearing notice.
Weyrens spoke with the Attorney and clarified that the proper people were notified of the public
hearing regarding the preliminary plat.
3. The Commission questioned the process for approval for the portion of the plat that lies in the
Township.
Weyrens added that Stearns County Environmental Services and the Joint Planning Board will
meet to approve this plat. The final plat will be signed by both the City and the Township.
S. Kara Hennes approached the Commissioners on behalf of the Monastery. She stated that when this
process started, the goal was to transfer some land between the College and the Monastery because
some of the college buildings are on Monastery property. To continue with the land transfer, they needed
to plat the property. She added that many of their boundaries are shared with the Parish and those were
brought in to the plat as well. It also includes a small portion of the Pfannenstein property near I-94 and
the land purchased from Anita Walz.
Deutz asked the Commissioners for their comments
Vern Bartz, SEH, also addressed the Commissioners. He stated that the plat incorporates the entire
College campus west of CR121. Meyer stated his concern with the number of outlots on the plat, as they
are generally more definitive. He also added his concern with the number of variances that are going to
be required. Bartz stated that they split the property into outlots as it will need to be split between the area
in the City and that in the Township. When the process was started, he stated that they were under the
impression that the property could be annexed into the City. With reference to the numerous outlots,
Deutz questioned whether or not this has been laid out for development. Bartz re-stated that the purpose
is to straighten out land lines and address gaps and overlaps. Although a portion of this could be
developed as commercial in the future, right now there is no intent to develop.
Wick stated that he had no questions; however, this plat is different as it is platted as outlots. He was
curious about the variances required. Weyrens stated that the City doesn't allow buildings on outlots. She
added that this is more administrative in nature as the current legal descriptions are a nightmare. Platting
it as outlots is the best method to now allow development. Wick questioned whether the taxes will be
different for outlots. Meyer stated that he sees a definite possibility for development. Bartz restated that
this plat is not for development rather to clarify property lines.
Sabart added that he has seen other plats with multiple outlots. The Parkway Business Center is one
example. According to Sabart, it is not uncommon to designate the property as outlots if the property
owner is not clear about the future use of the property. In previous discussions with staff, he stated that
Lot 4 Block 1 is intended as a future advance to the College for a parking lot. He added that there may be
a future development, but there are no definite plans.
McDonald questioned the annexation of the entire property. Weyrens stated that there has been some
dispute between the City and the Township. She added that the City can pursue this annexation request
and then the entire Benedict Plat would be within the City. They have previously talked about the Orderly

Annexation. The Township is not taking any initiative to approve this plat. Bartz stated that the fact that it
is not being annexed has caused them problems as well. They do not care either way. The Joint Planning
Board will meet to discuss the preliminary plat request.
Deutz questioned the delineation of the wetlands. Bartz stated that they have the information on the plat
and they will have the wetlands marked once the plat is approved.
Weyrens reminded the Commissioners that the Public Hearing was opened and closed at the last
meeting.
Meyer made a motion to recommend Council approval of the Preliminary Plat entitled Benedict for
administrative purposes, conveying no development rights. The motion was seconded by Deutz.

