Box 668 St. Joseph, MN 56374 This letter's intent is to provide commentary in regards to the City of St. Joseph's sanitary sewer billing and accounting methods. Specifically, the following items are addressed: • Method of sanitary sewer charges • Method of accounting for sanitary sewer • Depreciation coverage for sanitary sewer capital assets Method of Sanitary Sewer Charges Line Charge: Section 43.03a of the City's proposed sewer rate ordinance, dated 08/05/10, includes the following language: D Sewer Line Charge: All users of the St. Joseph Wastewater System will be billed a proportionate share of the fixed costs of the wastewater facilities. Annually the City Council will review the fixed cost and establish the Sewer Line Charge. The fixed costs used to determine the sewer line charge will be equated to a charge per unit... Minnesota Statute 444.075 Waterworks Systems; Storm, Sanitary Sewer Systems provides the City authority to impose minimum charges for sanitary sewer as follows: Subd. 3c.Minimum charges. (a) Minimum charges for the availability of water or sewer service may be imposed for all premises abutting on streets or other places where municipal or county water mains or sewers are located, whether or not connected to them. Itpt.b4. $, Subdivision 3 of Minnesota Statute 444.075 defines the items for which minimum charges for sanitary sewer are authorized: ➢ Subd. 3. Charges; net revenues. (a) To pay for the construction, reconstruction, repair, enlargement, improvement, or other obtainment, the maintenance, operation and use of the facilities, and of obtaining and complying with permits required by law, the governing body of a municipality or county may impose just and equitable charges for the use and for the availability of the facilities and for connections with them and make contracts for the charges as provided in this section. The charges may be imposed with respect to facilities made available by agreement with other municipalities, counties or private corporations or individuals, as well as those owned and operated by the municipality or county itself. (b) Notwithstanding local charter restrictions, charges made for service rendered shall be as nearly as possible proportionate to the cost of furnishing the service. • The City's intent to recover fixed overhead costs through the line charge equates to a minimum charge for sewer users. Fixed costs may include components of construction, reconstruction, operations, and maintenance, all of which are authorized uses of sewer charges as described in Subdivision 3. Usage Charge: Section 43.03b of the City's proposed sewer rate ordinance, dated 08/05/10, includes the following language: ➢ Sewer Usage Charge: All users of the St. Joseph Wastewater System will be billed for wastewater calculated on the basis of metered water usage, or if applicable direct wastewater metering. Subdivision 3a of Minnesota Statute 444.075 defines how sanitary sewer charges may be based: ➢ Subd. 3a.Sanitary sewer charges. Sanitary sewer charges may be fixed: (1) on the basis of water consumed; or (2) by reference to a reasonable classification of the types of premises to which service is furnished; or (3) by reference to the quantity, pollution qualities and difficulty of disposal of sewage produced; or (4) on any other equitable basis including any combination of equitable bases referred to in clauses (1) to (3), but specifically excluding use of the basis referred to in subdivision 3b, clause (1) *; and otherwise without limit. 2 * Subd. 3b.Storm sewer charges. Storm sewer charges may be fixed: (1) by reference to the square footage of the property charged, adjusted for a reasonable calculation of the storm water runoff The City annually establishes sewer usage charges based on the sewer fund budget. Line charges are used to offset fixed costs, and sewer usage charges are used to offset remaining costs. The City holds an annual public hearing to specifically address proposed fees, including those for sanitary sewer. Method of Accounting for Sanitary Sewer In accordance with government accounting practices, the City uses an enterprise fund to account for sanitary sewer activities. Enterprise funds utilize full accrual business -like accounting and are used to report activities for which fees are charged to external users for goods or services. The City's chart of accounts follows industry best practices and details general ledger, revenue, and expense items. Revenue accounts include sanitary sewer usage charges, line