JUSFYH JOINT PLANNING COMMISSION MEETING DATE: October 13, 2009 AGENDA ITEM: Louis Merkling -Request for Administrative Lot Split BACKGROUND INFORMATION: The Orderly Annexation Agreements includes the following provision: 8. Joint Planning Committee: Any issue that would normally come before the Planning Commission of either the City or Town that involves land within the boundaries of the orderly annexation area described in Section One prior to annexation will be heard by a Joint Planning Commission. Membership of this Joint Planning Committee shall be as follows: A. Three (3) members from the City Planning Commission [S. Kathleen Kalinowski, Ross Rieke, John Meyer] B. Three (3) members from the Town Planning Commission [Brenda Stanger, Ralph Eiynck, Doug Fredrickson) C. The City Member of the Orderly Annexation District Planning and Zoning Authority [AI Rassier] D. The Town Member of the Orderly Annexation District Planning and Zoning Authority [Jerome SalzerJ. The posting and publishing of meetings for the Joint Planning Commission, as well as the taking of minutes for their hearings shall be the responsibility of the Town Clerk. The property owned by Louis Merkling is included in the Orderly Annexation area, located north of CR 75 and east of CR 2, adjacent to the Northland Subdivision. The property owned by Louis Merkling is a property that will have an impact from the north east/west corridor. For your convenience I have had prepared for you a map that takes the survey presented by Merkling overlaid with the Transportation Plans of the City. As you can see the three alternatives for the Corridor do have an impact on this property. In an effort to get a better understanding of status of the North east/west corridor study, I asked the consultant working on the study, SRF -Brett Danner, to provide a summary on the status. I have included his correspondence in this packet. The corridor is a long way from completion or even construction. At this time the City/Township only have three alternatives and after it is narrowed to one, then additional environmental work must be completed. If the corridor was already selected and the official map was adopted, then the location of the road would be more crucial. It appears that the request for the lot split it is divide the homestead to a separate track so that a family member can purchase that portion. Therefore, the split is administrative at the County Level and contains only approximately two acres. The property owned by Merkling is in Planning District three of the St. Joseph Comprehensive Plan. Proposed future land use for this district include a statement that it is an area of change as the land uses will be determined by the location of the North east/west corridor. Development along the Corridor will be more intense tiered back to residential. ATTACHMENTS: Survey of area to be considered; Survey with transportation overlay; update from SRF on North Corridor Study; Section of St. Joseph Comprehensive Plan; Proposed Recommendation REQUESTED ACTION: The Commission should be a formal recommendation to Stearns County. I have attached a proposed recommendation form that can be used. I thought it might be helpful to create a format for the process and will not be offended if the Commission chooses a different format.
