PREVIOUS COUNCIL ACTION: The City Council has previously ordered the improvements for
16`h Avenue SE to include street, storm sewer, curb and gutter and turf restoration. The final plans have
been approved and the project is currently out for bidding.
BACKGROUND INFORMATION: The bids for the project are due on June 6, 2010 with the City
Council considering the bids on June 8 2010. The final assessments roll will be prepared using an
estimated number. After the bids are received and tabulated the assessments will be re- calculated and
they will be available for the special assessment hearing on June 13.
The process for bonding and assessing properties for improvements requires a series of resolutions.
Due to the compacted schedule, trying to get the project constructed this fall, the resolutions are being
submitted simultaneously.

REQUESTED COUNCIL ACTION: Authorize the Mayor and Administrator to execute Resolution 2010-
014 and 2010 -015 declaring costs to be assessed and setting the public hearing for the improvements to
16`h Avenue SE.

Declaring Costs to be Assessed and
Ordering Preparation of Proposed Assessment
16`h Avenue SE
WHEREAS, a contract has been let (estimated costs have been calculated) for the improvement to 16`h
Avenue SE between a point 100 feet to the south of Dale Street East and Minnesota Street East by
constructing grading, storm sewer bituminous street with concrete curb and gutter and turf
improvements and the estimated cost for such improvement is $ 700,800, and the expenses incurred or
to be incurred in the making of such improvement amount to $ 288,400 so that the total cost of the
improvement will be $ 989,200.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST JOSEPH, MINNESOTA:
1. The portion of cost of such improvement to be paid by the City is hereby declared to be $ 06,710
and the portion of the cost to be assessed against benefited property owners is declared to be $
482,490.
2. Assessments shall be payable in equal installments extending over a period of 15 years, the first
of the installments to be payable on or before the First Monday in January, 2011and shall bear
the interest rate of 5.5 percent per annum from the date of adoption of the assessment
resolution.
3. The City Administrator, with the assistance of the City Engineer shall forthwith calculate the
proper amount to be specially assessed for such improvement against every assessable lot,
piece or parcel of land within the district affected, without regard to cash valuation, as provided
by law, and she shall file a copy of such proposed assessment in her office for public inspection.
4. The City Administrator shall upon the completion of such proposed assessment notify the
Council thereof.

RESOLUTION 2010 -015
RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT
16`hAvenue SE Improvements
WHEREAS, by a resolution passed by the council on the 17`h day of June, 2010, the City Administrator was
directed to prepare a proposed assessment of the cost of improving 16`h Avenue SE between a point 100 -
feet south of Dale Street East and Minnesota Street E by constructing grading, storm sewer, bituminous
street with concrete curb and gutter, and turf improvements, and
WHEREAS, the Administrator has notified the council that such proposed assessment has been completed
and filed in his /her office for public inspection,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA:
1. A hearing shall be held at 6:30 p.m. on July 13, 2010 in the city hall located at 25 College Avenue N to
pass upon such proposed assessment. All persons owning property affected by such improvement will be
given an opportunity to be heard with reference to such assessment.
2. The City Administrator is hereby directed to cause a notice of the hearing on the proposed assessment
to be published once in the official newspaper at least two weeks prior to the hearing, and she shall state
in the notice the total cost of the improvement. She shall also cause mailed notice to be given to the
owner of each parcel described in the assessment roll not less than two weeks prior to the hearing.
3. The owner of any property so assessed may, at any time prior to certification of the assessment to the
county auditor, pay the whole of the assessment on such property, with interest accrued to the date of
payment, to the City Administrator, except that no interest shall be charged if the entire assessment is paid
within 30 days from the adoption of the assessment. An owner may at any time thereafter, pay to the
Stearns County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must be made before November
15 or interest will be charged through December 31 of the succeeding year.