charges, and College of Saint Benedict charges. Expense accounts are departmentalized into such categories as maintenance, various lift stations, and general administration. Object codes include those for personnel, supplies, and other services and charges. The City follows generally accepted accounting principles and government accounting standards, as promulgated by the Governmental Accounting Standards Board. Depreciation Coverage for Sanitary Sewer Capital Assets The City's audit management letter for the fiscal year ended December 31, 2009 (dated April 23, 2010) included the following comment in the financial analysis section: ➢ The Sewer Fund has shown operating losses for each of the past five years. Due to the nature and cost of the Sewer Fund's assets, it is difficult to establish sewer rates sufficient to cover replacement of the assets represented by depreciation expense. Ideally, sewer revenues should cover all operating expenses, including depreciation. However, depreciation of Sewer Fund assets is a difficult cost to recover from system users since there are relatively few users in relation to the cost of asset replacement. Generally accepted accounting principles (GAAP) permit the use of an enterprise fund to report activities for which fees are charged to external users for goods or services, regardless of whether the government intends to fully recover the cost of the goods or services provided. Although the auditor recommended the City cover operating expenses 3 with revenues, it is not required by GAAP or any legislative body. It is ultimately a City Council decision to change sewer rates that may affect revenues and operating results. Summary The City's method of charging for sanitary sewer is designed to cover costs at levels prescribed by the sewer budget and dictated by the City Council. The City's utilization of a minimum line charge to offset fixed costs and a usage charge to offset additional costs is authorized in Minnesota Statute 444.075. The City's accounting practices related to sanitary sewer are consistent with GAAP as well as industry best practices. J OSEPH www.cityofstjoseph.com August 9, 2010 Dale Schneider Sal's Bar 31164 — 115 Avenue Administrator St. Joseph MN 56374 Judy Weyrens RE: Alleged Bar Violation, July 29, 2010 Mayor Dear Dale: Al Rassier This letter is to inform you that Sal's Bar received an alleged liquor violation on July 29, 2010. Councilors The alleged violation includes sale to alcohol to two minors and three unaccompanied Steve Frank minors. As can be seen on the enclosed RMS Report (St. Joseph Police Department Reports), Bob Loso the St. Joseph Police Department was conducting routine bar checks and five minors were Renee Symanietz identified in your establishment. Two of the five have admitted to purchasing alcohol. Dale Wick The City Council has established a Liquor License Violations Matrix (see enclosed), in order to determine the fine for various liquor license infractions. Based on the Matrix, Sal's Bar is subject to a fine of $ 400.00. Since the violation included three to five reports, this incident is equivalent to two aggravating factors. The violation will remain with the license for a period of 12 months from the date of the violation. If you dispute the allegations you have a right to a hearing before the City Council. If you wish to contest the allegations you must notify me within 7 days of receipt of this letter and submit a $ 500.00 deposit. The deposit will be used to cover the costs of the hearing. If the allegations are determined to be unfounded, the $ 500.00 deposit will be returned. If the violation is founded the deposit will be forfeited and you are subject to a monetary fine and /or suspension of your liquor license. If you do not wish to contest the alleged violation, please remit the $ 100.00 to the City Offices no later than October 2, 2008. Suspensions: Suspensions shall automatically take effect the first consecutive regular business days following the appeal period or following the appeal to the City Council in which no catered events have been scheduled. Days in which the licensed premises are not open for business shall not be credited toward the suspension period. The licensed prem shall be required to provide proof of the scheduled catered events to the City Administrator /Clerk in order to exempt a specific date from the automatic suspension. REPORTING OFFICER: Johnson, Matt 7707 ASSISTING OFFICER(S): Sergeant Pfannenstein, Dwight 7702; Janssen, Pete 7704 On