BACKGROUND INFORMATION: The Orderly Annexation Agreement between the City of St.
Joseph and the Town of St. Joseph require action by the Joint Planning Board for all matters that would
normally come before the St. Joseph Township Planning Commission. The City and Township have
received a request for an administrative lot split. The lot split is being requested by Peter Rothfork and
the property is located west and adjacent to County Road 2.
As can be seen from the enclosed narrative from Attorney Scott Dymoke, the intent of the proposed
administrative lot split is to allow a land transaction to sell what is entitled Tract C on the Certificate of
Survey. Both Tract B and C are operating gravel pits that will remain as such. It is my understanding
that the mining will continue as has been in the past and will not be expanded. For your information I
have included the Mining Operation Registration that is filed with Stearns County.
The mining of the property was in existence before the passage of the Stearns County Mining Ordinance
(7.12). Accordingly, any such uses are grandfathered in per Stearns County Ordinance 7.12.1.c. The
Ordinance further states that the registration shall remain in effect and allow the operation to continue
as long as the operation remains in compliance with the minimum standards of the aforementioned
Ordinance. (See Attached).
In discussing the proposed lot split with Jennifer Buckentine of Stearns County, she stated that the City
and Township need to submit a jointly signed document (Resolution or Certificate) to the County before
the matter can be considered by Stearns County. During this discussion she also stated that Stearns
County will be conducting a public hearing to consider a Special Use Permit to allow an asphalt plant for
a four year period. The application is for both the south and north gravel pit. The MOU signed by the
City and Township does not require comments from the City and Township for Special Use Permits. She
indicated that if there are any comments they can be submitted at this time or at the public hearing. I
have included the correspondence from Jennifer in the packet.
Included in this packet is also a map illustrating the future transportation plans as it relates to the
Rothfork lot split request. As in the last request considered by this Board the future road plans that
impact this property are long range with no immediate plans to construct nor is the route finalized yet.
The other issue that the City staff discussed is that when the City extends sewer to the north utility
easements will need to be secured through the same property. Again, that is long term and we do not
have any immediate plans to construct.
The proposed lot split is located in Planning District 3 of the St. Joseph Comprehensive Plan (see
attached). Based on the Plan, this area is identified as an "area of change" with the future uses
dependent upon the location of major corridors. It is anticipated the district will consist of mixed
residential, commercial and industrial uses.
