BACKGROUND INFORMATION: In December 2009 the Joint Planning Board met to review an
administrative split for Rothfork. The purpose of the split was to allow for the sale of one of the gravel
pits. At that time the Board adopted a resolution that indicated if the mining is expanded the Joint
Board would again review the matter.
The Stearns County Planning Commission conducted a public hearing on an Interim Use Permit that
would allow the operation of an asphalt plant on the Rothfork site. In discussing the matter with Don
Adams of Stearns County, an asphalt plant is an intensification of use. Included in this packet is the
action of the Stearns Planning Board whereby they are recommending approval. The joint Planning
Board does have to make a recommendation on this matter and that will be forwarded for when the
Stearns County Commissioners consider the matter. It will be on their agenda for January 26, 2010.

Below are the conditions the Planning Commission recommended for the interim use permit. The County Board will
consider this at 9am on Tuesday, January 26th. Could you please let me know first thing Tuesday morning what the
discussion was at the Joint Planning Comm meeting?

1. The Planning Commission voted unanimously to recommend approval of the IUP request submitted by St.
Joseph Sand and Gravel, St. Joseph, MN for Melrose Associates and Rothfork Associates, Melrose, MN.
according to Sections 4.18, 7.25 and 9.3.6 E & F of Stearns County Land Use and Zoning Ordinance #209 to
operate a temporary asphalt plant for four (4) years. The property under consideration is part of the W1/2
SW1/4, Section 3 and part of the E1 /2 SE1 /4 Section 4, lying westerly of County Road 2, St. Joseph Township
(124/29).
A. Days and hours of operation shall be 6am to 8pm Monday — Friday, 8am to 2pm Saturday, and no
operation on Sundays or holidays.
B. The interim use permit shall expire on January 26, 2014.
C. Recycled asphalt pavement (RAP) and/or excess materials shall be removed upon completion of
operation.
D. A certified letter shall be sent to Stearns County Environmental Services notifying them when the
equipment is removed from the site.
E. The applicant shall submit a financial guarantee acceptable to the County, in the amount of $5000, to
ensure that the temporary equipment and RAP be removed upon termination of the interim use permit.
F. Truck hauling signs are required when hauling is occurring.
G. A sign is required at entrance(s) showing name(s) and telephone number(s) of property owner, site
operator and hauling contractor.
H. An approach permit is required from the County Highway Department for the change in use.
I. No more than one asphalt plant shall be located on the property at any given time.
J. Dust shall be controlled.
K. The applicant shall meet with the St. Joseph Township -City of St. Joseph Joint Planning Commission
for review of the requested permit.

SUBJECT: Administrative Lot Split for Property within OA -524.
MEETING DATE: December 21, 2009

REQUEST: Joint Planning Commission approval to submit an application to Stearns County
Environmental Services for an Administrative Plat, creating three parcels.
RECOMMENDATION: Approval of the administrative lot split as requested, (see attached survey)
based on the following findings.
FACTS/REASONS: The Joint Planning Commission has reviewed the proposed lot split as it relates
to the long range transportation of the City of St Joseph. In reviewing the long
range plans the following items were considered:
1. The City/Township of St. Joseph, Stearns County and APO are in the process of
completing a transportation study entitled the North east /west corridor study. This
study has significant impact to the property owned by Rothfork/Melrose Properties.
2. The North east /west corridor study is only in the environmental stages and a
preferred alternative has yet to be determined. Three different routes have been
identified and they are in the process of environment review.
1. The future land use plan for the subject area is designated an area of change and
identifies commercial, industrial and residential.
The Joint Planning Commission has reviewed the proposed lot split as it relates
to the existing land use and the Mining Registration issued by Stearns County.
1. It is the understanding of the Board that the property operates under a mining
registration and the use is allowed to continue under the conditions of the
existing permit. Additionally, a reclamation plan is part of the existing permit.
2. Based on the application, the property owner is not expanding the mining
operation and should the mining be expanded, the City and Township should
be consulted for a recommendation.
