BOARD /COMMISSION /COMMITTEE RECOMMENDATION: The St. Joseph EDA considered lot split
request of Joe Leach on April 28 and has recommended the City Council approve the request and passed
a resolution reflecting such.
PREVIOUS COUNCIL ACTION: When the Council updated the Zoning Ordinance in 2004, the Ordinance
allowed for administrative lot splits by issuance of a certificate of compliance. The Ordinance allows the
Administrator to approve minor subdivisions under certain circumstances. Those circumstances include
if the division is less than 10 acres and no more than two lots. In this case the Ordinance applies.
Approval of the certificate of compliance has been placed under the consent for this reason as they have
historically.
BACKGROUND INFORMATION: The EDA is party to this particular lot split as when the Buettner
Business Park was developed, the City was a partner and the protective covenants include review by the
EDA for certain items, such as a lot split. The EDA review is limited to assuring that the newly created
lots meet minimum dimensions.
Approval of the lot split does not convey development rights or site plan approval. As can be seen from
the enclosed certificate, the same language is part of the certificate. The parcel is being split for
potential development. At this time the City does not have the proposed development information;
however, when it does, the plan will be reviewed by the staff, EDA and Planning Commission.
BUDGET /FISCAL IMPACT: By approving the sub - division request, the City has the potential for
construction of a commercial facility, increasing the tax base.

REQUESTED COUNCIL ACTION: Authorize the Administrator to execute the Certificate Compliance
approving the lot split request of Joe Leach as recommended by Staff and the EDA.
CERTIFICTE OF COMPIANCE

The undersigned Administrator of the City of St. Joseph does hereby certify that the City Council
for the City of St. Joseph reviewed and approved at its regular meeting on the 6`h day of May, 2010, a lot
split dividing Lot 1 Block 1 Buettner Business Park into two separate parcels. The lot split results in the
following two parcels:
Parcel A
That part of Lot 1, Block 1, Buettner Business Park, according to the recorded plat thereof,
Stearns County Minnesota lying northerly of the following described line: Commencing at the
southeast corner of lot 1; thence North 00 degrees, 34 minutes, 30 seconds West assumed bearing
along the east line of said Lot 1, a distance of 326.90 feet to the point of beginning of the line to
be described; thence South 89 degrees 25 minutes 30 seconds West, a distance of 581.59 feet to
the westerly line of said lot 1, and said line there terminating.
Parcel B
Lot 1, Block 1, Buettner Business Park, according to the recorded plat thereof, Stearns County
Minnesota, except that part lying northerly of the following described line: Commencing at the
southeast corner of said Lot 1; thence North 00 degrees 34 minutes 30 seconds West assumed
bearing along the east line of said Lot 1, a distance of 326.90 feet to the point of beginning of the
line to be described; thence South 89 degrees 25 minutes 30 seconds West, a distance of 581.89
feet to the westerly line of said Lotl, and said line there terminating.
The above transfers are in compliance with the zoning ordinance and subdivision regulations for
the City of St. Joseph. Further, this Certificate does not convey site plan or development plan approval.

Dear Ms. Weyrens:
Please accept this letter and attached Certificate of Survey as a request to subdivide Lot 1,
Block 1, Buettner Business Park.
The current lot is approximately 8.31 Acres. The split would create a "North lot" of 3
Acres and a "South lot" of 5.31 Acres. The North 3 Acre parcel would then be sold to a
third party for their use, while the South 5.31 Acres would be retained by the current
owner, Secured Earning & Warranty.

The proposed lot split will accommodate the sale of the northern three acres of the site to
an existing business owner in the community. The City has not received any additional
information regarding the potential for pending construction on the three acre site in the
near -term.
The EDA is required to review the lot split request as it relates to the Buettner Business
Park Covenants in effect. The EDA's review is limited to confirming the proposed lot split
meets dimensional requirements contained in the covenants. The minimum lot size for
industrial lots in the Business Park is three acres.

RESOLUTION 2010 -001
RESOLUTION RECOMMENDING APPROVAL OF A LOT SPLIT FOR LOT 1, BLOCK 1 OF
THE BUETTNER BUSINESS PARK
WHEREAS, Joel Leach has submitted a request to split Lot 1, Block 1, Buettner Business Park;
and,
WHEREAS, the lot split would result in two lots measuring 5.31 acres and 3.00 acres in size;
and,
WHEREAS, the Protective Covenants applicable to the subject property require the Economic
Development Authority (EDA) to review lot split requests; and
WHEREAS, the EDA has reviewed the lot split request as it relates to minimum lot size within
the Buettner Business park; and
WHEREAS, a registered land surveyors' certification for the proposed lot split was included with
the application.
NOW, THEREFORE, BE IT RESOLVED BY THE ST. JOSEPH ECONOMIC DEVELOPMENT
AUTHORITY THAT: The Economic Development Authority does hereby approved the lot split
as it relates to the Protective Covenants within the Buettner Business Park relating to industrial
lot size;
BE IT FURTHER RESOLVED that the EDA hereby recommends the City Council of the City of
St. Joseph approve the proposed lot split.