Public Hearine - Preliminary Plat- Benedict: Acting Chair Rieke called the hearing to order and stated that the
purpose of the hearing is to consider a preliminary plat entitled Benedict. The Benedict Plat includes property
owned by the College of St. Benedict, Monastery of St. Benedict and Church of St. Joseph. The purpose of the plat
is to re-establish legal description and correct property discrepancies. Development rights are not being conveyed
with the Benedict Plat.
The proposed plat was submitted by the Monastery of St. Benedict, 104 Chapel Lane.
Weyrens stated that the staff has been working with the College/Monastery of St. Benedict on the plat that has
been entitled Benedict. The legal descriptions for the College/Monastery are metes and bounds and it is difficult
to determine lot lines. Therefore, the Monastery/College have developed a plat to re-establish lot lines. During
the platting process the Monastery/College met setback requirements where possible and access has been
provided to all lots and outlots. In addition, the St. Joseph Parish Cemetery abuts the Monastery/College and that
property has been included in the plat as well. Weyrens clarified that a portion of the proposed plat is located in
St. Joseph Township and they will be acting on that portion.
Sr. Kara Hennes approached the Commissioners representing the Monastery. She stated that Vern Bartz and Mark
Downing of SEH were also present. They are seeking approval to plat the property as described. In the process, she
stated that some parcels will be transferred to the College. She added that they found several gaps that have
existed for a long time. They are looking to plat the Monastery area south of County Road 2 and West of College
Avenue along with the main college buildings west of College Avenue and the non-taxable land on the property.
The property is made up of agricultural land to the west, woods to the south, the 7.2 acres of land purchased from
Anita Waltz-Harris and the 5 acres previously owned by Richard and Helen Kuebelbeck. The proposed plat is
approximately 140 acres which is made up of mainly woodlands and wetlands. This is an attempt to
administratively clean up the ownership issues for this property.
Vern Bartz, SEH, approached the Commissioners on behalf of the Sisters. He stated that they also clarified the
boundaries for the College Properties. There are three owners involved and recently there has been a quit claim
deed recorded between the Sisters and the Church of St. Joseph. He added that some of the lot lines are very close
to some of the grave sites. The Church of St. Joseph is platted as Outlot A. This plat will be reviewed by the College
and the Monastery and any corrections will be made. The purpose of the plat is to clean up overlaps, gaps and
clarify legal descriptions. This will be beneficial for the County when referring to legal descriptions. The Plat will
have all properties described as a Lot or an Outlot. Bartz stated that they have already been to St. Joseph Township
for approval of the Plat. Once the final plat is approved, the wetlands will be staked. Since this property abuts
Interstate 94 right-of-way, the plat will be sent to the State of Minnesota for approval as well. He added that there
are some property issues that will be addressed and cleared up prior to a final plat.
Bartz stated that the platting process is not for the purpose of development, rather lot line clarification. However,
the lots have been established looking at future uses for the property. For example the property located adjacent
to County Road 2 is suitable for commercial and at some point the Monastery may decide to sell that portion.
Bartz reiterated that the only purpose of the plan is to re-establish the lot lines.
Along County Road 2, they will be dedicating a 40' strip on their side for road right-of-way. They will also dedicate
some of their property along County Road 121 as road right-of-way. Most of the property is platted as Outlots and
they would not be able to develop it until it is re-platted. They have shown various ingress and egresses to each
Outlot as they need to have access to each lot. All required easements will be included on the plat.
Rieke asked Mr. Bartz for a disclosure statement to clarify that they are working for the Sisters and not the City as
there may be some confusion due to the fact that SEH is also the engineer for the City. Bartz stated that he is from
the surveying department at SEH and he has done work for the Sisters for a long time and he has a lot of
knowledge of this property.
Rieke opened the Public Hearing.

