JOSLFH Council Agenda Item FYI The following items are included in your packet as informational: Land Use Management of Orderly Annexation Area: The City and Township have been working with Stearns County Environmental Services to outline a better process for land use matters. I have included the draft flow chart that we are finalizing for submittal to the governing bodies. We would like to schedule a joint meeting with the Township and Planning Commission on April 17, 2010. 1 will have an update after the meeting on Thursday morning. Liquor Violation: Loso's on Main Street has received another Liquor Violation, this is the third in one year. If they receive a fourth we will be asking them to appear before the Council. In the most recent case they did release the bouncer that did not check the ID. Gang Strike Task Force: Annual report on activities. As can be seen on the enclosed RMS Reports (St. Councilors Joseph Police Department Reports), your employee admitted to allowing a patron in the Steve Frank establishment without checking her identification and she was in fact a minor. The individual Bob Loso admitted to entering your establishment without being asked for identification. This is your third Renee S violation within a twelve month period. The City of St. Joseph is concerned with the multiple ymanietz violations and wants to be assured that measures have been taken to correct the serving and Dale Wick entrance of minors. Additionally this information is being forwarded to the City Council and may be on the agenda for March 18, 2010. As you are aware, allowing minors in the establishment is a violation of St. Joseph Code of Ordinances 71.11.1 (c). The City Council has established a Liquor License Violations Matrix (see enclosed), in order to determine the fine for various liquor license infractions. Based on the Matrix, Loso's Mainstreet Pub is subject to a fine of $ 300.00. If you dispute the allegations you have a right to a hearing before the City Council. If you wish to contest the allegations you must notify me within 7 days of receipt of this letter and submit a $ 500.00 deposit. The deposit will be used to cover the costs of the hearing. If the allegations are determined to be unfounded, the $ 500.00 deposit will be returned. If the violation is founded the deposit will be forfeited and you are subject to a monetary fine and /or suspension of your liquor license. If you do not wish to contest the alleged violation, please remit the $ 300.00 to the City Offices no later than March 12, 2010. Suspensions: Suspensions shall automatically take effect the first consecutive regular business days following the appeal period or following the appeal to the City Council in which no catered events have been scheduled. Days in which the licensed premises are not open for business shall not be credited toward the suspension period. The licensed premises shall be required to provide proof of the scheduled catered events to the City Administrator /Clerk in order to exempt a specific date from the automatic suspension. Aggravating factors: The following shall each constitute one aggravating factor for the purpose of the liquor license violations matrix: One of the following violations concurrent with the present violation, or within the 12 months preceding the present violation: - A refusal to allow inspection - A violation for nudity/lewd acts - After hours sale - Sunday sale without license - After hours display - Violation of club license - Violation of Outdoor liquor permit Two of the following violations, in any combination, concurrent with the present violation or within the 12 months preceding the present violation: - Sale to Minor* - Unaccompanied Minor - Failure to prevent on -sale liquor from leaving premises - Sale to intoxicated person *If multiple citations/ICRs result from a single bar check, this matter shall be treated as a single violation if there are two or less citations/ICRs issued, two violations if 3 to 5 citations/ICRs are issued, or three violations if 6 to 10 citations/ICRs are issued. If more than 10 citations/ICRs result from a single bar check, the matter shall be brought before the City Council for consideration of a penalty. Evidentiary Hearing: The liquor license holder shall have the right to request an evidentiary hearing to contest an alleged violation. The request for hearing must be received by the City Administrator within 7 days of the alleged violation and the request must include a $ 500.00 deposit. In the event the evidentiary hearing finds in favor of the liquor license holder, the $ 500.00 deposit will be returned. ST. At this time, we performed a bar check at Loso's Main Street Pub at 21 Minnesota Street East. I advised Officer Janssen I would stand near the rear entrance of the building, as he and Reserve Officer Haugen went in the front entrance. Shortly after they made entry into the building, I observed a male and female walk out the back of the bar. I stopped these individuals asked if they had their ID's. The male stated he did and he was identified as , by his Minnesota drivers license. I then identified the female as by her name and date of birth. stated she was under twenty -one years of age and that she had her ID in the bar in her purse. At this time, I asked Officer Janssen to escort her into the bar and bring her back out. While they were in the bar, I spoke with who stated he was a bouncer at the bar. I asked' if he had recognized and carded when she came into the bar. He stated she came in with one of his friends who he knew was twenty -one and did not card either of them. tnd Officer Janssen returned to my location and Officer Janssen advised he would escort her to our Police Department. I then went inside the bar with ind advised I would like to speak with the manager on duty. stated this was WILLIAM WITTROCK, DOB: 06/24/1983. We met Wittrock at the rear of the bar and I asked Wittrock if he wished to have me or Douglas explain the situation. Wittrock stated he figured he knew what had happened and Douglas then told him that two females came into the bar, one he was friends with and one he did not know ad that