J()ShPH Council Agenda Item 4(h) MEETING DATE: February 18, 2010 AGENDA ITEM: Quarterly Gambling Report — Requested Action: Accept the 4th Quarter Report SUBMITTED BY: Finance BOARD /COMMISSION /COMMITTEE RECOMMENDATION: None PREVIOUS COUNCIL ACTION: None BACKGROUND INFORMATION: Per City Ordinance No. 62 each organization conducting lawful gambling within the City of St. Joseph is required to submit copies of their monthly state tax returns to City Hall on a quarterly and annual basis. Per review of the tax returns it some organizations are sufficiently supporting the local community while others are not. Those that have not provided 10% gambling donations to the community typically provide donations in other quarters of the year. Examples of how the organizations are giving back to the community include the following items: Crime Prevention Training Counseling Services Kennedy Outreach Program GPS for Scouts July 4th Parade Vacation Bible School Defibulator Christmas Lighting LEAF Endowment Fund -ISD 742 Lab School Spring Spectacular Food Shelf Cookies Dollars For Scholars Boy Scouts Jamboree /Camp Supplies SJP Year -end Party Easter Party Boys State Funeral Services Flags Summer Recreation Apollo Grad Party CPR Training The Boxer's Club has not provided their quarter statements to City Hall since March 2009. The Finance Director has been in contact with them. The Boxer's Club has indicated they discontinued their gambling operations in St. Joseph in May 2009 due to very low gambling sales. They were asked several times to provide their final tax returns and provide a written notification to the City ceased gambling operations. A failure to report fee has been sent to them. City of St Joseph Ordinance No. 62.07 Notes: 1. Some organizations provided substantial donations to the St. Joseph community in other quarters. 2. The Central MN Sexual Assault Center provides direct services to St. Joseph residents, but these expenditures are not reported as lawful gambling donations. They are included in the operating costs. In addition the CMSAC provided 4 hours training to St. Joseph's Investigators and 1.5 hours to Security. Officers at CSB. 3. The Boxer's Workout Gym closed their gambling operations in St. Joseph due to low ticket sales. The close out date was April or 2009. Tax returns were not submitted to City Hail for the 2nd, 3rd or 4th quarter despite numerous attempts to remind them. A penalty invoice has been sent to them for non .reporting. 4. The Central MN Sexual Assault Center will discontinue their gambling operations at the Holiday Station on February 28, 2010 due to low profits. 4(h):2
