JUSEPH MEETING DATE: July 12, 2010 Council Agenda Item 2a AGENDA ITEM: 16th Avenue — Final Assessment Hearing SUBMITTED BY: Administration BOARD /COMMISSION /COMMITTEE RECOMMENDATION: PREVIOUS COUNCIL ACTION: The City Council has previously ordered the improvement for 16th Avenue, approved the plans and specifications and accepted bids for the proposed improvement. BACKGROUND INFORMATION: As you are aware the City accepted bids for the 201016th Avenue Improvement project. Based on the lowest responsible bid, the final assessment roll has been prepared and distributed to the property owners. As required by Statute, a public hearing notice was duly published in the St. Joseph Newsleader and the same notice was mailed to all affected property owners. At the time of mailing the hearing notices, the bids were yet to be opened so the property owners were provided a final assessment worksheet based on preliminary numbers. The City has the ability after such notice to lower an assessment but not increase. Based on the competitive bids, the assessments for affected property owners have been reduced. Anyone appealing the assessment must file a written notice before, during or within 10 days of the closing of the hearing if they wish to appeal the assessment. If an appeal notice is not received the final assessment becomes due and payable within 30 days. The individual assessment notices that have been mailed to each property owner have been included in the back of the packet. The colored paper separating the packet includes an alphabetical listing of all affected property owners and a line number. The notices are in line number order. So, for example, if Ryan Meyer approaches the podium, he should be asked for his line number or the Council can quickly find the sheet using the alphabetized list. The Council at this meeting must also determine the length of the bond. Since the project can in lower than expected Monte Eastvold was asked to look at the impact of a 10 year versus 15 year bond. If a 19 year bond is assessed the interest rate charged on assessments would be 5% and if the bond is 15 years, the assessment would be 5.5 %. The City has historically issued 15 year bonds. If 10 years is something the residents are interested in that too could be accomplished. The length of term does not make a difference to staff, it is more an affordability issue for the residents. BUDGET /FISCAL IMPACT: Since this project is being financed through the issuance of a bond, the financial impact will include a tax levy and as agreed previously by the Council, a drawdown of the storm sewer reserve of approximately $ 13,000 to $ 20,000 per year, depending on a 15 or 10 year bond issue. The Storm Sewer Fund has a reserve balance and we continue to collect the utility. JOSEPH PUBLIC HEARING Notice is hereby given that the Council will meet at 6:30 p.m. on Monday, July 12, 2010 in the St. Joseph City Council Chambers to consider, and possibly adopt, the proposed assessment of the cost of Improvement No. SEH No. STJOE 11062, improving 16th Avenue SE between a point 100 -feet south of Dale Street East and Minnesota Street East by constructing grading, storm sewer, bituminous street with concrete curb and gutter, and turf improvements. Adoption by the Council of the proposed assessment may occur at the hearing. The proposed assessment role is on file for public inspection at the City Administrator's Office. The total project cost is $ 989,200 of which $ 482,490 is proposed to be assessed against benefiting properties. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the City Administrator prior to the assessment hearing or presented to the presiding officer at the hearing. The Council may upon such notice consider objection to the amount of a proposed individual assessment at an adjourned. meeting upon such further notice to the affected property owners, as it deems advisable. An owner may appeal an assessment to district court pursuant to Minn. Stat. 429.081 by serving notice of the appeal upon the Mayor or City Administrator within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or City Administrator. Judy Weyrens Administrator Publish: June 25, 2010 2(a):3 City of St. Joseph RESOLUTION 2010 -016 RESOLUTION ADOPTING FINAL ASSESSMENTS 16th Avenue SE Improvements WHEREAS, pursuant to proper notice duly given as required by law, the council has met and heard and passed upon all objections to the proposed assessment for improvement of 16th Avenue SE between a point 100 -feet south of Dale Street East and Minnesota Street E by constructing grading, storm sewer, bituminous street with concrete curb and gutter, and turf improvements. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 15 years, the first of the installments to be payable on or before the first Monday in January of 2011, and will bear an interest rate of 5.5 percent per annum from the date of the adoption of the assessment resolution. The first installment will have an added interest on the entire assessment from the date of the assessment resolution until December 31, 2011. An interest for one year on all unpaid installments shall be added to each subsequent installment when due. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment to the City Administrator except that no interest shall be charged if the entire assessment is paid no later than August 12, 2010; and he may, at any time thereafter, pay to the City Administrator, the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The City Administrator shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County. Such assessments shall be collected and paid over in the same manner as other municipal taxes. Adopted by the council this 12th day of July 2010.'
