PREVIOUS COUNCIL ACTION: The City Council on September 29, 2010 approved the final plat for
Rivers Bend 2 contingent upon execution of the development agreement and approval of the City
Engineer.
BACKGROUND INFORMATION: The City Engineer has received and reviewed the final construction
plans and accepted them as final. The only portion left is the execution of the Development Agreement.
Cory Ehlert stopped in the office late on Friday with concern with the developers agreement. When
City improvements are constructed privately, they developer is required to have a city inspector on -site
to verify that they are being built to City standards. The cost for the inspection is based on the time it
takes for the contractor to install the infrastructure. The project costs are very tight for the developer
and they have indicated that they have $ 5,000 for the inspection services. It is anticipated that the
project will take approximately 4 to 5 weeks and the inspection is like to cost between $ 20,000 - $
30,000 (Approximately 200 hours).
Since I have not had time to discuss this with the engineer or attorney, I have placed the matter on the
agenda as the Council would have to decide if public utilities will be allowed to be constructed with
observation. With the exception of St. Cloud who has inspectors on site, the surrounding communities
require inspection services. More information will be provided to the Council as it develops during the
week.
