RE: Public Hearing on Payable 2009 Proposed Budget and Tax Levy
During the 2009 legislative session changes were made to Statute 275.065, subdivision 6 regarding
requirements of a public hearing for the adoption of the budget and levy. Outlined below are the
changes:
• It is no longer required to have a separate truth-in-taxation hearing.
• The hearing can take place at a regularly scheduled meeting after November 24 and before
December 27.
• The public must have the opportunity to speak and the meeting must not be held before 6:00
p.m.
• The truth-in-taxation notice that is retained must identify the date of a regularly scheduled
meeting after November 24 and before December 27 where the budget and levy will be
discussed.
• There is no required newspaper advertisement of the hearing.
• There is no required coordination between counties, cities and school districts, so hearings
can overlap.
• Eliminates the exception to the TNT notice of the hearing requirement for cities under 500.
However, the department will continue to administer the law as if such an exception exists.
No notice of hearings is required of cities under 500 and thus no notice of the date and time
need to be included on the TNT notice.
Please advise me in writing by September 15, 2009 of the date, time and location of the
public hearing. If you have any questions or concerns please contact Jerry Roering, in

Your final levy may be adopted during your next regular scheduled Council Meeting.
However, it must be certified to the County Auditor by December 28, 2009.
Under current law, each City with a population over 500 is required to certify the date, time
and location of the public hearing, on their preliminary budget and tax levy for taxes
payable in 2009 to the County Auditor on or before September 15, 2009.
