Jc~ahPH MEETING DATE: AGENDA ITEM: SUBMITTED BY: Council Agenda Item ~~ November 19, 2009 Engineer Reports -16th Avenue SE Update Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: N/A PREVIOUS COUNCIL ACTION: The Council requested the City Engineer conduct a neighborhood meeting for resident abutting the 16th Avenue SE project to gather additional data. This meeting is being held on November 16, 2009 at 6:30 PM. BACKGROUND INFORMATION: The City Engineer will report on the neighborhood meeting. In the event the Council would like to move forward to the public hearing stage I have enclosed the appropriate resolution that needs to be adopted. The process for completing an improvement is statutory and includes a series of resolution. The public hearing does required public and mailed notice, so the soonest we could conduct the public hearing would be December 3, which is your next regular meeting. Another alternative is a special meeting on Wednesday, December 9. If the Council would like to move this project forward and have the design ready for early bidding we will need to start the process. If the City does move forward and the bids come insignificantly higher than anticipated the bids do not have to be awarded and we can review the project. BUDGET/FISCAL IMPACT: Tax Levy beginning in 2011, with a proposed project beginning in 2010. ATTACHMENTS: Notice to residents, email correspondence (Schirmers), Draft Resolution REQUESTED COUNCIL ACTION: The Council must decide if the project will move to the next stage, conducting a public improvement report to consider the making of improvements on 16th Avenue SE between Minnesota Street East and Dale Street East. November 9, 2009 Dear Resident: The St. Joseph City Council is considering an improvement to 16`h Avenue SE between Minnesota Street and Dale Street. The City Engineer has presented the City Council with a feasibility report which identifies the scope of work and projected project costs. A proposed assessment roll has not been prepared as the Council has yet to determine what percent of the project will be assessed. At this time the City Engineer would like to meet with the residents abutting the project area to gather additional data. A neighborhood meeting will be scheduled on: Monday, November 16, 2009 6:30 PM, St. Joseph City Hall The City Engineer will have a short presentation on the proposed project and the balance of evening will be spent gathering information that you as residents may have regarding current road and storm water conditions and concerns. Information gathered at this meeting will be provided to the City Council. If the Council decides to pursue reconstruction, apublic hearing will be scheduled and all affected property owners will be notified. The public hearing is when it will be determined if the project will move forward for construction in 2010. JOSEPH RESOLUTION 2009-026 RESOLUTION RECEIVING REPORT AND CALLING HEARING ON IMPROVEMENT 16th Avenue SE WHEREAS, pursuant to resolution of the Council adopted November 19, 2009, a report has been prepared by Randy Sabart of SEH with reference to the improvement of 16th Avenue SE Street between Minnesota Street East and Dale Street East by reconstructing bituminous street and constructing drainage improvements, and this report was received by the Council on November 19, 2009, and WHEREAS, the report provides information regarding whether the proposed project is necessary, cost-effective, and feasible, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA: 1. The Council will consider the improvement of such street in accordance with the report and the assessment of abutting property for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Chapter 429 at an estimated total cost of the improvement of $ 2. A public hearing shall be held on such proposed improvement on the day of 2009, in the council chamber of the city hall at 7:00 p.m. and the clerk shall give mailed and published notice of such hearing and improvement as required by law. Recently I received notification of a neighborhood meeting to discuss our road conditions and I have a few questions that I would like to have answered at that meeting. In regards to seal coating, how many times has 16th Avenue S.E./91St Avenue been sealed since the city annexed this area? When utilities were added, it was requested to the city engineer, Joe B., that seal coating be done because of the damage/strain put on it from heavy equipment. At the same time, 17th Avenue S.E. received a new top coat of tar, however 16th Avenue did not. Can you please provide some reasons as to why this did not occur? As you know, 16th Avenue S.E./91St Avenue is a posted five ton road. With increased properties, both commercial and residential over the last decade, has the city taken into consideration the amount of multiple refuge and semi trucks, as well as seasonal farm machinery, that utilize the road as a means of travel for pick-up and delivery on a daily basis? In the last two council meetings, Council Member Frank has commented to the city engineer of the damage done by refuge vehicles; is the city aware that all refuge and semi trucks, as well as farm machinery must use 16th to access 91St as it is the sole entrance, or feeder, to the township road? F~irthermore, being that the road is posted as 5 ton, these vehicles are utilizing the road. How many times has the City of Saint Joseph or County weighed vehicles/trucks in the last 10 years? If so, how many vehicles have been ticketed? Please know I am merely looking for some information as a concerned resident. I enjoy and appreciate our commercial neighbors, support our local farmers, and the economic welfare of Saint Joseph. I also realize the financial challenges that face the city and our neighborhood. I only ask that the City Council and City Engineer take the aforementioned questions and the answers to those questions into consideration when making their decision.