Benedict Plat
Bernard Schloemer, 701 Hill Street W, approached the Commissioners with procedural questions relating to the
proposed plat. He questioned whether they are requesting to plat the entire area shown on the legal notice that
was printed in the paper. Weyrens stated they are. He then questioned whether adjoining property owners are to
be notified of such hearings. Weyrens stated that the City is required to send notice to property owners within 350
feet of a subject property. The proposed plat illustration includes property located in St. Joseph Township but the
City is not considering action on that portion of the plat. The legal description that was used was that given to the
City by the engineer for the Monastery of St. Benedict. Rieke stated that, in the past, the City has re-done Public
Hearings with correct legal descriptions. Weyrens stated that she will check with legal and make any corrections if
necessary.
Gary Renick addressed the Commissioners as the attorney on behalf of the Church of St. Joseph. He stated that
they received the materials and they are being reviewed by the Church and their legal counsel. Currently, they are
not in a position to be in favor of or against the proposed plat. Meyer questioned Renick as to how long the legal
analysis will take to which he replied not more than 30 days.
Tim Borresch, 113rdAvenue NW, approached the Commissioners to share some concerns relating to the
College/Monastery property. He stated that he lives at the corner near the main entrance to St. Ben's. He is
concerned about the amount of traffic using that entrance. Borresch suggested that, prior to putting more people
on campus; they consider ingress and egress. Over time 3~d Avenue SW has become a major entrance to the
College and it was originally designed as an alley. Borresch expressed frustration with the amount of traffic the
neighborhood tolerates. Rieke stated that the purpose of the hearing is to consider a plat to establish lot lines, not
development of the property. Therefore traffic impacts are not considered as part of the process.
Schloemer approached the Commissioners for a second time with afollow-up question. He questioned whether it
was the Sisters' intent to plat the entire area shown on the hearing notice. He stated that it would be better to plat
the entire area at one time. Weyrens stated that the City is only conducting a hearing on the portion within the
City. Schloemer stated that it should all be dealt with at one time as the City and Township have a joint powers
agreement. Meyer advised Schloemer that the Planning Commission has a meeting with the Township in a few
weeks. Schloemer stated that this issue seems to be a little premature at this time. Meyer stated that this is an
ongoing process and they will be discussing such with the Township. Schloemer suggested that a Public Hearing be
held in conjunction with the Township.
The public hearing was closed at 7:45 PM
Weyrens questioned Renick whether or not the Church needs to verify legal descriptions prior to giving support.
Renick re-stated that the Church neither supports nor objects to the plat at this time as they need to first clarify
their legal descriptions. Meyer stated that this is a wise decision by the College and the Monastery to have the land
platted to re-establish lot lines. Based on questions by the Township, they need to bring the entire property into
the City so the process is streamlined.
Meyer made a motion to table the discussion of the preliminary plat until May 4, 2009 when a continuation
hearing will be held if necessary. The motion was seconded by McDonald.
Discussion: Weyrens stated that additional notices will be mailed if necessary. Meyer questioned whether
they already approached the Township. Bartz stated that they did address the Township and they were
under the understanding that the City was going to annex that property. They also met with the County
and they were advised by the County that the area would not be annexed at this time. They have given
them their approval for the plat once it is approved by the Council. Weyrens stated that it cannot go to the
Council for approval as there is one party that has some issues that need to be addressed. Rieke added
that the Joint Planning Board has not yei met to discuss this either.
The motion passed.

PREVIOUS PLANNING COMMISSION ACTION: The Planning Commission conducted the Preliminary
Plat hearing on April 6, 2009. During the meeting the following concerns were expressed:
1. Legal Counsel for the St. Joseph Parish had not reviewed the Plat and stated that the Parish
could neither support or oppose the plat until they had time to review such. Since the
Parish is a signing party to the plat, they would need to approve.

3. The Commission questioned the process for approval for the portion of the plat that lies in
the Township.
The matter was originally tabled to the May meeting of the Planning Commission, however, the St.
Joseph Parish had not responded, needing additional time.
BACKGROUND INFORMATION: Since the April 6, 2009 meeting, the City has received verification from
St. Joseph Parish that they support the plat and any concerns have been resolved. Included in your
packet is email correspondence I received from Sandy Scholz of the Parish.
With regard to the hearing notice, I have had an opportunity to discuss the legal description with the
City Engineer and City Attorney. The legal description did in fact include the entire plat, including the
portion located in St. Joseph Township. The City mailed notices to all property owners within 350 feet
of the boundaries of the plat, as required by State Law. As long as all property owners within that
distance are notified the requirement has been fulfilled.
With regard to the County process, I have had an opportunity to discuss the process with a
representative at Stearns County Environmental Services. St. Joseph Township did meet to review the
proposed plat. The plat will be required to go through a hearing process at the County and this should
require review by the joint planning board. This board would make a recommendation to the County for
approval.
The plat before the Planning Commission is ready for approval and the City Engineer will be at the
meeting to answer any questions that may arise.

the church has agreed to. If you are submitting the description to be used in the paper make sure you add "Less and
except that part lying within the St. Joseph Township limits" to the end of the description. This is important because the
plat boundary and description covers both city and township property and it will help clarify that the meeting is only for the
portion that is within the city limits.

SUMMARY OF COMPREHENSIVE PLANNING
FOR MONASTERY CAMPUS
This campus, this monastery land is dear to all of us. It is part of our spiritual
life and testifies to others who we are. We walk it and care for it just as our
foremothers did. This land is unique and sacred as land and sites are
sacred to indigenous peoples and institutions are to the sites they have
occupied since their inception.
In our visioning for the future, we see ourselves smaller but a vital part of this
land. We will welcome others who share a spirituality of the land and its
historic continuity. We want to provide a welcoming entrance into St. Joseph
that speaks of the values that these residents and the two religious
communities share; that open space is restful and healing, that green areas
along a large freeway invite travelers to slow down and stop to see more,
and that all can gain a greater appreciation of historic spaces that welcome
the new while tending the old.
Our monastery has a long history of land planning. As Benedictines, we let
go of land that we do not use or need. (Attachment A) As we look into the
future, we know that we need the land that we currently have. These needs
have been incorporated into our comprehensive planning in the past and will
be as we move forward in visioning the future. This summary provides a
review of the planning efforts of our recent past, the current proposals and
the Visioning for Hospitality and Outreach as we plan for our future.

