JOSEPH NOTICE OF HEARING ON IMPROVEMENT Park Terrace Improvements Administrator To Whom It May Concern: Judy Weyrens Notice is hereby given that the City Council of St. Joseph will meet at the St. Joseph Community Fire Hall, 323 41h Avenue NE, on Thursday, April 14, 2011 at 7:OOPM to consider the making of Mayor an improvement of the public street and alley rights -of -way and associated public utilities Rick Schultz located in the front and rear yards along the north side of Minnesota Street (CSAH 2) between a point 400 feet west of 4th Avenue NW and 3rd Avenue NW, along 4th Avenue NW between Minnesota Street W (CSAH 2) and Birch Street W, along 5th Avenue NW between 4th Avenue Councilors NW and a point 200 feet north of Birch Street W, along Ash Street W between 5th Avenue NW Steve Frank and 4th Avenue NW, along Birch Street W between 5th Avenue NW and 2nd Avenue NW, and Bob Loso along Old Highway 52 between Birch Street W and a point 200 feet northwest of Birch Street W Renee Symanietz by constructing sanitary sewer, water main, storm drain, grading, bituminous street with concrete curb and gutter, and surface restoration improvements, pursuant to Minn. Stat. Dale Wick § §429,011 to 429.111. The estimated cost of the improvement is $2,200,000.00. A reasonable estimate of the impact of the assessment will be available at the hearing. Such persons, as desire to be heard with reference to the proposed improvement, will be heard at this meeting. Hearing notice published on April 1 and April 8 b. Notices mailed to affected property owners —week of March 28 April 21, 2011 City Council determines if the Park Terrace project will: a. Approves Resolution to design the project for construction b. Table for additional information c. Suspend the project If the project moves forward: April 21 /May 5, 2011 City Council adopts resolution ordering improvement, Engineer begins design of Project. Project designs time —10 to 12 weeks June /July Begin the process to determine eligibility for DEED Assessment Abatement September City Council reviews design and accepts the documents for bidding Sept /Oct a. If applicable — DEED Grant application must be submitted b. Council review design, approves solicitation of competitive bids C. City Engineer requests competitive bids November Council conducts Assessment Hearing 2012 January City Council considers bid, either awarding or rejecting February Awards are announced for DEED April /May Contract documents are prepared and project begins when weather permits CITY OF ST. JOSEPH WWW. cityof stjoseph.com This official notice of public hearing is being sent to inform you that the City Council of the City of St. Joseph will be conducting a public hearing at 7:00 PM on Thursday, April 14, 2011 at the St. Joseph Community Fire Hall, 323 — 4th Avenue SE, to consider the proposed public improvement as listed on the attached hearing notice. If these proposed improvements are approved by the City Council, property in your ownership abutting these improvements will be Administrator assessed for the benefit. Judy Weyrens We are taking these means of informing you of the procedures followed and the policies established by the City Council with regard to the proposed improvements. Mayor 1. At the time of the public hearing anyone wishing to speak in favor of or in opposition Rick Schultz to the proposed improvements, or having questions relating thereto, will be heard by the Council. (Note: You are not required to attend this meeting). Written testimony Councilors may be directed to the City Administrator, City of St. Joseph, PO Box 668, St. Joseph Steve Frank Minnesota, 56374. After concluding the public hearing, the City Council will take one of the following Dale Wick actions: a) Approve the proposed improvement requesting the Engineer to prepare the plans and specifications. b) Table the action to a future meeting, the date of which will be announced at this same time. c) Request modification of the project with revised plans submitted to the City Council. d) Reject the proposed improvement. 3. Should the City Council elect to approve the improvement, it is anticipated that bids for will be received fall 2011 for construction spring of 2012. 4. After preparation of the assessment roll, each owner receives a notice of the proposed assessment to his /her property and the City Council conducts a public hearing on the proposed assessment. The assessment hearing is conducted after the bids are received but before the City Council awards the project. The final decision on the making of the improvement occurs when or if the City Council votes to award the project. 5. Assessments are based on actual project costs (construction, engineering, administration and capitalized interest). The assessed amounts may vary from estimated costs, depending upon the actual project cost. 6. Following approval of the assessment roll, as proposed or as amended, you will be sent a bill of your actual assessment. The City Council's policy for payment of the assessment allows payments in the following manner: ZS College Avenue North . PO Box 668 . Saint Joseph, Minnesota 56374 Phone 320.363.7201 Fax 32.0.363.0341 a) Payment in full or a partial payment of the assessment to the City of St. Joseph, within 30 days of the date of the assessment bill. Payments must be submitted to the City Offices. b) After 30 days from the date of the assessment bill, but before September 15, 2012, payment of the entire amount of the assessment plus interest estimated at a rate of 5.5% per year, computed from the date of the Council resolution adopting the assessment roll to the date of payment. Payments must be submitted to the City Offices. (Note: The interest rate will be determined at the time of bonding for the improvement.) c) On or about October 1, 2012 the Finance Director will certify the unpaid assessment balance to the County Auditor for collection. Payments will then be made in annual installments over either a 10 or 15 year period. The term will be determined at the assessment hearing. These payments shall be payable in the same manner as real property taxes, with the first installment payment due on May 15, 2013. The first installment shall be added interest at the estimated rate of 5.5% of the entire assessment amount computed from the date of the Council resolution adopting the assessment roll to December 31, 2013. Thereafter, the assessment shall be divided into equal annual payments. Once the assessment has been certified to the County Auditor for collection, the assessments may be paid in full to the City Offices with interest accrued to December 31 of the year in which payment is made. d) A homestead property whose owner is 65 years of age or older may be eligible for a deferment of special assessment.