he did not card either of them. At this time, I observed Douglas hand his bar key over to Wittrock and walk away from us. I spoke shortly with Wittrock, explaining we were doing random bar checks and explained how the situation unfolded to him. I advised this did constitute a bar violation. Wittrock did not have any questions at this time. I then returned to the St. Joseph Police Department and spoke with admitted to consuming alcohol and took a PBT, with the results being a .090 AC. I asked Koller if she would be willing to give a statement and she stated she would not. Dan Miller, Central Minnesota Drug and Gang Task Force In August of 2006, I was assigned to the Central Minnesota Drug and Gang Task Force. The CMDGTF covers the counties of Stearns, Benton, Todd, and Morrison Counties. My position is that of a gang investigator and is jointly funded by the Cities of Sartell, Waite Park, Sauk Rapids, and St. Joseph. Part of our job is to identify new members of criminal gangs. We do this by conducting investigations of their members. When criteria points are met for members and or associates of gangs, they are documented in a state data base. Gang investigations include drug crimes, thefts, assaults, robberies, and other crimes of violence. We also give several presentations to different community organizations. During the past year, I have given presentations to schools, the Metro Citizens Police Academy, and other community organizations. Our office along with the Alcohol Tobacco & Firearms (ATF), initiated a case involving the smuggling of cocaine into Minnesota from Mexico. We were joined on the case by the Drug Enforcement Agency (DEA). The case was named operation "Malverde ". 26 people from Minnesota to Texas were federally indicted in the case. Seizures of approximately $500,000 in cash and 41 Kilo's of cocaine were recovered. We also uncovered approximately $2.5 million dollars of wire transfers in reference to this case. This case took several months of surveillance and investigation. The case started in the summer of 2008 and still continues to keep us busy with court appearances and meetings. I still spend days tracking informants down to the cities for hearings or to meet with attorneys. As of January 2010, 23 of the 26 have pled guilty and we are expecting the last three to plead soon. This case was the best case scenario of good collaboration between local, state, and federal law enforcement agencies. The case started in Stearns County and with outside agency assistance tracked to the Mexico border and one step from the powerful Mexican Cartels. January 2009 Conducted an investigation in the City of St. Cloud in reference to the sales of prescription pills. An adult male was arrested in connection with this case. Conducted controlled purchases in reference to methamphetamine in the City of Sauk Rapids. An adult female was arrested in connection with the case. Conducted controlled purchases of marijuana from juveniles in the City of Sartell. Charges were filed against three juveniles. February 2009 Completed and executed a search warrant in the City of St. Cloud. During execution of the warrant two people were arrested on controlled substance charges. Investigators located psilocybin mushrooms and marijuana. March 2009 Arrested a male and female for possession of methamphetamine in the City of Waite Park. Charges were filed against both parties. April 2009 Conducted controlled purchases in reference to prescription pill sales in the Cities of Albany and St. Cloud. Charges are pending against an adult female and male in reference to the case. May 2009 Conducted controlled purchases and search warrants in the City of Kimball in reference to the sales of methamphetamine. A female party was arrested for 2 "d Degree Sales of Methamphetamine and 1St Degree Possession of methamphetamine. Also recovered during the search warrant were 13 firearms. This female was responsible for selling a large amount of methamphetamine in the Waite Park, St. Cloud area. June 2009 Conducted controlled purchases of crack cocaine, marijuana and prescription pills from a confirmed gang member in Benton County. Charges are pending. July 2009 Conducted controlled purchases of methamphetamine from a male in the City of Sauk Rapids. Charges are pending. August 2009 Conducted several controlled purchases in the City of Sauk Centre in reference to the sales of methamphetamine. Charges are peding against 3 adult males. Executed a search warrant in the City of St Cloud in reference to a marijuana cultivation. During the arrest of the female tenant, officers were assaulted and the female was taken into custody. Arrested a confirmed gang member for felon in possession of a firearm. The male had 6 violent felony convictions on his criminal history. The male was indicted in federal court and currently is in federal custody. September 2009 Conducted controlled purchases of large amounts of methamphetamine in Monticello with assistance of the Wright County Task Force. Conducted controlled purchases of crack cocaine from a documented gang member in the City of Waite Park. Charges are pending against an adult male. October 2009 Assisted the Sartell Police Department in reference to a male arrested for being a felon in possession of a firearm. The case was presented to the United States Federal Attorney's office for prosecution in the federal court system. Conducted a search warrant in the City of Waite Park. During the warrant 23 pounds of marijuana and $10,000 in U.S. Currency was recovered. We also located 2 handguns inside the residence. November 2009 Conducted controlled purchases in the City of St Cloud in reference to the sales of methamphetamine. Charges are pending. December 2009 Conducted an investigation into the distribution of high grade marijuana into the Central Minnesota Area. During the investigation a search warrant was executed in the City of Sartell. During the warrant of the warrant 146 pounds of marijuana was recovered. The estimated street value of approximately $600,000. Follow up search warrants were conducted in the City of Waite Park which led to the seizure of $23,000.
