Pursuant to due call and notice thereof the Planning Commission for the City of St. Joseph me in regular
session on Monday, November 4, 2001 at 7:00 PM in the St. Joseph City Hall.
Members Present: Chair Gary Utsch. Commissioners S. Kathleen Kalinowski, Marge Lesnick, Mike
Deutz, Jim Graeve. City Administrator/Clerk Judy Weyrens. Members absent: Commissioner Kurt
Schneider and Council Liaison Al Rassier.
Others Present: Loren Mathison, Kevin Hardesty, Jean Dehler, Mark Lambert, Randy Schmitz, Kay
Lemke, Dorothy Klein-Anderson, Howard Zimmer, Lance Honer.
Deutz made a motion to approve the agenda with the deletion of item #3, Minutes
Approve Agenda:
and the addition of 11 (a) Proposed Development south of Kennedy School. The motion was
seconded by Lesnick and passed unanimously by those present.
Public Hearing – Robert Veline, Special Use Permit: Chair Utsch opened the public hearing at 7:00 PM
and stated the purpose of the hearing is to consider a Special Use Permit to allow a rental unit in a General

Business District. The property is located at 21 – 1 Avenue NW and is legally described as follows: N65’
of lots 11 and 12 Block 8 and Block 9 Townsite of St. Joseph. The request has been submitted by Robert
Veline.
St. Joseph Code of Ordinances 52.21 subd. 3 (f) provides for the following under Special Uses: Mixed use
of a Permitted Use and a multiple residential dwelling units; but only if at least 50% of the interior square
footage (exclusive of the basement or cellar) is used full time for a Permitted Use. The area consisting of
multiple residential dwelling units must meet the standards of Section 52.19, Subd. 5 and 6. Parking
requirements shall be separately determined for the commercial and residential uses in accordance with
Section 52.14, Subd. 4.
Robert Veline spoke on his own behalf. Veline stated that his plans for the above mentioned property
include remodeling the lower level for business retail such as a gift shop and remodeling the upper level for
two apartments. The upper level of the building had been used in the past as a rental unit.
Jean Dehler of 33 Minnesota Street West spoke in support of the project. Dehler is encouraged that St.
Joseph will soon have another business and encouraged the Planning Commission to recommend the City
Council approve the Special Use Request.
Their being no one further wishing to testify, Utsch closed the hearing at 7:10 PM
Utsch questioned Veline as to the timeline for his project and if both levels will be remodeled at the same
time. Veline stated that he plans to begin remodeling the upper level while looking for a tenant for the
lower level. Utsch stated that while he supports the project but would like to establish a date when the
lower level business must be operating as the rental license is tied 50% of the building being business.
Veline stated that he will have a lower level tenant operating on or before June 1, 2002.
Graeve questioned when the rental units will be completed and ready for occupation. Veline stated that he
would like to have the remodeling completed within three (3) months.
Kalinowski made a motion to adopting the following resolution:

The request of Robert Veline for a Special Use request came before the Planning Commission at a public
hearing held on November 5, 2001. The purpose of the hearing was to consider issuance of a Special Use
Permit to allow a rental license in a General Business Zoning District..

The request has been submitted by Robert Veline, 23 West Minnesota Street, St. Joseph MN 56374.
Notice of this matter was duly served and published.
In consideration of the information presented to the Planning Commission and its application to the
Comprehensive Plan and Ordinances of the City of St. Joseph, the Planning Commission makes the
following findings:
The proposed use is consistent with the standards for granting a special use permit, St.
Joseph Code of Ordinances 52.9 Subd. 1.
The proposed use meets all the parking requirements both for a rental unit and lower level
gift shop.
Therefore, based on the above findings, the Planning Commission makes the following recommendation:
Approval of the Special Use Permit to allow a rental unit in a General Business District with the following
contingencies:
1. The rental license must meet all the requirements as determined by the Housing
Inspector, Building Official and Fire Chief.
2. If the lower level is not occupied by a permitted business on June 1, 2002, the rental
license shall be suspended until the lower level is occupied.
The motion was seconded by Lesnick and passed unanimously.
Randy Schmitz, Request to Construct a Fence: Randy Schmitz appeared before the Commission to request
authorization to make application for a building permit to construct a fence on the property located at
31101 County Road 133. The property has recently been annexed to the City of St. Joseph and is zoned
Highway Business. Schmitz stated that the fence will be eight feet in height, steel construction and be
painted red to match the existing buildings.
Utsch stated that since the property abuts County Road 133, the fence should be finished on the outside and
landscaped. Schmitz stated his plans include constructing birms and landscaping in front of the fence.
However, the landscaping cannot be completed until spring 2002.
Deutz expressed concern regarding the maintenance of a steel fence. In his opinion metal fences need to be
maintained if they are constructed and should be a condition of the building permit.
Lesnick questioned how many accesses the property will have to County Road 133. Schmitz stated the
property currently has two accesses and he plans to use both to service the property.
Kalinowski made a motion authorizing Schmitz to make application for a building permit to
construct an eight (8) foot steel fence at 31101 County Road 133 with the following contingencies:
1) The outside of the fence abutting County Road 133 must be landscaped no later than
June 1, 2002.
2) The fence must be maintained at all times.
The motion was seconded by Graeve and passed unanimously.
Public Hearing – Loren Mathison, Special Use Permit and Variance: Chair Utsch opened the public and
stated the purpose of the hearing is to consider a Special Use Permit to allow an auto dealership in a
Highway Business District and to consider a variance on the exterior requirements. The property is located
at 219 Cedar Street East, legally described as follows: .75A W 200’ of E 631.57’ of SE4NW4 lying N of
Hwy 52, S of RR Less .07A.
