BACKGROUND INFORMATION: The City was contacted by a potential resident who is looking to
purchase two lots to construct a new home with accessory building. All the platted lots include an
easement between the Tots for drainage and utility. This easement is platted through the platting
process. While the lots are not developed, the easement is still recorded as public right -of -way and
utility companies have the right to use the easement today and in the future. This particular lot has a
five foot easement as does the adjoining property creating a ten foot easement.
Since the easement is recorded on the plat, it is considered public right of way and can only be released
through a public hearing process. The Council must determine at the hearing that it is in the best
interest of the City to release the portion of easement. Since a utility easement can be used by any
public utility, the City staff has sent a hearing notice to all utility companies that have underground lines
in St. Joseph. While some do not have lines in the area identified, we chose to send to all regardless.

Public Hearing — Easement Release
The City Council for the City of St. Joseph shall hold a public hearing on Thursday September 16
Administrator at 7:00 p.m. in the St. Joseph City Hall, 25 — College Avenue North, St. Joseph MN 56374
ludy Weyrens The purpose of the hearing is to consider a request to release the 10 foot utility easement
separating Lots 1 and 2, Block 1 Graceview Estates 3. The request has been submitted by
Leonard and Marcie Bechtold, 7431 Ridgewood Road, St. Joseph MN 56374.
Mayor
Al Rassier The request will release any rights of the City contained in the plat. By this action the City is
not affecting any rights of public utility companies not owned and operated by the City of St.
Councilors Joseph.

Councilors received a request to release the easement to allow lots 1 & 2 Block 1 to be combined,
Steve Frank creating one lot. The petitioner requesting release intends to construct a single family home
Bob Loso and accessory building on the newly created lot.
