Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in regular
session on Monday, December 6, 2010 at 7:00PM in the St. Joseph City Hall.
Members Present: Chair S. Kathleen Kalinowski, Commissioners Ross Rieke, Rick Schultz, Mike Deutz,
Brian Orcutt, John Meyer, Dale Wick and City Administrator Judy Weyrens
Others Present: Jason Pekarek
Deutz made a motion to approve the agenda with the following deletion:
Approval of the Agenda:
Delete 5 Ordinance Amendment – 52.21 Transportation Corridor Overlay
The motion was seconded by Schultz and passed unanimously.
Orcutt made a motion to approve the minutes of November 1, 2010 with
Approval of the Minutes:
minor changes. The motion was seconded by Deutz.

Public Hearing, Interim Use Permit – 114 1 Avenue SE: Kalinowski called the Public Hearing to order.
Weyrens stated that the purpose of the hearing is to consider an Interim Use Permit to allow an owner

occupied rental at 114 1 Avenue SE. The property is legally described a Lot 4, Block 3, Loso’s 2
Addition.
St. Joseph Code of Ordinances 52.27 Subd. 5 allows for an Interim Use Permit as follows: Residential
rental provided the unit is owner occupied and provided the room(s) rented does not contain separate
kitchen facilities and is not intended for use as an independent residence. For purposes of establishing if
the property is owner occupied, the owner must be a natural person, and all owners must occupy the
property as their principal residence. The owners may not exceed two in number. For purposes of
determining ownership, the owner/owners must provide a copy of a recorded deed or recorded contract
for deed. A purchase agreement will not be accepted as evidence of ownership.

The request for Interim Use was submitted by Jason Pekarek, 114 1 Avenue SE.
The public hearing was closed as there was no one present wishing to speak.
Wick made a motion to authorize the Planning Commission Chair and Administrator to execute
the Findings of Fact recommending the Council issue an Interim Use Permit to Jason Pekarek to

operate an owner occupied rental unit at 114 1 Avenue SE. The motion was seconded by Meyer
and passed unanimously.
Orderly Annexation: Deutz stated that, today, he received a public hearing notice regarding some
rezoning of the industrial zoning district in the Orderly Annexation Area and surrounding areas. He
questioned the purpose of the hearing. Weyrens explained that, previously, a new board was created to
handle issues in the Orderly Annexation Area. In the Urban Expansion Area, there are some properties
that are zoned Industrial. Rezoning those properties does not change the use; rather it allows the Joint
Planning Board to act on all requests. Weyrens added that all land uses should be consistent with the
future land use. Deutz expressed his dissatisfaction with how this was presented to the affected property
owners. Weyrens stated that she would contact the Stearns County and see if a notice clarifying the
process could be forwarded to all property owners.
January Meeting: Kalinowski questioned whether January 3 is a holiday or whether or not they will
conduct their meeting.

Board Vacancy: Rieke questioned whether or not a new member will be appointed to the Planning
Commission once Schultz takes office as Mayor. Wick advised Rieke that he will still be a member of the
commission until he takes office on January 6, 2011.
Wick made a motion to adjourn; seconded by Schultz and passed unanimously.
