STAFF RECOMMENDATION:
PREVIOUS PLANNING COMMISSION ACTION: On August 3, 2009 the Planning Commission considered
the annual review for Interim use Permit to allow for owner occupied rental in R1 Zoning Districts and
non owner occupied rental in the B2 Zoning District. At that time the City did not have complete
applications for Ryan Lieser and Thomas Ortman. They have since submitted completed applications.
BACKGROUND INFORMATION: Ryan Lieser owns the property at 401-1St Avenue NE. When he made
application for an Interim Use Permit the Ordinance did not allow for non owner occupied rentals. Since
that time the Ordinance has been amended and they are allowed by Interim Use Permit as a transitional
use.
In discussing the situation with the City Attorney the Planning Commission could allow the permit to be
transferred to a non owner occupied rental for the current period and then at the renewal time in 2010,
he could make application for a new Interim Use Permit as other properties in that area. The properties
along College Avenue have an expiration date of 2010 with the option of a three year renewal. This
would provide for consistent expiration dates. At this time Lieser is still residing at the residence.
The other application in the packet is for Thomas Ortman who had not provided all the information for
the last meeting.

Dear SL Joseph City Council,
My name is Ryan Lieser, owner of the property located at 403 ls` Ave NE in St.
Joseph. I have been renting my property as an owner-occupied interim permit use for the
last 3 years. It has been brought to my attention that my property is located in an area that
is under re-zoning which will allow me to apply for anon-owner occupied rental license
during this transformation. In the past few years I have put in a 2 car parking spot and
had the house re-wired to run off circuit breakers so it was up to code with the rental
guidelines. With where my property is located, I am currently surrounded by commercial
property. I think it is only an advantage for me and the community of St. Joseph that I be
granted an acceptance to use the property as a permanent rental. I am under the
assumption that if I were to be granted acceptance, my property will be re-zoned to
commercial. It seems only logical that this property be used for such purposes in the
future as well. It will be next to impossible to sell the house as a residential property due
to the location but is an ideal location for commercial usage. If you have any questions
