BACKGROUND INFORMATION: Tom Jovanovich is representing Tom and Carol Schindler in a private
matter regarding correcting a legal description (see attached letter). In order to resolve the legal
description the City is being requested to approve a lot split attaching a small piece of land from Samuel
Johnson to the Schindlers. The Sam Johnson and Anne Buckvold have already executed a quit claim
deed but it cannot be recorded without City Council approval.
The matter was reviewed by the City Engineer and the legal description is correct.

REQUESTED COUNCIL ACTION: Authorize the Mayor and Administrator to execute the Certificate of
Compliance approving the lot split request of the Schnidler's.

The undersigned Administrator for the City of St. Joseph does hereby certify that the City
Council reviewed and approved, at its regular meeting on the 2 " day of December, 2010, a lot split to
rectify and erroneous conveyance that occurred in 1978 between the properties located at 810
Minnesota Street E and 807 Able Street E. The property described on the attached quit claim deed
dated November, 2010 shall be attached to the following parcel:
LOT TWO (2), Block One (1) CLOVERDALE ESTATES 2 ADDITION, according to the plat and
survey thereof on file and of record in the office of the County Recorder in and for Stearns County
Minnesota.
Approved by the Council this 2 " day of December, 2010.

wife, Grantee, as joint tenants, real property in. Stearns County, Minnesota, described as follows:
All that part of the Northeast Quarter of the Southeast Quarter (NE 1/4 SE 1/4) of Section
Ten (10), in Township One Hundred Twenty -four (124) North, of Range Twenty -nine
(29) West, in Stearns County, Minnesota described as follows, to -wit: Beginning at the
northwest comer of Lot 3, Block 1, CLOVERDALE ESTATES 2ND ADDITION,
according to the recorded plat thereof; thence SOUTH, plat bearing, along west line of
said Lot 3 a distance of 53.00 feet; thence WEST, along the north line of Lot 2, .Block 1
of said addition, a distance of 72.70 feet; thence North 00 degrees 10 minutes 52 seconds
West 46.79 feet to the most northerly corner of said Lot 2; thence North. 85 degrees 07
minutes 37 seconds East 73.11 feet to the point of beginning. Containing 3,631 square
feet and subject to any easements of record.
Said tract being conveyed for the purpose of attachment to a contiguous tract, to -wit:
Lot Two (2), :Block One (1) CLOVERDALE ESTATES 2ND ADDITION, according to
the plat and survey thereof on file and of record in the office of the County Recorder in
and for Stearns County, Minnesota.

Dear Judy:
I spoke with you during September regarding a Certificate of Compliance
involving a proposed property transfer splitting a tract of land at 810 Minnesota
Street East in the City of St. Joseph from Samuel D. Johnson and Anne G.
Buckvold to Thomas C. and Carol Schindler. The purpose of the conveyance is to
rectify an erroneous conveyance that occurred in 1978 from Thomas and Carol
Schindler to Michael and Joyce Belford. I am enclosing the 1978 deed. I am also
enclosing a drawing of the plat of Cloverdale Estates 2 Addition marked as
Exhibit A. The area highlighted in yellow on the plat drawing is the tract
conveyed by the1978 deed to the Belfords and is described as follows:
All that part of the Northeast Quarter of the Southeast Quarter (NE
1 /4 SE 1 /4) of Section Ten (10), in Township One Hundred Twenty -
four (124) North, of Range Twenty -nine (29) West, in Stearns
County, Minnesota, described as follows, to -wit: Beginning at a

Number 52 which lies 462 feet due East from the West line of the
said NE 1 /4 of the SE %4 of Section 10; thence in a Southerly
direction along a line lying parallel to the West line of the said NE
1 /4 of the SE 1 /4 of Section 10 a distance of 218 feet; thence at a
right angle West a distance of 66 feet; thence at a right angle North
to the Southerly right -of -way line of Old Trunk Highway Number
52; thence in an Easterly direction along the said Southerly right -of
way line of Old Trunk Highway Number 52 to the point of
beginning, according to the U.S. Government Survey thereof on
file and of record in the Office of the County Recorder in and for

THE MISTAKE:
The Schindlers intended to keep the southern portion of the above described property. I am
enclosing a second copy of the plat drawing marked as Exhibit B. The area highlighted in
yellow is the southern portion and is described as follows:
All that part of the Northeast Quarter of the Southeast Quarter (NE '/4 SE 1/4) of
Section Ten (10), in Township One Hundred Twenty -four (124) North, of Range
Twenty -nine (29) West, in Stearns County, Minnesota, described as follows, to-
wit: Beginning at a point on the Southerly right -of -way line of Old Trunk
Highway Number 52 which lies 462 feet due East from the West line of the said
NE 1 /4 of the SE 1 /4 of Section 10; thence in a Southerly direction along a line lying
parallel to the West line of the said NE 1 /4 of the SE 1 /4 of Section 10 a distance of
218 feet; thence at a right angle West a distance of 66 feet; thence at a right angle
North to the Southerly right -of -way line of Old Trunk Highway Number 52;
thence in an Easterly direction along the said Southerly right -of way line of Old
Trunk Highway Number 52 to the point of beginning, which lies South of a line
drawn from the most Northerly corner of Lot 2, Block 1, Cloverdale Estates 2nd
Addition, a duly recorded plat in Stearns County, Minnesota, to the Northwest
corner of Lot 3 in said Block 1.
Thomas and Carol Schindler have occupied and used the property since 1978. The mistake was
never corrected, and the Schindlers do not have a deed. Samuel Johnson and Anne Buckvold,
the current owners of the property, have agreed to give the Schindlers a Quit Claim Deed. The
property will be attached to a contiguous tract owned by Thomas and Carol Schindler at 807
Abel Street East, St. Joseph, Minnesota, described as follows:
Lot Two (2), Block One (1), CLOVERDALE ESTATES 2 ADDITION,
according to the plat and survey thereof on file and of record in the office of the
County Recorder in and for Stearns County, Minnesota.
Enclosed please find an executed Quit Claim Deed from Johnson/Buckvold to the Schindlers.
The legal description used on this Quit Claim Deed is the legal description prepared by Randy
Sabart. He has approved this legal description.
Please review the proposed transfer and if the split is approved, issue a Certificate of
Compliance.