Background
Previous Campus Studies
1. Joint Campus Master Plan by Dahlgren, Shardlow, and Uban, Inc., recommended a
revision of the northwest entrance into campus. The original plan called for a drive from
that entrance near the current Dehler House that would direct monastery traffic along a
mall toward the Chapel.
2. The Comprehensive Facilities Plan by Yeater, Hennings, Rokke Architects/Planners built
on the Shardlow Study by incorporating a monastery drive from the northwest entrance
along a mall toward the Chapel.
3. The Monastery Site and Facilities Planning Task Team developed and helped to
implement the changes that enhance our current monastery entrance near the Guest
House.
Other Studies that Impact the Campus Planning
1. The Chapter adopted a Community Position Statement and Guiding Principles for our
Corporate Ownership of Land in 1990. (Attachment B) This statement continues to guide

2. The Woodland Stewardship Plan grew out of recommendations from a Department of
Natural Resources Study in 1995. The current Woodland Stewardship Plan was updated
in 2007 and guides our stewardship decisions for the woods.
Current Campus Studies
1. The College and Monastery Joint Master Planning process is guided by the Joint Planning
Advisory Committee (JPAC). The group focuses on areas of joint policies that guide
shared services, programs, facilities and land. This group also guides interactions with
legal resources and city and county governments on joint concerns. Recent concerns
include the Collector Road, City Comprehensive Plan and assessments for city services.
The JPAC developed priorities for joint land planning. We both agreed to have land areas
appraised where the monastery owns the land and the college uses it.
2. Monastery Comprehensive Plan guides current budgeting and internal planning projects.
The current visioning process will give direction to future actions included in the
comprehensive plan.
3. The monastery's Leadership Team met with the master planner for the college to
incorporate our plans and needs into the new plan. The master planner incorporated
input from the Joint Planning Advisory Committee, the Shardow Study and the Collector
Road Studies.
Current Proposals on Monastery and College Shared Sites
1. From 2002-2004 the JPAC studied the demographics of the student and sister
populations, assessed the shared services, shared sites, and shared facilities. From this
joint study they developed assumptions about the future.
2. In 2004 the JPAC developed a list of potential property exchanges, had a formal
appraisal done on the land areas of Power Plant, Brian Hall, CSB Maintenance Garage,
Parking Lots I and II, Soccer Field, Jeanette House and Linneman Woods. This
information was discussed in area meetings of the Sisters in 2004 and 2005 and at the
Sisters' August Chapter meeting in 2005. Jeanette House and Linneman Woods were
dropped from the list of potential properly exchanges.

Saint ~enedict's Monastery

The Sisters of Saint Benedict were founded in 1857 by four young
Benedictine Sisters and two candidates who came from Eichstatt,
Bavaria, to teach children of European settlers and to establish a
Benedictine community on the frontier. At the invitation of the
people of St. Joseph in 1863, the Sisters moved from St. Cloud to
this frontier town where they established routs and built their
monastery. At present, St. Benedict's Monastery is home to 290
Sisters.
Over time, the Benedictine monastic community has divested or
contributed land to respond to the needs of the local community.
This land has been used for community enrichment
• 68 acres sold to the City of St. Joseph for Park Terrace,
Millstream and Klinefelter parks.
It has also been sold to respond to keep pace with the city's growth
for city services
• 24 acres sold to City of St. Joseph for storm drainage.
Today, the Sisters have about 300 acres in St. Joseph. Taxes are
paid on 50% of the acres.
• 100 acres of natural woods with walking trails to enjoy
wildlife
• 8 acres of tall grass prairie with pond and wetland
• 7 acres of prairie restoration along the freeway
• 84 acres leased to local farmers who practice sustainable
farming
• 3 acres for a community sustained garden called Common
Ground
• 5 acres of oak savannah and short grass prairie
• 90 acres for the main monastery buildings and their land