July 29, 2010 at approximately 0015 hours, Sergeant Pfannenstein, Officer Janssen, and I were doing bar checks. We started at 109 Minnesota Street West, Sal's Bar, and upon entering observed approximately twelve to fifteen people in the bar. We went to the bar and spoke to KYLE MARK SCHNEIDER, DOB: 02/22/1978, and advised him we were conducting bar checks. At this time, I observed four people at the bar and five at a separate table. As we were speaking, I observed a female walk out the front of the bar. Reserve Officer Seifermann and I followed this female and identified her as TARA RAE NOACK, DOB: 12/28/1989, by her name and date of birth. Noack admitted she was under twenty -one years of age and that she was consuming alcohol in the bar. She also stated she did not have any identification on her. In speaking with Noack, we were approached by four more patrons, who were all identified by their name and date of birth as BRITTNEY PATIENCE PROELL, DOB: 09/30/1989, ADAM MICHAEL GIAMBRUNO, DOB: 04/06/1990, ALISA NICOLE HEMMESCH, D013: 05/03/1990, and TAYLOR MORGAN RAMLER, DOB: 02/10/1990. They all admitted to be consuming alcohol inside of Sal's Bar and not having a license with them. In speaking with Proell, she stated she was the designated driver and had not been drinking. Ramler, Hemmesch, and Noack were placed in the back of squad 702. Giambruno was placed in the back of squad 704. Proell was given a PBT and was found to be .00 AC. I then reentered the bar and identified the remaining patrons as being at least twenty -one years of age. At this time, I spoke with Giambruno. Prior to placing him in my squad, I asked if he had anything in his pockets, he stated he had some keys, an I -Pod, a cell phone, and a wallet. When he pulled his wallet out, I asked if he had any identification and he stated he did. Giambruno did have his ID, showing he was under twenty -one. He gave me consent to search his wallet and I found no more identifications. At this time, I issued Giambruno a citation for underage consumption and then took a recorded statement from him. During the statement, Giambruno stated he went into Sal's Bar around 2330 hours and went directly to the bathroom. Giambruno stated he came out of the bathroom, walked to the bar, and ordered a $4.00 mug of beer, paying cash. Giambruno stated he was never asked for an ID when he ordered the beer, nor was he approached by an employee. (See Giambruno statement for additional.) Giambruno was then released. I then spoke with Hemmesch, who was placed in the back of my squad car, and took a recorded statement from her. In the statement, Hemmesch stated they arrived at the bar around 2300 hours. She stated she sat down at the bar and her friend, Giambruno, gave her a beer. She stated she did not purchase a beer from the bar. She also stated she was not approached by any of the bar employee's, nor was she asked for identification at t,- bar. JOSEPH POLICE DEPARTMENT Follow -Up Report • • ICR NUMBER: 10801219 OFFENSE /INCIDENT: Bar Violation LOCATION OF OCCURRENCE: 109 West Minnesota Street, Sal's Bar REPORTING OFFICER: Janssen, Pete 7704 DATE OF REPORT: July 29, 2010 • • On July 29, 2010 at approximately 0015 Hrs. I, Officer Peter Janssen along with Officer Matt Johnson conducted a bar check at Sal's Bar. As we walked into the bar I observed 4 females and one male at the bar. I approached the bar and spoke with the employee behind the bar known to me as Kyle Mark Schneider, DOB: 02 -22 -1978. As I was speaking with Schneider I observed one of the females walk away from the bar and out the front door. Officer Johnson and his Reserve Officer, A. Seifermann identified the female outside of the bar and found her to be under the age of 21. It was later found that all of them were under the age of 21. 3 of the females were drinking inside the bar and the one male. The other female had not been drinking as she was the designated driver. I assisted Officer Johnson by getting a tape statement from Tara Rae Noack, DOB: 12 - - 1989. Noack agreed to give a volunteer statement. In speaking with Noack she said she arrived at Sal's Bar at approximately 2330 Hours. Noack said she nobody was at the front door when she walked in. Noack said she was not carded and that she did not have any identification on her person. Noack agreed to let me check her purse. No identification found. Noack identified the employee working behind the bar as Kyle. Noack said she met him over the summer. Noack admitted to consuming alcohol inside the bar.
