The Planning Commission recommended approval of the amendment. BACKGROUND INFORMATION: The City Council considered the recommendation of the Planning Commission in October 2010 and approved all the amendments with the exception of the Parking. The Council requested the Planning Commission review the amendment as it relates to parking pads and how residents can accommodate the storage of recreational vehicles. THIS PAGE INTENTIONALLY LEFT BLANK Extract of City Council Minutes October 21, 2010 Ordinance Amendments, Ordinance 52.10. Parking: Weyrens reported that the Planning Commission recently held a public hearing for the potential amendments to the Parking Ordinance. The proposed amendments include the definition of a parking pad, where it can be located and how it can be constructed. Another possible amendment was to remove the requirement of perimeter curbing in the downtown area [131 Zoning District] if there is adequate drainage. Rassier clarified that the curbing relief is not guaranteed, rather there must be proof that water issues will arise is curbing is installed. [see Ordinance 52.10 Subd 5(g)]. There were also some changes made with respect to parking pads for residential units in all Zoning districts. Jansky expressed that they have some issues with enforcing the ordinance as it is currently written. Some residents have put down crushed gravel as a parking pad and then weeds begin to grow through it. The tough question is whether or not that is still considered a parking pad. From an enforcement standpoint, Jansky stated that it is best to have a definition of what is acceptable and what is not. Weyrens stated that other cities have the same issues. She added that staff recommended that there be access to a street or alley from the parking pad and thought it would be best to have a setback. According to Loso, the intent of the Ordinance was to prohibit parking on the grass in the front yard. Weyrens stated that society has changed over the years and people have a number of toys such as boats, snowmobiles, trailers, campers and adjoining property owners often complain about having to took out their window and see vehicles or recreation equipment parked on the lawn. Loso stated that not everyone has a place to store boats, etc and parking pads should be installed for that purpose. Weyrens stated that a hearing was already held, but the Ordinance can still be changed. Loso stated that he would like to see a more common sense approach. Wick added that, from a timing standpoint, this is a bigger issue in the spring, summer and fall rather than during the winter. Loso stated that it seems as though some of these violations are "grandfathered" in until a building permit is issued; whereas, the new homes are designed to allow for the newer toys. There was considerable discussion regarding how much of the front yard can be covered with a parking pad. Rassier would like to see parking pads in the front yard to be more uniform. He also stated that people are not required to pave the surface rather they must have a hard surface. Loso made a motion to send this back to the Planning Commission for further discussion conveying the discussion by the Council to include the language relating the parking of recreational or power sports vehicles. The motion was seconded by Symanietz. Discussion: The Council clarified that the only portion of the Ordinance amendment in question is that which relates to the parking pad provisions. The amount of required off4trad puking space for new uses or buildings, additions thereto and additions to existing buildings as specified previously, shall be determined in accordance with the following table, and the space so regtw W and shall be irrevocably reserved for such use, except these requirements shall not apply to uses in existing buildings within the Central Business District of St Joseph. The amount of required off - street parking in the Central Business District for existing or new uses and improvements to existing buildings which do not increase the area used for commercial or resi use shall be determined by the Planning Commission with approval by the City Council prior to the issuance of a building permit. The amount of panting space required shall be based on the anticipated demand for parking and loading space, the length of visits generated by the particular business, and the availability of other parking spaces in the Central Business District. The Central Business District shall be located within the following boundaries: Properties lying to the West of First Avenue Northeast; lying East of Second Avenue Northwest; lying North of Minnesota Street; and lying South of the emilwest alley which is between Minnesota Street and Ash Street. Members Present: Chair Sister Kathleen Kalinowski, Commissioners Ross Rieke, Rick Schultz, Mike Deutz, Brian Orcutt, John Meyer, Dale Wick and City Administrator Judy Weyrens Ordinance Uodate — Parking: Weyrens stated that staff has received lots of complaints regarding parking on the grass and thus the Commission should begin discussing the parking Ordinance. Rieke stated that he recently read an article about a new system in which a metal grid can be buried under the dirt and .then the area would be seeded to allow for parking on the grass. Weyrens stated that she is aware of that system, but staff will continue to receive calls regarding parking. Weyrens questioned the Commissioners as to whether or not they have any thoughts on