PREVIOUS COUNCIL ACTION: The City Council has previously ordered the improvement for 16th
Avenue, approved the plans and specifications and accepted bids for the proposed improvement.
BACKGROUND INFORMATION: This agenda item can be considered if the City does an appeal of the
assessment. We will have more information on this at the public hearing.war
BUDGET /FISCAL IMPACT: Since this project is being financed through the issuance of a bond, the
financial impact will include a tax levy and as agreed previously by the Council, a drawdown of the storm
sewer reserve of approximately $13,000 to $ 20,000 per year, depending on a 15 or 10 year bond issue.
The Storm Sewer Fund has a reserve balance and we continue to collect the utility. Therefore, the
utilization of storm sewer funds for this project will not result in increased rates at this time.

REQUESTED COUNCIL ACTION: Authorize the Mayor and Administrator to execute Resolution 2010-
017, awarding the project to the lowest, responsible bidder, JR Ferche in the amount of $ 550,416.65.

RESOLUTION 2010 -017
RESOLUTION ACCEPTING THE BIDS AND AWARDING THE CONTRACT TO JR FERCHE
16th Avenue SE Improvements
WHEREAS, pursuant to an advertisement for bids for the improvement of 16th Avenue SE between
a point 100 -feet south of Dale Street East and Minnesota Street E by constructing grading, storm
sewer, bituminous street with concrete curb and gutter, and turf improvements, bids were
received, open and tabulated according to law, and the following bids were received complying with
the advertisement:

AND WHEREAS, it appears that JR Ferche of Rice, MN is the lowest responsible bidder.
NOW, THEREFORE, BE IT RSEOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA:
1. The Mayor and City Administrator are hereby authorized and directed to enter into
the attached contract with JR Ferche of Rice, MN in the name of the City of St. Joseph
for the improvement of 16th Avenue SE between a point 100 -feet south of Dale Street
East and Minnesota Street E by constructing grading, storm sewer, bituminous street
with concrete curb and gutter, and turf improvements according to the plans and
specifications therefore approved by the City Council and on file in the office of the City
Administrator.
2. The City Administrator is hereby authorized and directed to return forthwith to all
bidders the deposits made with their bids, except that the deposits of the successful
bidder and the next lowest bidder shall be retained until a contract has been signed.
Adopted by the council this 12th day of July 2010.
