BOARD/COMMISSION/COMMITTEE RECOMMENDATION: On September 3, 2009 the Planning
Commission considered the Interim Use Permit renewal for Ryan Lieser and unanimously recommended
renewal.
PREVIOUS COUNCIL ACTION: Ryan Lieser was granted an Interim Use Permit in 2006 for an owner
occupied rental in a B2 Zoning District.
BACKGROUND INFORMATION: Since the initial issuance in 2006, the 62 Zoning Ordinance has been
amended to allow non owner occupied rental by issuance of an Interim Use permit. While Ryan Lieser
still resides at the property located at 403 -1St Avenue NE, he would like to change the status of his
license to non-owner occupied.
Within one block of his property, two property owners have already secured non owner occupied
Interim Use Permits with the first expiration of 2010. The Planning Commission renewed the Interim
Use Permit for Ryan Lieser with the understanding that during the current license period he may convert
the property to non owner occupied. In addition, when the two licenses in the neighborhood expire, at
that time the notice will include the conversion of his property.

Dear St. Joseph City Council,
My name is Ryan Lieser, owner of the property located at 403 I S` Ave NE in St.
Joseph. I have been renting my property as an owner-occupied interim permit use for the
last 3 years. It has been brought to my attention that my property is located in an area that
is under re-zoning which will allow me to apply for anon-owner occupied rental license
during this transformation. In the past few years I have put in a 2 car parking spot and
had the house re-wired to run off circuit breakers so it was up to code with the rental
guidelines. With where my property is located, I am currently surrounded by commercial
property. I think it is only an advantage forme and the community of St. Joseph that I be
granted an acceptance to use the property as a permanent rental. I am under the
assumption that if I were to be granted acceptance, my property will be re-zoned to
commercial. It seems only logical that this property be used for such purposes in the
future as well. It will be next to impossible to sell the house as a residential property due
to the location but is an ideal location for commercial usage. If you have any questions