parking in yards. According to Deutz, Ordinances are only as good as they are enforced. Weyrens explained that the problem with enforcing the ordinance is related to how it is currently written. She suggested either removing the provision for no parking on the grass or define a parking pad. Rieke stated that in order for enforcement to be enforceable, there needs to be a definition. Weyrens also stated that staff wants to look at parking in the B1 District with respect to perimeter curbing that is required where it is impossible 6(a):13 ✓` A G� a 1 i September 13, 2010 Page 3 of 7 Deutz made a motion to recommend approval of the rezoning from AG to R4 Rezoning. The motion was seconded by Orcutt and passed unanimously. Public Hearing, Ordinance Amendments: Kalinowski opened the Public Hearing. Weyrens stated that the purpose of the hearing is to consider amendments to the City of St. Joseph Zoning Ordinance: • Ordinance 52.06 Building Permits Required • Ordinance 52.10 Parking • Ordinance 52.12 General Performance Standards • Ordinance 52.21 Transportation Corridor Overlay • Ordinance 52.22 Outdoor Dining • Ordinance 52.31 131 - Central Business District • Ordinance 52.32 B2 - Highway Business • Ordinance 52.33 B3 - General Business • Ordinance 52.34 LI - Light Industrial • Ordinance 52.35 Educational and Ecclesiastical • Ordinance 58 Telecommunications Weyrens stated that since the last meeting, all of the business districts were amended to include the provision to relieve the requirement for site plan approval by the Planning Commission if plans are consistent with Zoning District. Ordinance 52.06 - Building Permits Required: This amendment clarifies that building permits are required for all work in the City to include shingling, siding and window replacement: Meyer made a motion to approve the amendment to Ordinance 52.06. The motion was seconded by Deutz and passed unanimously. Ordinance 52.10 — Parking: This amendment includes provisions for shared parking spaces, delineating parking and requirements; provide relief from curbing in 131 Zoning Districts. Meyer suggested the following changes/corrections: 52.10 -6 (g) "... as may be amended, may be exempted from perimeter..." 52.10 -8 (f) Meyer stated that the following "... Parking pads shall not occupy a viewing triangle measuring twenty -five (25) feet from the curb intersect at intersections of two or more public streets." conflicts with Ordinance 52.12 Subd. 10 (a)(1)(13)(iv) which states "... If stored on a comer lot they are not closer than twenty feet from the property line abutting side street. ". The Commissioners asked Sabart for clarification on this provision. Sabart replied that there is no standard, but he would prefer that the Ordinance refer to a distance from the property line rather than the curb. Meyer made a motion to approve the amendment to Ordinance 52.10 with the following change: Subd. 6(t) "... Parking pads shall not occupy a viewing triangle measuring not closer than twenty feet from the property line abutting a side street" The motion was seconded by Deutz and passed unanimously. Ordinance 52.12 — General Performance Standards: This amendment adds a fence provision for Commercial and Industrial Zoning Districts; removing duplicate language regarding parking which is referred to in Ordinance 84 and Junk Cars. Schultz made a motion to approve the amendment to Ordinance 52.12. TMeae properties consist of Single Family, Townhome, Duplex and Patio Homes, single - family detached and single - family attached. When can vehicles park: 1. Zoning sections 52.12 (R-1), 52.13 (R -2) and 52.14 (K-3) all have a section titled. "Yard Cover". In all cases, it notes that motor vehicles may not be left perked or unattended on or within a yard. 2. A yard is defined as open space on a lot which is unoccupied and unobstmCW fi= its lowest level to the sky, except as otherwise permitted in this Ordinance. This would include any front, side or rear yard. 3. TMe only exception to parking in any yards is that designated driveways may be used for parking of vehicles. Cars parked on an unimproved surface mostly occur in the older parts of town where we have a mix of rentals and older people on fixed incomes. We would like to get the cars off the grass or dirt, but we are concerned that this would create a hardship for some of the older folks that don't have a bituminous driveway. Further complicating the issue is the Benton County Fair. Homeowners around the fair sell parking spaces on their lawns. Politically it would be hard to changes this. Also because the fair doesn't really have dedicated parking areas, it does serve a functional purpose. No more than one (1) recreational vehicle may be parked or stored in the front yard. No more then one Class A motorhome may be parked or stored on a residentially zoned property. Class A motorhomes typically resemble a bus, are entirely constructed on a specially designed motorhome chassis, and often include multiple slide -out sections, living space, kitchens, bathrooms, and entertainment centers. 2. Size. a. No recreational vehicles greater than 45 feet in length shall be permitted on any residential lot in the city. b. The total lot coverage of all recreational vehicles stored outside may not exceed 10% of the lot area. 3. Location. Recreational vehicles may be parked or stored on a parcel which contains a permitted principal use to a residential zoning district, subject to the billowing regulations: a. Surfaces.
